4 Meaning of trust (1) In this Act, trust includes— (a) an implied or constructive trust (including a trust where the trustee has a beneficial interest in the trust property); and (b) the duties of a legal representative of a dead person. (2) However, trust does not include the duties incidental to an estate conveyed by way of mortgage.
