sec.62 Duty of other trustees
This section applies to a trustee if— the trustee is not a professional trustee; and section 61 does not apply to the trustee. The trustee has a duty, in administering a trust, to exercise the care, diligence and skill that a prudent person of business would exercise in managing the affairs of other persons. (sec.62-ssec.1) This section applies to a trustee if— the trustee is not a professional trustee; and section 61 does not apply to the trustee. (sec.62-ssec.2) The trustee has a duty, in administering a trust, to exercise the care, diligence and skill that a prudent person of business would exercise in managing the affairs of other persons.
- (a) the trustee is not a professional trustee; and
- (b) section 61 does not apply to the trustee.
