Travel Agents Repeal Act 2014

The Act is short and focused. The central legal concepts are repeal, preservation of specified pre-repeal rights and processes, and temporal limitation of the compensation scheme.

• Repeal: Section 3 performs a statutory repeal by declaring that the Travel Agents Act 1986 is repealed. That is the primary, operative act of this instrument (s 3).

• Transitional preservation: Section 4 is the core technical provision. It does not attempt to preserve the repealed Act in full. It preserves specified substantive and procedural elements of the repealed Act only insofar as they relate to matters occurring before the repeal date. The preserved elements are: the ministerial declaration under s 46(1) of the repealed Act (s 4(1)(a)); the operation of s 45A in relation to legal proceedings by or against compensation scheme trustees for matters before the repeal date (s 4(1)(b)); the continuing application of s 46(3) and (4) to trustee decisions about pre-repeal matters (s 4(1)(c)); and application of s 46B to claims arising from defaults before the repeal date (s 4(1)(d)). Those sections from the repealed Act are preserved as they stood immediately before repeal (s 4(2)(a)).

• Definitions continuity: Section 4(2)(a) preserves the meaning of terms used in the preserved sections, by stating that a term used in the cited sections of the repealed Act has the same meaning as it had immediately before the repeal date. That mechanism avoids definitional gaps for the preserved provisions.

• End-date fixed by trust deed: The Act does not itself fix an absolute calendar termination date for the compensation scheme. Instead, s 4(2)(b) links the date of termination of the scheme to the trust deed under which the scheme is established, specifically clause 27.1 of that deed. The note to s 4(2) reproduces the trust deed clause in summary: termination on 31 December 2015 or as soon after 30 June 2015 as obligations are discharged, subject to extension or earlier termination by the Ministerial Council.

• Preservation of interpretative regime: Section 4(3) states that, unless a contrary intention appears, section 4 does not affect or take away from the Interpretation of Legislation Act 1984 (s 4(3)). The endnotes to the Act reproduce key interpretive rules from the Interpretation of Legislation Act 1984 (for example, headings and notes form part of Acts passed after 1 January 2001), but those endnotes are general interpretive material and not operative changes made by this Act.

• Consequential amendments: The Act declares a purpose to make consequential amendments to other Victorian statutes (s 1(c)) , specifically the Australian Consumer Law and Fair Trading Act 2012 and the Business Licensing Authority Act 1998 , but the text of those consequential amendments is not contained in the instrument provided here. The Act therefore signals an intention to reallocate or reframe regulatory responsibilities to other statutory schemes, while preserving targeted aspects of the old scheme for historical events.

These concepts together create a time-limited legal regime: the Travel Agents Act 1986 is removed for the future, but certain rights, trustees’ decision-making rules, and persons’ ability to bring claims for pre-repeal defaults continue to be governed by the repealed Act and the trust deed until the trust is terminated in accordance with the deed.

The Act affects a small set of actors directly, and a broader set indirectly through the consequences of repeal and the preservation of the compensation scheme.

Directly affected actors

• Compensation scheme trustees: Section 4 preserves the application of certain provisions of the repealed Travel Agents Act 1986 to trustees. The Act explicitly keeps section 45A operating in relation to legal proceedings brought by or against the compensation scheme trustees in respect of matters occurring before the repeal date (s 4(1)(b)), and it preserves the operation of s 46(3) and (4) in relation to any trustee decision about pre-repeal matters (s 4(1)(c)). Trustees will therefore continue to make and defend decisions and to be parties to litigation under those preserved statutory hooks for pre-repeal events.

• Claimants who suffered loss because of travel agent defaults occurring before the repeal date: Section 4(1)(d) preserves s 46B of the repealed Act as it applied immediately before repeal, as the statutory basis for claims for compensation by persons affected by a travel agent default occurring before the repeal date. Those persons retain the right to bring claims and have those claims processed under the preserved rules until the scheme terminates.

• The Minister and Ministerial Council referenced in the trust deed: Section 4(1)(a) preserves any declaration made by the Minister under s 46(1) of the repealed Act that was in force immediately before repeal. The trust deed note specifies that a Ministerial Council may extend or shorten the termination date in clause 27.1 of the trust deed. Those Ministerial actors therefore retain powers and discretion affecting the compensation scheme’s continuance and termination.

Indirectly affected actors

• Travel agents: The Act repeals the Travel Agents Act 1986 (s 3). That repeal removes the statutory framework contained in that Act for future events. The Act also states its purpose to make consequential amendments to other legislation (s 1(c)), which suggests that regulatory obligations, licensing regimes or consumer-protection responsibilities that previously sat in the Travel Agents Act may be relocated to the Australian Consumer Law and Fair Trading Act 2012 and the Business Licensing Authority Act 1998. The Act text here does not state the content of those consequential amendments, so the practical impact on travel agents’ regulatory and licensing obligations depends on those other instruments.

• Consumers and suppliers of travel services post-repeal: For defaults occurring after the repeal date, the preserved provisions do not apply (s 4(1) is limited to matters occurring before the repeal date). Therefore consumers seeking compensation for post-repeal defaults must look to the statutory and contractual frameworks that operate after the repeal, including any consequential amendments to the Australian Consumer Law and Fair Trading Act 2012 and the Business Licensing Authority Act 1998 mentioned in s 1(c).

• Courts and litigants: Section 4 preserves the application of s 45A to litigation involving compensation scheme trustees that relates to pre-repeal matters (s 4(1)(b)). Courts will therefore continue to apply the preserved statutory provisions when adjudicating disputes arising from pre-repeal conduct.

• Administrators of the compensation trust: Clause 27.1 of the trust deed determines the termination date for the trust (s 4(2)(b) note). The trustees and trust administrators therefore remain responsible for discharging trust obligations, processing claims for pre-repeal defaults and, contingent on the trust deed and any Ministerial Council decision, winding up the trust.

Who does not continue to be governed by the repealed Act

• For events occurring after the repeal date, the substantive regulatory regime in the Travel Agents Act 1986 is not preserved by the Act. The preserved provisions are expressly tied to matters occurring before the repeal date (s 4(1)). Therefore regulatory obligations, licensing, and consumer protection for events after repeal will be governed by the law that applies post-repeal, including any consequential amendments to the other statutes referred to in s 1(c).

In short, the Act confines continued statutory protection under the Travel Agents Act 1986 to pre-repeal events and to the compensation trust, while removing the Act as the governing regime for future conduct. The precise post-repeal regulatory environment for travel agents and consumers is left to consequential amendments and other existing statutes not fully reproduced in the instrument provided.

The Act itself is largely about preserving specified existing duties and rights from the repealed statute for historical events, rather than creating new ongoing duties or rights. The relevant operative statements are in section 4.

Preserved rights and entitlements

• Right to make claims for pre-repeal defaults: Section 4(1)(d) keeps section 46B of the repealed Act in force as it applied immediately before repeal for any claim for compensation by a person affected by the default of a travel agent occurring before the repeal date. Practically, this preserves claimants’ statutory entitlements to pursue compensation under the rules that existed immediately before the repeal for qualifying defaults occurring before the repeal date.

• Rights to rely on ministerial declarations: Section 4(1)(a) preserves any declaration by the Minister made under section 46(1) of the repealed Act that was in force immediately before the repeal date. Where such a declaration created rights or confirmed the operation of the compensation scheme to specific persons or classes, those effects remain in place.

Preserved duties and decision-making standards

• Trustees’ decision-making obligations and judicial review pathways: Section 4(1)(c) preserves sections 46(3) and 46(4) of the repealed Act as they applied immediately before repeal in relation to any trustee decision concerning pre-repeal matters. Although the text of those subsections is not reproduced here, the Act ensures that whatever duties, standards or review mechanisms applied to trustee decisions under the repealed Act continue to apply in relation to pre-repeal matters.

• Litigation procedure and protection in respect of trustees: Section 4(1)(b) preserves section 45A as in force immediately before the repeal date for legal proceedings brought by or against the compensation scheme trustees in relation to matters occurring before the repeal date. That preservation will influence the procedural and substantive position of trustees in litigation, for example by retaining any statutory peculiarity in how such proceedings were to be commenced, defended or resolved under s 45A.

Continuity of definitions and terms

• Definitions preserved for the preserved provisions: Section 4(2)(a) provides that a term used in sections 45A, 46 or 46B of the Travel Agents Act 1986 has the same meaning that it had immediately before the repeal date. That continuity prevents semantic gaps from arising in the preserved provisions and ensures that terms such as “compensation scheme trustees”, “default”, or other defined technical terms continue to be read consistently with the pre-repeal Act for the purposes preserved by s 4.

Termination and time limits on duties and rights

• Temporal limitation of preserved duties and rights: The preserved rights and duties apply only in relation to matters occurring before the repeal date (s 4(1)). The date of termination of the compensation scheme is determined by clause 27.1 of the trust deed (s 4(2)(b)), which the note summarises as 31 December 2015 or as soon after 30 June 2015 as obligations are discharged, with the potential for extension or earlier termination by the Ministerial Council. Once the trust is terminated in accordance with the trust deed, the compensation scheme’s abilities to pay claims or be subject to trustee duties will extinguish in accordance with the trust deed and applicable law.

No new penalties, licensing duties or consumer-rights expansions in this Act

• No new ongoing statutory obligations in the Act text: The Act does not formulate fresh licensing obligations, penalties or broad consumer-rights frameworks. Its operative content is repeal plus focused preservation. It signals consequential amendments to other Acts (s 1(c)), but the instrument provided does not contain those consequential provisions, so any new duties or rights created elsewhere are not stated in this text.

Practitioner implications

• To establish current duties and rights for post-repeal events, practitioners must consult the consequential amendments and the statutes named in s 1(c). For pre-repeal events, practitioners should consult the specific provisions of the Travel Agents Act 1986 as they stood immediately before repeal, because those provisions and their definitions are explicitly preserved for pre-repeal matters by s 4(1)-(2).

The Travel Agents Repeal Act 2014 does not itself introduce new penalty provisions or a fresh enforcement regime; its function is to repeal the Travel Agents Act 1986 and to preserve specified aspects of the compensation scheme for pre-repeal matters. The instrument therefore has limited direct effect on penalties and enforcement mechanisms, but it preserves enforcement channels in relation to pre-repeal events.

What the Act preserves (enforcement implications)

• Preservation of legal proceedings related to the compensation trustees: Section 4(1)(b) preserves section 45A of the repealed Act in relation to legal proceedings brought by or against the compensation scheme trustees in respect of pre-repeal matters. While the text of section 45A is not reproduced in this instrument, the preservation means that whatever procedural or enforcement framework existed under s 45A continues to be available for dealing with litigation involving the trustees about pre-repeal defaults.

• Preservation of trustee decision-related mechanisms: Section 4(1)(c) preserves sections 46(3) and (4) in relation to trustee decisions about pre-repeal matters. Any enforcement consequences arising from those subsections (for example, grounds for review, internal notice obligations, or delegated enforcement powers) remain in effect for pre-repeal events to the extent those subsections provided them.

• Preservation of claim rights under s 46B: Section 4(1)(d) keeps s 46B in operation for claims relating to defaults occurring before the repeal date, preserving the statutory pathway for claimants to seek compensation from the scheme.

What the Act does not preserve or do

• No new penalties for post-repeal conduct: The Act does not create penalties for conduct after the repeal date. Because the Travel Agents Act 1986 is repealed by section 3, any penal or regulatory offences that previously existed solely within that Act cease to operate for events occurring after the repeal date, unless they have been re-enacted or provided for in consequential amendments to other statutes. Section 1(c) indicates that consequential amendments were intended to the Australian Consumer Law and Fair Trading Act 2012 and the Business Licensing Authority Act 1998; those consequential instruments, if enacted, would be the place to look for new or continuing offences and enforcement machinery.

• No enforcement powers granted to new agencies in this text: The Act does not in itself allocate enforcement functions to particular agencies; any reallocation will depend on the consequential amendments referenced by s 1(c) and on existing enforcement provisions in other Acts.

Practical enforcement points

• For trustees and claimants, the ability to enforce rights and obligations in relation to pre-repeal events remains; trustees can be parties to litigation under preserved provisions (s 4(1)(b)). Practitioners should examine the preserved sections of the Travel Agents Act 1986 for specific enforcement mechanics.

• For alleged breaches or defaults occurring after the repeal date, enforcement will depend on the post-repeal legal framework, including any amendments to the Australian Consumer Law and Fair Trading Act 2012 and Business Licensing Authority Act 1998. Those instruments should be checked for new offences or enforcement procedures; the Act here does not set them out.

• Termination of the trust under the trust deed will affect the practical enforceability of compensation claims: once the trust is lawfully terminated pursuant to clause 27.1, the trustees’ ability to meet claims will be governed by the trust deed and winding-up rules applicable to the trust. The Act links the scheme’s termination date to that clause (s 4(2)(b)), and the note records the likely dates and the Ministerial Council’s power to alter the date.

In short, the Act preserves enforcement pathways relating to pre-repeal events but does not add new penalty regimes or enforcement bodies for conduct occurring after repeal. Any enforcement for post-repeal conduct depends on consequential or other statutory provisions not reproduced in the instrument.

The Act interacts with other instruments in three principal ways: (1) it repeals an existing statute and preserves specified sections of that statute for historical events; (2) it expressly contemplates consequential amendments to two named Acts; and (3) it cross-refers to the trust deed and the Interpretation of Legislation Act 1984 for interpretive and termination mechanics.

Consequential amendments and regulatory shift

• Statement of purpose to amend other Acts: Section 1(c) states that one of the Act’s main purposes is to make amendments to the Australian Consumer Law and Fair Trading Act 2012 and the Business Licensing Authority Act 1998 consequent upon repeal of the Travel Agents Act 1986. The specific amendments are not contained in the text provided, so the exact legal content and reallocation of regulatory powers must be sought in those other Acts or in the instruments that implemented the consequential changes. Practitioners should therefore consult the Australian Consumer Law and Fair Trading Act 2012 and the Business Licensing Authority Act 1998 as amended consequentially to understand the new regulatory landscape.

Continuity under the repealed Act for pre-repeal matters

• Preservation of parts of the repealed Act: Section 4 preserves specified provisions of the Travel Agents Act 1986 , s 45A, s 46 (declaration and ss 3-4 of it), and s 46B , for matters occurring before the repeal date (s 4(1)). That preservation creates an interaction between the repealed statute and the post-repeal legal environment: for pre-repeal defaults, the applicable legal rules remain those in the repealed Act as they stood immediately before repeal (s 4(2)(a)).

• Definitions and interpretive cross-reference: Section 4(2)(a) requires that terms used in the preserved sections carry the same meaning as they had before repeal. Section 4(3) states that section 4 does not affect or take away from the Interpretation of Legislation Act 1984 unless a contrary intention appears. The endnotes reproduce interpretive rules from the Interpretation of Legislation Act 1984 (for example, headings and notes form part of acts passed after 1 January 2001). Those interpretive rules may guide courts and practitioners when applying the preserved provisions of the repealed Act.

Trust deed interaction

• Trust deed termination date: Section 4(2)(b) fixes the date of termination of the compensation scheme to the date provided in clause 27.1 of the trust deed under which the scheme is established. The note summarises clause 27.1: termination on 31 December 2015 or as soon after 30 June 2015 as obligations are discharged, subject to Ministerial Council extension or earlier termination. Thus, the statutory preservation in s 4 interacts directly with the private trust deed to determine how long the compensation scheme operates after repeal.

Temporal segmentation of legal regimes

• Pre- and post-repeal legal regimes: The Act deliberately segments liability and protection by time: matters occurring before the repeal date remain governed by the preserved provisions of the Travel Agents Act 1986; matters occurring after the repeal date fall outside the repealed Act and will be governed by the statutory framework in force after repeal, including any consequential amendments to the Australian Consumer Law and Fair Trading Act 2012 and the Business Licensing Authority Act 1998 (s 1(c) and s 4(1)). That segmentation requires practitioners to assess events by date to determine which legal regime applies.

No express savings for other statutory interactions

• The Act does not specify, within the provided text, how any licences, registrations or permits previously granted under the Travel Agents Act 1986 are to be treated after repeal. The instrument makes no express transitional provision allocating existing licences to replacement schemes. Therefore, to determine how licensing and registration interactions play out, one must consult the consequential amendments to the other Acts and other administrative instruments.

Court and litigation interaction

• Preservation of litigation mechanics: Section 4(1)(b) preserves s 45A in relation to legal proceedings involving the trustees for pre-repeal matters, thereby ensuring continuity in litigation related to the compensation scheme.

In summary, the Act creates a clean break for future regulation by repealing the Travel Agents Act 1986, preserves specific pre-repeal statutory rules and claims, links the compensation scheme’s duration to the trust deed, and leaves the substantive reshaping of the regulatory framework to consequential amendments in the Australian Consumer Law and Fair Trading Act 2012 and the Business Licensing Authority Act 1998. To understand the full regulatory picture, practitioners must combine this Act with the consequential amendments and the trust deed.

The text provided includes explicit enactment, commencement and amendment metadata in the endnotes and the table of amendments. The key chronological and amendment facts set out in the instrument are as follows.

Enactment, assent and commencement

• Assent date: The Act was assented to on 18 March 2014 (endnotes, Table of Amendments).

• Commencement: Section 2 of the Act provides for commencement by proclamation (s 2(1)), with a default commencement date of 1 December 2014 if the Act is not proclaimed earlier (s 2(2)). The endnotes record that, in practice, the Act came into operation on 1 July 2014: Special Gazette (No. 170) 3 June 2014, p. 1. That practical commencement supersedes the default date because the Act was brought into operation by proclamation earlier than the backstop date.

Version and incorporation notes

• Version: The document is Version No. 002 incorporating amendments as at 1 December 2015. That indicates that the consolidated text reflects changes up to that date.

Repeal of Part 3 and timing

• Part 3 repeal: The edition’s marginal note (and the Table of Amendments) records that Part 3 (the heading and sections 5-13) was repealed by No. 16/2014 s 13. The Table of Amendments records that s 13 repealed Part 3 on 1 December 2015. The Table also records that s 13 itself was commenced on 1 July 2014 per Special Gazette. The note in the Table states: "Note: S. 13 repeals Pt 3 (ss 5-13) on 1.12.15." That timeline indicates an amendment in the Act’s own lifecycle that removed Part 3; the concrete effect is that the public consolidated version reflects that Part 3 is no longer in force as of 1 December 2015.

Trust deed termination dates reported as explanatory note

• Trust deed clause 27.1 summary: The Act’s section 4(2)(b) and its accompanying Note state that clause 27.1 of the trust deed provides for termination of the Trust on 31 December 2015 or as soon after 30 June 2015 as obligations are discharged, whichever occurs first. The clause also allows the Ministerial Council to extend or shorten the termination date. That trust-deed-sourced date and the Ministerial Council’s discretion are the practical endpoints for the preserved compensation scheme under the Act.

Parliamentary process references

• Second reading speeches: The document records the dates of the Minister’s second reading speech in the Legislative Assembly and the Legislative Council , Legislative Assembly: 13 November 2013; Legislative Council: 20 February 2014. The long title for the Bill was "A Bill for an Act to repeal the Travel Agents Act 1986 and for other purposes." Those entries relate to parliamentary history and the Act’s progress through the Parliament.

No other amendments recorded

• Amendments not in operation: The endnotes state that there are no amendments Not in Operation at the date of the publication. The Table of Amendments shows only the internal repeal of Part 3 as an item of post-enactment change captured in the consolidated text.

Implications for practitioners

• Because the Act is short and because it explicitly links continuing operation of the compensation scheme to the trust deed, the most significant subsequent changes affecting users are likely to be found in the trust deed administration and in the consequential amendments made to the Australian Consumer Law and Fair Trading Act 2012 and the Business Licensing Authority Act 1998. The exact form and timing of those consequential amendments are not reproduced here; practitioners must consult the relevant amending instruments and the consolidated texts of those Acts.

In summary, the amendment history recorded in the instrument shows assent on 18 March 2014, commencement by proclamation so the Act was in operation from 1 July 2014, internal repeal of Part 3 effective 1 December 2015, and preservation of the trust’s termination mechanics tied to clause 27.1 of the trust deed.

The text supplied includes no case law, reported judicial decisions or litigation summaries. The Act itself does not record litigation. The only references in the instrument that touch on litigation are statutory: section 4(1)(b) preserves section 45A of the repealed Travel Agents Act 1986 in relation to legal proceedings brought by or against the compensation scheme trustees in relation to matters occurring before the repeal date. Because the substantive text of section 45A is not reproduced here, and because no cases are cited in the Act or the endnotes, the present instrument does not provide any litigation history.

Practical points for researching litigation

• Examine preserved statutory hooks: For litigation that concerns trustee conduct, claims under the compensation scheme, or decisions of the trustees about pre-repeal matters, investigators should begin by examining the text of the Travel Agents Act 1986 as it stood immediately before repeal , especially sections 45A, 46 and 46B , because section 4 preserves those provisions for pre-repeal matters (s 4(1)-(2)). That will identify the statutory causes of action, defences and procedural requirements.

• Search external sources for cases: Because the Act does not contain litigation references, search of court databases and legal reporters for cases involving the compensation scheme trustees, claims under s 46B, and litigation under s 45A will be necessary to identify judicial treatment. The Act’s preservation of those sections suggests that existing lines of authority prior to repeal would be relevant for pre-repeal matters.

• Consider trust deed-related litigation: Given that the Act ties the compensation scheme’s termination date to clause 27.1 of the trust deed, any litigation concerning the trustees’ powers to admit, reject or pay claims, or concerning the timing and manner of winding up the trust, may involve both the preserved statutory provisions and the trust deed. Search for trustee litigation and trust-winding disputes in the period after repeal.

• Temporal limitation of causes of action: Remember that the preserved statutory provisions apply only to matters occurring before the repeal date (s 4(1)). Any litigation concerning events after repeal will be governed by the post-repeal regulatory framework and not by the preserved sections unless the post-repeal statutes expressly reincorporate them.

Absence of recorded litigation in the instrument

• The Act’s endnotes do not list any judicial decisions or litigation history. The “Explanatory details” endnote states "No entries at date of publication." Therefore, users must not infer litigation history from the Act text supplied; independent legal research is required to produce an authoritative litigation history.

In short, the Act preserves statutory causes for litigation relating to pre-repeal events but contains no litigation citations in itself. Practitioners must consult the preserved provisions and external case law databases for applicable authorities.

This Act is short and focused, but several practical traps and sources of uncertainty flow from its structure and from what it does not specify. The following points are grounded in the Act’s text and the endnotes; they are the concrete operational risks and attention points for practitioners and administrators.

1. Temporal boundary of preserved rights

• The preserved provisions apply only to matters occurring before the repeal date (s 4(1)). That creates a strict temporal boundary. Practitioners must determine the precise date of the relevant event to decide whether the preserved provisions or the post-repeal law applies. Failure to do that can lead to reliance on inapplicable statutory provisions.

2. Repeal date versus actual commencement

• Section 2 contemplated commencement by proclamation with a backstop default of 1 December 2014 (s 2(1)-(2)). The endnotes record that the Act came into operation on 1 July 2014. Parties should confirm the actual repeal date in the Gazette or official commencement instrument, because the legal effect turns on the day on which section 3 comes into operation (the repeal date) (s 4(1) reference to “the repeal date”).

3. The compensation scheme’s termination date is determined by a private trust deed

• The Act does not set an absolute statutory termination date for the compensation scheme. Instead it defers to clause 27.1 of the trust deed (s 4(2)(b) and the Note). The note summarises clause 27.1 as providing termination on 31 December 2015 or as soon after 30 June 2015 as obligations are discharged, subject to Ministerial Council extension or earlier termination. That means the effective horizon for claimants and trustees depends on trust administration and Ministerial Council action, not purely on statute.

4. Definitions and meaning continuity hinge on pre-repeal definitions

• Section 4(2)(a) preserves the meaning of terms used in the preserved sections by reference to their immediately pre-repeal meanings. Where a practitioner cannot locate a definition that applied immediately before repeal, uncertainty may arise. One must reconstruct the pre-repeal text of the Travel Agents Act 1986 and its definitions as at the repeal date.

5. Unspecified consequential amendments

• The Act says it will make amendments to the Australian Consumer Law and Fair Trading Act 2012 and the Business Licensing Authority Act 1998 consequent upon repeal (s 1(c)). The Act text does not include those amendments. Therefore it would be a mistake to assume what regulatory responsibilities or licensing requirements apply now; one must check the amending instruments and the consolidated texts of those Acts.

6. Part 3 internal repeal and consolidated text complexity

• The Table of Amendments notes that Part 3 (Heading and ss 5-13) was repealed on 1 December 2015. If a practitioner relies on older consolidated versions or extracts, they may miss that Part 3 has been removed. Always check the consolidated instrument (Version No. 002 as at 1 December 2015) for the current operative text.

7. No express transitional treatment of licences and registrations

• The Act does not say what happens to licences, registrations or permits that were granted under the Travel Agents Act 1986 for ongoing operations after the repeal date. If those processes were material to a client’s business continuity, the absence of an express statutory saving is a potential gap. Practitioners must consult the consequential amendments and administrative practice for how licences were migrated, surrendered or preserved.

8. Reliance on ministerial declarations

• Section 4(1)(a) preserves any ministerial declaration under s 46(1) of the repealed Act that was in force immediately before repeal. The practical content of such declarations may vary. Clients should inspect the text of any relevant declaration because the Act preserves those declarations without restating their terms.

9. Legislative interpretation caveat

• Section 4(3) reserves the Interpretation of Legislation Act 1984 unless a contrary intention appears. This means standard interpretative tools remain available, but the preserved provisions must be read with an eye to their pre-repeal statutory context.

10. Administrative ambiguity during wind-up

• Because the trust deed controls termination and because the Ministerial Council may extend or cut short the termination date, there can be administrative uncertainty during the wind-up phase concerning the timetable for claims, payment prioritisation and trustee liabilities. That knotty interaction of statutory preservation, trust obligations and administrative discretion is a practical gotcha for claimants and trustees.

These are not speculative risks; each follows from specific textual features of the Act: the temporal limitations in s 4(1), the definitional saving in s 4(2)(a), the trust deed linkage in s 4(2)(b) and its Note, the commencement backstop in s 2(2), s 1(c)’s reference to consequential amendments, and the Table of Amendments noting the repeal of Part 3.

Compliance under this instrument is primarily about handling pre-repeal claims and navigating the changed regulatory landscape after repeal. Because the Act repeals the Travel Agents Act 1986 for future events but preserves certain provisions for pre-repeal matters, the following practical compliance checklist flows directly from the Act’s text.

1. Establish the relevant event date

• Determine whether the event or default in question occurred before or after the repeal date. Section 4 applies only to matters occurring before the repeal date (s 4(1)). The Act’s practical repeal date was the day section 3 came into operation; the endnotes record that the Act came into operation on 1 July 2014. Confirm the repeal date for legal certainty using the proclamation or Gazette entry.

2. For pre-repeal matters: use the preserved statutory provisions

• If the matter occurred before the repeal date, operate under the provisions preserved by section 4: refer to sections 45A, 46 (including any ministerial declaration preserved by s 4(1)(a)) and 46B of the Travel Agents Act 1986 as they stood immediately before repeal (s 4(1)(b)-(d) and s 4(2)(a)). That means retrieving the text of the Travel Agents Act 1986 as at the repeal date and applying its procedures, definitions and time limits.

• For claimants, lodge claims with the compensation scheme trustees in accordance with s 46B (as preserved) and the trust deed procedures. For trustees, continue to follow the decision-making provisions and processes preserved by the Act (s 4(1)(c)).

3. Check the trust deed for termination and claims timetable

• Consult clause 27.1 of the trust deed to determine the date of termination for the compensation scheme and any trust deed provisions about claim lodgement deadlines, priority of payments and winding-up procedures. The Act anchors the scheme’s termination to clause 27.1 (s 4(2)(b)).

• Monitor any Ministerial Council decisions about extension or earlier termination, because clause 27.1 allows the Ministerial Council to alter the termination date, and the Act’s Note records that power.

4. For post-repeal matters: find the post-repeal statutory framework

• For events occurring after the repeal date, the Travel Agents Act 1986 no longer applies. Section 1(c) indicates that consequential amendments were to be made to the Australian Consumer Law and Fair Trading Act 2012 and the Business Licensing Authority Act 1998. Practitioners and regulated entities should consult the consolidated versions of those Acts, and any relevant regulations or administrative guidance, to identify current licensing obligations, consumer-protection duties, offence provisions and enforcement arrangements.

• Do not assume licences or permits issued under the repealed Act automatically survive; check the consequential amendments and administrative practice for migration arrangements.

5. Preserve and produce records

• For claims under the preserved scheme, maintain records evidencing the date and nature of the travel agent default, contractual documents, financial records and any prior communications. Because preserved provisions use pre-repeal definitions (s 4(2)(a)), documentary evidence tied to those definitions will be material.

6. Where litigation is contemplated or ongoing

• If litigation relates to pre-repeal matters, rely on the preserved application of s 45A to proceedings involving the trustees (s 4(1)(b)). Review the Travel Agents Act 1986’s provisions as they stood immediately before repeal to ensure procedural compliance.

• If litigation concerns post-repeal conduct, use the relevant post-repeal statutory framework and procedural rules in force for the time of the event.

7. Check ministerial declarations and trustee decisions

• For any ministerial declaration that was in force immediately before repeal under s 46(1) of the repealed Act, confirm whether that declaration is preserved and what practical effect it has for claimants and trustees (s 4(1)(a)).

• For trustee decisions about pre-repeal matters, check that the trustee process complied with the preserved standards under sections 46(3) and 46(4) (s 4(1)(c)) to reduce exposure to challenge.

8. Confirm administrative and regulatory obligations

• For travel service providers, confirm regulatory obligations in the updated consumer law and licensing regimes post-repeal. Consult the Australian Consumer Law and Fair Trading Act 2012 and the Business Licensing Authority Act 1998 as amended consequentially, and seek administrative guidance from relevant regulatory agencies.

9. Seek legal and trust-administration advice where necessary

• Because the termination date and the trust deed govern wind-up mechanics, trustees should obtain professional advice on trust law, distribution priorities, and trustee liabilities during the winding-up process.

10. Keep up to date with consolidated legislation

• Use the consolidated version of the Travel Agents Repeal Act 2014 (Version No. 002 as at 1 December 2015) and consolidated versions of the other Acts affected by consequential amendments to ensure compliance with the current legal position. Note the internal repeal of Part 3 effective 1 December 2015 per the Table of Amendments.

Following these steps reflects the Act’s structure: operate under the preserved pre-repeal rules for historical defaults and consult the new post-repeal legislative framework and the trust deed for present and future compliance.
