sec.163 Persons who may apply for particular orders relating to trusts and trust property

This section applies to an application to the court for any of the following orders in relation to a trust— an order under section 15 approving the appointment of more than 4 trustees of the trust; an order under section 166 appointing a new trustee; an order under section 166 removing a trustee; an order under section 168 disqualifying a person from being appointed as a trustee or removing the person as a trustee; an order under this Act relating to the trust property. The application may be made by— a trustee; or a person applying to be appointed as a trustee; or a person who is beneficially interested in the trust property; or a person in whose favour a power to distribute the trust property may be exercised. Also, a custodian trustee may apply for an order mentioned in subsection (1) (b) . Subsection (2) does not apply if another provision of this Act provides for the persons who may apply to the court in relation to the particular matter.
