What it does
This Act creates a specific excise-style levy tied to a statutory concept called a true‑up shortfall. The levy is imposed where a person has a true‑up shortfall (s 8(1)), and the person is made liable to pay that levy (s 8(2)). The amount of the levy is prescribed by a formula set out in the Act (s 8(3)). The Act limits the levy so that it operates only to the extent the levy constitutes a duty of excise within the meaning of section 55 of the Constitution (s 8(4)). The Act also contains several territorial and Crown‑binding qualifications: it binds the Crown in right of the States and of the Australian Capital Territory and the Northern Territory, but not the Crown in right of the Commonwealth (s 4); it extends to every external Territory (s 5), to Australia’s exclusive economic zone and continental shelf (s 6), and to the Joint Petroleum Development Area (s 7). The Act contains a short commencement regime: sections 1 and 2 and anything not otherwise covered commence on the day of Royal Assent (s 2 and the commencement table), and sections 3 to 9 commence at the same time as Part 4 of Schedule 1 to the Clean Energy Legislation (Carbon Tax Repeal) Act 2014 (s 2 and the commencement table). Definitions are partly imported from other instruments: “person” is defined by reference to the Clean Energy Act 2011, “true‑up shortfall” is defined in Part 4 of Schedule 1 to the Clean Energy Legislation (Carbon Tax Repeal) Act 2014, and “Joint Petroleum Development Area” is defined in the Petroleum (Timor Sea Treaty) Act 2003 (s 3). The Act also contains an express non‑operation in relation to State property taxes: it has no effect to the extent it imposes a tax on property belonging to a State, with “property of any kind belonging to a State” given the meaning in s 114 of the Constitution (s 9).
The statutory mechanics therefore are: a defined event or measurement (true‑up shortfall) triggers a statutory levy, liability is placed on the person who has that shortfall, and the levy amount is determined by a statutory formula. The Act deliberately ties commencement of its operative provisions to the commencement of a provision in separate repeal legislation, indicating an implementation link between this levy and the Carbon Tax Repeal package (see s 2 and cross‑references in s 3). The Act also expressly frames the levy as an excise duty for constitutional purposes (s 8(4)) and carves out an exemption from applying to State property taxes (s 9).
