What it does
Mechanically, the Tumbarumba Local Environmental Plan 2010 (the Plan) sets the legal land-use framework for the area identified on its Land Application Map. It does this by zoning land, fixing the rules for what development is permitted, requiring development consent for specified activities, creating exempt and complying development pathways, and imposing a set of local development standards and matters for consent. The Plan commences on publication on the NSW legislation website (cl 1.1AA), and the consent authority for the Plan is the Council (cl 1.6). The Plan also repeals earlier local environmental plans that applied solely to this land (cl 1.8) and contains a savings provision that preserves the legal status of development applications made before commencement (cl 1.8A).
Operationally the Plan converts policy into binding development controls and mapped instruments. It identifies the Land Zoning Map and other maps (Lot Size Map, Land Reservation Acquisition Map, Heritage Map, Natural Resources Sensitivity,Biodiversity Map, Additional Permitted Uses Map, Industrial Buffer Map, Horticultural Land Map) as statutory instruments to which the Plan refers (cl 1.7, cl 1.3, multiple clauses referencing maps). The Land Use Table (Part 2, cl 2.3) prescribes for each zone the objectives, development that may be carried out without consent, development that may only be carried out with consent, and prohibited development. Where a State environmental planning policy (SEPP) prevails over the Plan, the SEPP applies as provided by s 3.28 of the Environmental Planning and Assessment Act 1979 (the Act), and the Plan recognises that (cl 1.9(1)).
The Plan establishes minimum subdivision lot sizes and subdivision consent rules (cl 4.1, cl 2.6), specific controls for rural subdivision and the erection of dwellings in specified rural and conservation zones (cl 4.2, cl 4.2A), detailed local controls for aquaculture (cl 5.19 and Schedule 6), biodiversity, land, water and earthworks (cl 6.2-6.5), heritage controls (cl 5.10 and Schedule 5), flood planning duties (cl 5.21), rules on temporary uses (cl 2.8), a prohibition on canal estate development (cl 2.9), and a local rule preventing refusal of consent to licensed premises solely on many music-related grounds (cl 5.20). The Plan also provides for classification and reclassification of public land (cl 5.2 and Schedule 4), designates relevant acquisition authorities for mapped reservation lands (cl 5.1), and specifies additional permitted uses for particular mapped parcels (Schedule 1). Several standard controls commonly seen in LEPs (height, floor space ratio) are noted as not adopted in this Plan (cl 4.3-4.5).
