Trustee Regulations 2011

The regulations operate by converting broad statutory references in the Trustee Act 1936 into concrete, administrable requirements. Three main conceptual functions appear across the text:

1. Specification of prescribed entities: r 4 narrows the universe of “prescribed insurers” for s 13A(1)(b) of the Act to insurers authorised under the Commonwealth Insurance Act 1973 to carry lender’s mortgage insurance. The concept is functional: when the Act requires a “prescribed body” for that purpose, the regulation supplies the qualifying criterion based on Commonwealth authorisation for a particular class of insurance business. The regulation therefore links a South Australian statutory reference into Commonwealth regulatory authorisation.

2. Detailed record-keeping as a governance and audit enabler: r 5 implements a prescriptive records regime for trustees pursuant to s 84B of the Act. The regime is granular. It treats administration records as a collection of document types (authorising instruments, correspondence, statutory declarations and affidavits, deeds and tax returns), ongoing operational registers (securities, property, investments, cash receipts and payments), ADI statements and annual trust statements (r 5(1)(a)-(k)(vii)). The concept is that trustees must maintain a set of records that together permit “the receipt and disposition of trust property to be conveniently and properly audited” (r 5(1)(k)).

3. Professional gatekeeping for inspectors: r 6 defines the professional qualifications for persons who qualify as inspectors under s 84C of the Act. The conceptual choice is to limit the inspector pool to certain regulated professions and certifications: registered auditors under the Corporations Act, legal practitioners under the state Legal Practitioners Act, a named forensic accounting certification, and registered liquidators (subject to exclusions). The regulation thus ties investigatory or inspection authority under the Act to recognised professional credentials set by other statutes and a professional body.

Cross-cutting concepts: the regulations rely on and reference external legal regimes (Commonwealth Insurance Act 1973; Corporations Act 2001; Legal Practitioners Act 1981; Chartered Accountants certification). They set both content and procedural standards , what must be kept, how it should be recorded (registers and entries), and for how long (minimum five years after trust termination) (r 5(3)). They also require separate accounting for separate trusts (r 5(2)), implying legal separability of trust records even under a single trustee.

The regulations name and affect a small set of actors directly; these actors bear the obligations and costs or exercise the decisions specified.

• Trustees: The primary duty-bearer is any trustee administering trust property to which s 84B of the Act applies. Trustees must maintain the catalogue of records listed in r 5(1) for each trust they administer, keep separate records where more than one trust is administered (r 5(2)), and retain those records for at least five years after termination of the trust (r 5(3)). Trustees decide how to produce and store records in legible written form or the format readily convertible into such a form (r 5(3)).

• Inspectors and persons appointed under s 84C: Those who act as inspectors under s 84C must meet the prescribed qualifications in r 6. The qualification gate narrows eligible persons to registered auditors under Division 2 of Part 9.2 of the Corporations Act 2001, legal practitioners within the Legal Practitioners Act 1981, CA Forensic Accounting Specialists certified by Chartered Accountants Australia and New Zealand, and registered liquidators under Part 2 of Schedule 2 of the Corporations Act 2001, subject to specified exclusions (r 6(a)-(d)). Entities that would appoint inspectors (eg, courts, beneficiaries, or other statutory appointers under the Act) will be constrained by these professional criteria when selecting an inspector.

• Insurers relevant to the Act’s s 13A(1)(b): Insurers authorised under the Commonwealth Insurance Act 1973 to carry lender’s mortgage insurance are the prescribed bodies under r 4. The regulation therefore affects which insurance companies can be relied upon as prescribed insurers for that section. Entities that are not authorised under the Commonwealth Insurance Act 1973 to carry lender’s mortgage insurance are not prescribed by this regulation for the purposes of s 13A(1)(b).

• Beneficiaries and third-party service providers: Beneficiaries are indirectly affected because trustees must preserve certain beneficiary-related documents where applicable, including personal tax returns for beneficiaries (r 5(1)(e)). Third-party providers such as valuers, investment advisers and banks will be involved: the trustee must keep independent valuations obtained (r 5(1)(f)) and a record of any investment adviser report and decisions (r 5(1)(i)); ADI statements and passbooks must be retained (r 5(1)(k)(vi)). Those service providers therefore participate in the information flow trustees must preserve.

• Auditors and regulators: The record format and registers are explicitly intended to enable auditing (r 5(1)(k)). Auditors, whether internal or external, and regulators tasked with oversight under the Act will interact with the specified records when assessing trust administration.

Who pays: the regulation places record-keeping and inspector-engagement costs on trustees and, ultimately, on the trusts themselves. Whichever party bears those costs (the trustee personally or the trust estate) depends on trust instruments and the law as to trustee indemnity , not specified here. Who decides: trustees decide the operational methods to meet the requirements; appointing bodies must choose inspectors who meet r 6 qualifications; ministers or the Governor in Council made the regulation and amended it in 2011 and 2025 (Legislative history).

The regulation creates precise duties for trustees and qualification constraints for inspectors; it does not itself grant substantive rights to beneficiaries beyond the records regime, nor does it create statutory penalties in the text. The principal duties and operational rights arising from the text are:

Duties of trustees (r 5):

• Maintain a comprehensive set of records relating to administration of trust property, specifically enumerated in r 5(1)(a)-(k)(vii). That list includes:
  • Each document authorising the trustee to act (r 5(1)(a)).
  • Every letter received and a copy of each letter sent (r 5(1)(b)).
  • Copies of statutory declarations and affidavits made during administration (r 5(1)(c)).
  • Deeds, agreements or instruments varying distribution, or stamped duplicates (r 5(1)(d)).
  • Copies of all returns made as to any duty, charge or tax imposed by the Commonwealth or any State or Territory, including trust income tax returns and personal tax returns for beneficiaries where applicable (r 5(1)(e)).
  • Written instructions for sale or transfer of trust property and any independent valuations obtained (r 5(1)(f)).
  • Minutes of meetings relating to administration where the trustee was or was entitled to be present (r 5(1)(g)).
  • A record of insurance cover in respect of assets forming part of the trust (r 5(1)(h)).
  • Reports from investment advisers and a record of decisions made on such reports, plus records of investment reviews (r 5(1)(i)-(j)).
  • Detailed registers and books for securities, property, investments, cash receipts and payments, ADI statements and an annual trust statement (r 5(1)(k)(i)-(vii)). The trusts statements must show cash receipts and payments, other property received or transferred, and assets and liabilities as at the statement period end (r 5(1)(k)(vii)(A)-(C)).
• Keep separate records for each trust where more than one trust is administered by the trustee (r 5(2)).
• Retain all records in legible form or readily convertible to such a form for at least five years after termination of the trust (r 5(3)).

Duties related to inspectors (r 6):

• Persons acting as inspectors under s 84C must meet one of the prescribed qualifications in r 6(a)-(d). Those qualifications prescribe who is professionally eligible to inspect trust administration under the Act.

Rights and operational effects:

• The regulations do not explicitly create new rights for beneficiaries in the text provided; rather they set record-keeping standards that enable auditing and scrutiny, which in practice supports beneficiary rights under the Act to information and oversight. The text makes express that the registers and records will enable the “receipt and disposition of trust property to be conveniently and properly audited” (r 5(1)(k)), implying a procedural facilitation of oversight.
• Trustees retain discretion over how to store records so long as they are legible or readily convertible to legible form (r 5(3)), and they must judge which beneficiary personal tax returns are “applicable” for retention (r 5(1)(e)).

Limits of the instrument:

• The regulations do not by themselves set sanctions; enforcement mechanisms and any offences or remedies are left to the Act referenced in the regulation headings (r 4, r 5, r 6 refer to sections of the Act). The regulation content is prescriptive, but the legal consequences of non-compliance are governed by the parent Act.

The regulation text supplied contains no standalone penalty schedule and does not itself specify enforcement procedures or sanctions. The instrument operates as subordinate legislation that defines content for sections of the Trustee Act 1936 (r 4, r 5, r 6 refer expressly to provisions of the Act). The following points, drawn strictly from the text, summarise enforcement-related boundaries and implications:

• Absence of express penalties in the regulations: The regulations list duties and qualifications but do not attach a penalty quantum, criminal offence, or administrative sanction within the regulation text. Where the Act imposes consequences for failing to keep records or for improper administration, these regulations give content to the obligations that enforcement under the Act would address. The regulation itself does not replicate or restate enforcement provisions. Practitioners should therefore look to the Trustee Act 1936 for the statutory enforcement regime applicable where these regulated duties are not met.

• Enforcement enabler through auditable records: The r 5(1)(k) record regime is constructed to “enable the receipt and disposition of trust property to be conveniently and properly audited”. That phrase signals intent that the records serve as the evidentiary foundation for audits and inquiries. The regulations thereby define the documentary baseline that auditors, inspectors appointed under s 84C, and other authorised enforcers would examine.

• Inspector qualifications inform investigatory capacity: r 6 prescribes who may be appointed as an inspector under s 84C. Although the regulation does not state who appoints inspectors or what powers they will exercise, restricting the pool to registered auditors, legal practitioners, specified forensic accountants and certain registered liquidators links inspection to qualified professionals who can produce audit, legal or insolvency analyses. The substantive powers and enforcement implications of an inspector’s appointment remain as set out in the Act; the regulation confines the professional profile of those persons.

• Practical enforcement mechanisms implied but not enacted by the regulation: Because records must be kept, retained and structured for audit, the practical enforcement pathway is that an inspector, auditor or statutory authority will review the prescribed registers and documents. Any findings leading to enforcement, penalties or remedial orders would arise under the Act or other applicable legislation, not under a penalty clause in these regulations.

In short, the regulations prescribe the documentary and professional infrastructure that enforcement and sanctions under the Trustee Act will rely upon, but they do not themselves declare offences or penalties.

The regulations explicitly cross-reference and depend on definitions, registrations and authorisations that sit in other statutes and professional systems. Those interactions determine qualification thresholds, evidence features and external reporting obligations:

• Commonwealth Insurance Act 1973 (sourced by r 4): r 4 prescribes, for the purposes of s 13A(1)(b) of the Act, that a “prescribed body” is a body authorised under the Commonwealth Insurance Act 1973 to carry on lender’s mortgage insurance. The regulation therefore imports a Commonwealth authorisation test to determine which insurers are treated as prescribed for a South Australian statutory provision. The interaction is normative: federal licensing determines state-law status for the regulation’s purpose.

• Corporations Act 2001 (Cth) (r 6 references): r 6(a) and r 6(d) rely on two concepts from the Corporations Act:

  • An auditor registered under Division 2 of Part 9.2 of the Corporations Act 2001 qualifies as an inspector (r 6(a)).
  • A registered liquidator within the meaning of Part 2 of Schedule 2 of the Corporations Act 2001 qualifies, with express exclusions for those registered only as restructuring practitioners or as receivers and receiver/managers (r 6(d)(i)-(ii)). The regulation therefore ties inspector eligibility to federal registration schemes for audit and insolvency professionals.

• Legal Practitioners Act 1981 (SA) (r 6): r 6(b) recognises legal practitioners within the meaning of the Legal Practitioners Act 1981 as eligible inspectors. That legislated definition determines who counts as a practitioner for r 6(b).

• Chartered Accountants Australia and New Zealand certification (r 6(c)): r 6(c) recognises the CA Forensic Accounting Specialist certification as a qualifying credential. The regulation thus recognises professional accreditation standards set by a non-statutory professional body as sufficient for inspector qualification.

• Taxation and other Commonwealth/State duties (r 5(1)(e)): r 5(1)(e) requires trustees to retain copies of “all returns made as to any form of duty, charge or tax imposed on the trust by the Commonwealth or any State or Territory of the Commonwealth (including trust income tax returns and personal tax returns for beneficiaries where applicable)”. That provision requires trustees to keep records touching federal and state tax filings, embedding an interaction between trust administration and tax law compliance and record retention obligations.

• Banking/ADI frameworks (r 5(1)(k)(iv)-(vi)): The regulations refer to ADI accounts and ADI statements and passbooks, requiring trustees to record deposit dates into ADI accounts and retain ADI statements. Those references import the banking account framework handled under federal banking regulation (including the meaning of ADI), and require trustees to tie their records to financial institution documentation.

• Evidence and procedure rules (statutory declarations, affidavits) (r 5(1)(c)): Requirement to keep statutory declarations and affidavits links trust administration records to procedural and evidence requirements in other statutes and rules of court that govern those instruments.

Operationally, these interactions produce practical cross-border compliance requirements: trustees must align record-keeping and inspector selection with federal registrations and professional standards as well as state statutory definitions. Where the regulation calls for documents whose form or existence is governed by other laws (tax returns, ADI statements, statutory declarations), trustees must secure and retain those external documents to satisfy the state regulation.

The legislative history also shows interaction with the Legislation Revision and Publication Act 2002, which led to omission of r 2 and Sch 1 on 12 March 2025; and an instrument (2011 No 207) that commenced in 2011 and an amending instrument in 2025 (No 8) that amended r 6. Those entries indicate the regulation has been varied to remain aligned with other legislative or drafting frameworks.

The regulation text includes a concise recorded history of enactment, revocation and later amendment events. The main entries in the legislative history supplied are:

• Enactment and commencement in 2011: The Trustee Regulations 2011 were made and published as the principal regulations in 2011 (No 207, Gazette 25.8.2011 p 3716). Commencement note indicates r 2 came into force on 1 September 2011 (Legislative history entry: 2011, No 207, Gazette 25.8.2011 p3716; 1.9.2011: r 2).

• Revocation of previous regulations: The 2011 regulations revoked the Trustee Regulations 1996, recorded under “Legislation revoked by principal regulations”.

• 2025 variation: An amendment instrument appears in 2025 (No 8, Gazette 12.3.2025 p294), with commencement on 12 March 2025 (Legislative history entry: 2025, No 8, Gazette 12.3.2025 p294; 12.3.2025: r 2). The 2025 instrument effected at least two drafting consequences recorded in the notes:

  • r 2 was omitted under the Legislation Revision and Publication Act 2002, effective 12 March 2025 (Legislative history, “Provisions varied” and “r 2 omitted under Legislation Revision and Publication Act 2002 12.3.2025”).
  • r 6 was amended by the 2025 instrument (8/2025 r 3(1), (2)), with the effective date 12 March 2025. The published regulation text presently contains r 6 as amended; the legislative history notes the amendment entry.

• Schedule 1 (Sch 1) omission: Sch 1 was omitted under the Legislation Revision and Publication Act 2002 on 12 March 2025, per legislative history.

The records show the regulations were intended to modernise and replace the 1996 Regulations, and that subsequent technical amendments took place in 2025 to align provisions (including omitting r 2 and Sch 1 and amending r 6). The text of the amended r 6, as provided, contains the qualifications for inspectors that include Auditor registration, Legal Practitioner status, CA Forensic Accounting Specialist certification and specified registered liquidators, with explicit exclusions.

The legislative history supplies the instruments numbers, gazette references and dates that an advisor would cite when tracking changes and the current operative provisions.

The material supplied does not include any case law, judicial decisions or references to litigation involving the Trustee Regulations 2011. The regulations text, the short legislative history and the notes supplied do not name any cases or judicial determinations.

Given the absence of reported litigation in the supplied source, the following are points to note about litigation risk and potential areas where disputes could arise if contentious facts present themselves, drawn strictly from the regulation text:

• Ambiguity over qualification thresholds may prompt contested questions: r 6 ties inspector eligibility to registrations and certifications in other regimes. Disputes could arise over whether a particular person meets those external definitions or falls within an exclusion, for example whether a registered liquidator is “registered to practise only as a restructuring practitioner” or only as a receiver and therefore excluded by r 6(d)(i)-(ii). The regulation text itself contains these exclusions; a future dispute would focus on the proper statutory interpretation of those external registration statuses.

• Content and sufficiency of records: r 5 is detailed but contains terms susceptible to factual dispute, such as what counts as “any independent valuations obtained”, what is a sufficient “copy” of a personal tax return “where applicable”, and when a record is “readily convertible” into legible form (r 5(1)(f); r 5(1)(e); r 5(3)). If questions arise about compliance with the r 5 requirements, controversies would likely focus on whether the trustee’s record-keeping met the standard required for “convenient and proper” auditability (r 5(1)(k)).

• Separation of records for multiple trusts: r 5(2) mandates separate records for each trust. Disputes could arise where a trustee uses consolidated accounting systems or mixed records; litigation might require a court to decide whether the trustee’s approach satisfied the regulation’s separate-record requirement.

• Interaction with Commonwealth registrations and authorisations: r 4 prescribes insurers authorised under the Commonwealth Insurance Act 1973. Litigation could arise about whether a particular insurer’s authorisation under the Commonwealth Act extends to lender’s mortgage insurance in the sense required by r 4.

These are hypothetical areas where disputes could occur; the supplied regulation text contains no reported litigation to date. Where litigation exists, practitioners must consult case law beyond the supplied regulation text.

The regulation contains several tightly worded requirements and cross-references that create practical traps for trustees and advisers. The following items are concrete, text-based “gotchas” to watch for:

• Separate records per trust: r 5(2) obliges trustees administering more than one trust to keep separate records “in accordance with this regulation in relation to each trust”. A trustee who maintains consolidated ledgers without clear, trust-specific segregation risks failing to meet the separate-record requirement.

• Five-year retention after termination: r 5(3) requires retention of all records for at least five years after termination of the trust. Termination triggers the retention clock; trustees must determine the precise termination date and ensure record retention continues for the five-year period in a legible form or in a form readily convertible into legible form. Failure to account for the post-termination retention window is a compliance risk.

• Breadth of documents: The list in r 5(1) is expansive. Examples that commonly surprise trustees include:

  • Requirement to keep copies of personal tax returns for beneficiaries “where applicable” (r 5(1)(e)). Trustees must determine when a beneficiary’s personal tax return is “applicable” to the trust administration and preserve it accordingly.
  • A copy of each statutory declaration and each affidavit made in the course of administration (r 5(1)(c)). Trustees who rely on oral approvals or unrecorded statements could face evidential gaps.
  • A copy of each letter sent and each letter received (r 5(1)(b)), which can create voluminous archival obligations if correspondence is frequent and multi-channel.

• ADI deposit dates and ADI statements: The cash receipt book must record the date the cash is deposited in an ADI account “where applicable” (r 5(1)(k)(iv)(F)), and trustees must keep each ADI statement and passbook in relation to trust ADI accounts (r 5(1)(k)(vi)). Failure to capture deposit dates or retain bank statements/passbooks can undermine audit trails.

• Registers must show “consideration passing” and “brief particulars of the purpose”: Both the securities register (r 5(1)(k)(i)) and property register (r 5(1)(k)(ii)) require entries for the consideration passing on receipt or disposition and brief particulars of the purpose of each transaction. Sparse entries that omit consideration detail or purpose may be non-compliant.

• Inspector eligibility exclusions: r 6(d) admits registered liquidators generally but expressly excludes those registered to practise only as a restructuring practitioner or as a receiver and receiver and manager. Parties appointing or proposing inspectors need to verify the specific registration categories before relying on a liquidator’s eligibility.

• Format and legibility requirement: r 5(3) allows records to be retained in written form or “so as to be readily convertible into such a form”. Trustees using electronic record systems must ensure records are readily convertible to legible written form when required. Failing to preserve conversion ability or using proprietary formats lacking adequate export mechanisms could breach r 5(3).

• Annual trust statements frequency: r 5(1)(k)(vii) requires trust statements prepared not less than annually, showing a set list of items. Trustees must build processes to produce formal statements at least every 12 months; ad hoc or irregular summarised reports may not satisfy the “not less than annually” formulation.

• Linkage to external authorisations: r 4’s prescription of insurers depends on Commonwealth authorisation under the Insurance Act 1973. Trustees relying on particular insurers in relation to s 13A(1)(b) must confirm the insurer’s authorisation status under the Commonwealth Act.

• Amendments and versions: r 6 was amended in 2025 (Legislative history). Practitioners must check the current consolidated regulation text for the operative wording, rather than relying on past practice or older versions.

Each of these items is spelled out in the regulation text and presents operational and compliance thresholds that trustees and their advisers must manage.

This section translates the regulation text into practical, text-grounded compliance steps for trustees and for parties who appoint inspectors under the Act.

Record-keeping compliance (r 5):

1. Inventory required documents: Create a checklist mapped to r 5(1)(a)-(k)(vii). The checklist should capture:

   • Authorising documents for the trustee (r 5(1)(a)).
   • All incoming and outgoing correspondence (r 5(1)(b)).
   • Copies of statutory declarations and affidavits given in the course of administration (r 5(1)(c)).
   • Deeds, agreements or instruments varying distributions, and stamped duplicates (r 5(1)(d)).
   • Copies of all tax and duty returns by the trust and, where applicable, beneficiaries’ personal tax returns (r 5(1)(e)).
   • Written sale/transfer instructions and any independent valuations obtained (r 5(1)(f)).
   • Minutes of all relevant meetings (r 5(1)(g)).
   • Insurance records for trust assets (r 5(1)(h)).
   • Investment adviser reports and records of decision and investment reviews (r 5(1)(i)-(j)).
   • Registers and books specified in r 5(1)(k)(i)-(vi) and annual trust statements r 5(1)(k)(vii).

2. Segregate records by trust: Where you administer multiple trusts, maintain separate physical or electronic folders/accounts for each trust per r 5(2). Ensure ledgers and registers clearly label the trust reference and do not commingle transactions.

3. Implement register templates: Adopt templates that capture required fields verbatim:

   • Securities register: date of receipt/disposition, description, consideration passing, brief purpose (r 5(1)(k)(i)(A)-(D)).
   • Property register: date, description, consideration, purpose (r 5(1)(k)(ii)(A)-(D)).
   • Investments register: date of investment, amount, particulars (r 5(1)(k)(iii)(A)-(C)).
   • Cash receipt book: date, reference number, payer name, trust reference, purpose, amount, ADI deposit date where applicable (r 5(1)(k)(iv)(A)-(F)).
   • Cash payments book: date, cheque number if applicable, payee, trust reference, purpose, amount (r 5(1)(k)(v)(A)-(F)).
   • Retain ADI statements and passbooks for trust ADI accounts (r 5(1)(k)(vi)).
   • Prepare formal trust statements at least annually showing receipts/payments, other property movements, assets and liabilities at period end (r 5(1)(k)(vii)(A)-(C)).

4. Preserve legibility and convertibility: Ensure documents are stored in formats that remain legible or are readily convertible to legible written form (r 5(3)). Keep original stamped deeds and scanned copies as backups. For electronic systems, maintain exportable formats (PDF/A or other stable formats) and migration plans.

5. Retention scheduling: Implement a retention schedule keyed to each trust’s termination date so records are kept for at least five years after termination (r 5(3)). Tag records with termination dates and put automated archival/retention holds in place to avoid premature disposal.

6. Vendor and service-provider coordination: Contractually require third parties (valuers, investment advisers, banks) to supply written reports, valuations and ADI statements suitable for retention. Record any independent valuations obtained and keep the instructions that led to sale or transfer decisions (r 5(1)(f)).

Inspector qualification compliance (r 6):

1. When an inspector is to be appointed under s 84C, confirm the candidate meets one of the r 6 categories:

   • Registered auditor under Division 2 of Part 9.2 of the Corporations Act 2001 (r 6(a)).
   • Legal practitioner under the Legal Practitioners Act 1981 (r 6(b)).
   • Certified CA Forensic Accounting Specialist (r 6(c)).
   • Registered liquidator under Part 2 of Schedule 2 of the Corporations Act 2001, ensuring they are not registered only as a restructuring practitioner or only as a receiver/receiver and manager (r 6(d)(i)-(ii)).

2. Document qualification evidence: Keep copies of the auditor’s registration, legal practitioner practising certificates, CA Forensic Accounting Specialist certification, or registered liquidator credentials to demonstrate compliance with r 6 when an inspector is nominated or appointed.

Prescribed insurer checks (r 4):

1. Where the Act’s s 13A(1)(b) is engaged, confirm the insurer is authorised under the Commonwealth Insurance Act 1973 to carry lender’s mortgage insurance. Obtain and retain documentation proving the insurer’s authorisation status if relying on a particular insurer under that provision.

Audit preparedness and practical controls:

1. Build an audit trail: Ensure every entry in registers links to supporting documents listed in r 5(1) and can be cross-referenced for audit (r 5(1)(k) emphasis on convenient and proper auditability).
2. Annual statement routine: Prepare trust statements at least annually and retain them as part of the trust record set (r 5(1)(k)(vii)).
3. Board/minute discipline: Record minutes for all meetings relating to the administration where trustees were or entitled to be present (r 5(1)(g)). Adopt minute templates capturing attendees, resolutions and decisions, linking those decisions to subsequent entries in registers and to investment adviser reports and decisions (r 5(1)(i)-(j)).
4. Data governance for beneficiary tax returns: When retaining beneficiaries’ personal tax returns, apply careful data governance processes for access control, confidentiality and secure retention consistent with trustee duties (r 5(1)(e)). Although the regulation does not specify privacy mechanisms, trustees must ensure these records are retained and available for audit while managing confidentiality.

Record conversion and legacy formats:

1. If using electronic or legacy formats, ensure you can produce legible written forms on request (r 5(3)). Retain originals when required (eg, stamped duplicates of deeds) and create certified copies where needed.

Review and update:

1. Review the regulation text and the trustee’s compliance framework whenever the regulations are amended. Note that r 6 was amended in 2025; ensure current practice aligns with the operative wording recorded in the consolidated regulation.

In sum, compliance requires constructing and operating a records system that mirrors the regulation’s enumerated items, maintaining clear segregation by trust, documenting qualifications of inspectors, and instituting retention and conversion practices keyed to the five-year post-termination requirement in r 5(3).
