Transport Superannuation Regulations 2018

Salary. The definition of salary is central to the entire scheme, as it determines both contribution amounts and benefit calculations. Regulation 6 says salary is "the pecuniary emoluments payable to a member in accordance with regulation 7". Regulation 7 then provides a layered definition. The general rule (reg 7(1)) is that salary is the annual rate of remuneration payable periodically and regularly, including any higher duties allowance that has been paid continuously for at least 12 months, but explicitly excluding expense of office or uniform allowances, reimbursements of travel or incidental expenses, overtime allowances, and any allowances not ordinarily payable every pay period. This exclusion means that irregular or reimbursable amounts do not inflate the superannuation base, which is standard for defined benefit superannuation schemes. Special rules apply for leave without pay, union officials, part‑time members, salary reductions, and shift workers. For members on leave without pay or less than full pay, salary is generally the pre‑leave salary adjusted for classification changes, unless the member is a full‑time union officer, in which case it is based on the last substantive classification before becoming an officer (reg 7(2)(b)). For part‑time members, salary is the full‑time equivalent salary for a similar position (reg 7(2)(c)). This mechanism prevents part‑time work from reducing the notional superannuation base but means that contributions and benefits are calculated as though the member were full‑time, likely requiring a contribution adjustment.

The most economically significant sub‑rule is the salary reduction provision (reg 7(2)(d)). If a member's salary is reduced, and the Board agrees the reduction must not be taken into account, salary is the greater of the pre‑reduction salary and the actual salary. This preserves benefit expectations for members whose salaries are involuntarily reduced (for example, due to reclassification), but only with Board approval. The Board thus holds discretionary power to freeze or not freeze the salary base for superannuation purposes, a feature that creates uncertainty for members who might face a reduction.

Medical classification certificate. This is a certificate issued by the Board after examining a member's medical history. It effectively records a pre‑existing condition or risk. If such a certificate is in force, the death or disability benefits payable under the Act are reduced according to regulation 12, unless the Board determines otherwise under the narrower accident/misfortune exception in regulation 13. The medical classification certificate concept transfers risk from the fund to the member: members with known medical issues receive lower benefits, but are still covered for unrelated events. The Regulations do not specify how the Board makes its classification; the Act and the Board's own policies govern that.

Transferred members. Regulation 11 guarantees that members who transferred from another superannuation fund or arrangement referred to in section 4(1) of the Act (i.e., a prescribed superannuation scheme) will receive full death and disability benefits if they were entitled to such benefits in their previous fund. This is a grandfathering protection for transferred members, ensuring no loss of coverage upon moving into the transport superannuation scheme.

Prescribed rate on resignation. Regulation 10 sets out how the benefit on resignation is calculated. It uses a two‑step method: (a) contributions and interest as at 30 June 1987 are calculated using the factor table in Schedule 1, with intermediate values interpolated to the lower 0.01; and (b) additional annual rates of interest from 1 July 1987 onwards are those published each year by the Board in the Government Gazette. The factor table provides multipliers that increase with earlier entry dates, reflecting the accumulation of interest up to 30 June 1987. For example, a member who entered in the year ended 30 June 1987 gets a factor of 1.00 (no interest baked in), while a member who entered in the year ended 30 June 1949 or earlier gets a factor of 2.25. This table is a historical artefact from the old defined benefit interest rate methodology, which has been replaced by the annually published rates for post‑1987 periods.

The Regulations directly affect members of the Victorian transport superannuation scheme, their employers (the State of Victoria and its transport agencies), the Emergency Services Superannuation Board (or its successor, now part of the Victorian Superannuation Board), and to a lesser extent, members of other public sector superannuation schemes who may transfer into or out of the transport scheme.

Members include current employees of public transport employers, such as Metro Trains Melbourne, Yarra Trams, and Public Transport Victoria (though the specific employers are defined in the Act, not the Regulations). The Regulations affect members in different ways depending on their employment status (full‑time, part‑time, shift worker, leave without pay, union official) and their medical history (classified or not). Members who have taken a pay cut and obtained Board approval to use the pre‑reduction salary will see their contribution and benefit base preserved. Union officials are treated differently: their salary is based on their last substantive classification before becoming a full‑time officer, unless the union pays them a higher salary approved by the Board. This prevents superannuation from being advantaged or disadvantaged by temporary union roles.

Employers (the employing authorities) are required to deduct contributions from members' after‑tax salaries and pay them to the Board on the appropriate pay day via direct credit to the Board's nominated bank account, or in any other manner approved by the Board (reg 9(2)). They must also provide written particulars of each payment and explain any variation in the amount of contributions normally paid (reg 9(3)‑(4)). This imposes a compliance burden: employers must have systems capable of producing these particulars daily, and any payroll error that changes contribution amounts requires written explanation. The Regulations do not prescribe a penalty for non‑compliance, but the Act may impose obligations; the regulation itself simply states what employers must do.

The Board is given substantial discretion. It computes salary under the determination in regulation 7; it approves the non‑application of salary reductions; it fixes the dates for contribution changes; it publishes shift allowance schedules and annual interest rates in the Government Gazette; and it determines benefits under the medical classification and accident exception rules. The Board's decisions are largely unreviewable within the text of the Regulations, though general administrative law and the Act's internal review provisions may apply.

Transferred members are protected. Anyone who moved from another prescribed superannuation scheme into the transport scheme retains full death and disability coverage (reg 11). This affects members of state or federal public sector schemes who move vertically or horizontally within the public sector.

Other persons liable to benefit financially from a member's death are indirectly affected by regulation 13(1)(b)(i): if the Board is satisfied that the member's death or retirement was due to the fault of the member or any person liable to benefit financially from the death, the Board may deny the enhanced benefits for accidental death. This creates a potential deterrent against fraudulent claims.

Duty to contribute. A member must make contributions to the Fund on each date of payment of salary or periodic payments under the Accident Compensation Act 1985 (reg 9(5)). The member's contribution rate is fixed by the Act (section 28), but the member can elect to change that rate by giving two months' notice in writing to the Board (reg 9(1)(a)). The change takes effect from the first date for payment of salary on or after the date fixed by the Board for salary adjustment in each year (reg 9(1)(b)). This means there are only specific windows during which contribution rates can be altered, which may disadvantage members who need to change their rate at other times for personal financial reasons.

Employer duty to pay and report. The employing authority must deduct the contributions from the member's after‑tax salary and pay them on the appropriate pay day via direct credit to the Board's nominated bank account (reg 9(2)). It must provide written particulars of the contributions and other money comprising the payment on the day the payment is made (reg 9(3)). If there is any variation in the amount of contributions normally paid, the authority must explain in writing, showing the changes that have occurred in the deductions from the contributor's after‑tax salaries (reg 9(4)). This duty creates a clear paper trail but also imposes a rigid reporting timeline: "on the day that the payment is made" means same‑day reporting, which may be operationally difficult for large payroll runs.

Member's right to elect contribution rate change. A member has the right to change their contribution rate under section 28 of the Act, but the right is constrained by the two‑month notice period and the timing restriction to Board‑established salary adjustment dates. This is a significant practical limitation, as it prevents a member from altering contributions in response to a sudden change in financial circumstances outside those windows, unless the Board exercises discretion not specified in the Regulations.

Member's right to salary base protection. If a member's salary is reduced, the member can ask the Board to agree that the reduction should not be taken into account for superannuation purposes (reg 7(2)(d)). If the Board so agrees, the salary for superannuation purposes becomes the greater of the pre‑reduction salary and the actual salary. This right is discretionary: the member does not have an entitlement; the Board must "agree" that the reduction must not be taken into account. The Regulations do not specify the criteria for that agreement, so the Board's decision is opaque.

Board's duty to publish. The Board must publish in the Government Gazette the annual interest rates to be used for resignation benefit calculations (reg 10(b)) and the schedule of shift allowances (reg 7(2)(e)). This ensures transparency of the key parameters for benefit calculation, though publication in the Gazette is not a widely read medium.

Rights on transfer. A transferred member who was entitled to full death and disability benefits under their previous superannuation fund or arrangement is entitled to the same full benefits from the transport scheme (reg 11). This is a hard right, not subject to Board discretion.

Rights under medical classification exception. A member who has not been medically examined and classified and who dies or is retired due to disability caused by an accident or medical trauma unrelated to any prior medical condition, and where the death or disability was not the fault of the member or a financial beneficiary, can have the Board determine that benefits be paid as if no medical classification certificate were in force (reg 13). This right is not automatic; the Board must be satisfied and then it "may determine". It is a discretionary safety valve for truly accidental events.

The Regulations themselves do not create any penalties. They do not contain penalty units, infringement notices, or criminal offences. Enforcement is left to the Transport Superannuation Act 1988 and general law. The only enforcement mechanism visible in the Regulations is the Board's ability to reduce benefits under regulations 12 and 13, but that is not a penalty; it is a benefit calculation rule. For employers who fail to pay contributions on time or fail to provide the required written particulars, there is no express penalty in these Regulations. The Act itself may contain provisions regarding late payment interest or criminal liability for misappropriation of contributions, but the Regulations do not cross‑reference them.

The Board's discretion to "determine" salary (reg 7(1) and (2)(f)), to "fix dates" for contribution changes (reg 9(1)(b)), and to "approve" the non‑application of salary reductions (reg 7(2)(d)) means that the Board is the primary enforcement body. A member or employer who disagrees with a Board determination would need to invoke the Act's internal review mechanisms or seek judicial review on administrative law grounds (procedural fairness, no error of law). The Regulations provide no express avenue for appeal.

The closest thing to a penalty is the reduction in death or disability benefits under regulation 12 for a classified condition. This is not a penalty for wrongdoing but a risk‑adjusted benefit. However, regulation 13(1)(b)(i) excludes from the accidental‑event exception any death or disability caused by the fault of the member or a person liable to benefit financially from the death. This provision functions as a potential avoidance of benefit when the Board finds fault - effectively a penalty for self‑inflicted or conspiratorial injury or death. The Board can decide not to pay the enhanced benefits, but that is not a fine or sanction; it simply means the standard lower benefits apply.

The enforcement burden falls on employers to ensure payroll systems conform to the direct credit requirements and the reporting of particulars. If an employer fails to pay on the correct day, the Board could take action under the Act (unpaid contributions might attract interest or be recoverable as a debt). The Regulations, being procedural, do not address recovery.

The Regulations operate wholly under the Transport Superannuation Act 1988 and must be read with that Act. They do not override the Act but fill in gaps. For example, the definition of "salary" in the Act (section 3(1)) simply says "salary has the meaning given by the regulations", so the Regulations create the actual definition. The same applies to the "prescribed rate" for resignation benefits and the "prescribed superannuation scheme" for transfer provisions.

The Regulations also touch the Accident Compensation Act 1985 (Vic). Regulation 9(5) requires a contributor to make contributions on each date of payment of salary or periodic payments under the Accident Compensation Act 1985. This means that a member receiving workers' compensation payments must still contribute to the superannuation fund from those payments. This ensures continuity of contributions during a period of incapacity, but it also means the member loses part of their compensation to superannuation contributions. The interaction is not optional: the regulation mandates that contributions be paid from those periodic payments.

Regulation 8 defines a "prescribed superannuation scheme" for the purpose of section 4(5) of the Act as any scheme established under an Act of Victoria, any other state, the Commonwealth, or a territory, or by the governing body of an authority constituted under any such Act. This means that the transport superannuation scheme recognises transfers from virtually all other Australian public sector superannuation schemes, including state teachers' schemes, federal schemes (PSS, CSS), and local government schemes if established by an Act or authority. But the definition is limited to "prescribed schemes", not private sector schemes. A member transferring from a private corporate super fund would not be a "transferred member" for the purposes of regulation 11.

The Regulations themselves do not interact with the Superannuation Industry (Supervision) Act 1993 (Cth) directly, as the Victorian transport superannuation scheme is a public sector scheme that is exempt from certain SIS requirements. However, the interest rates published by the Board may need to meet preservation and minimum benefit standards under Commonwealth taxation law, though the Regulations are silent on that.

The Regulations also reference the Subordinate Legislation Act 1994 (Vic), which imposes a sunset clause: the Regulations expire after 10 years from making (11 September 2028). This sunset does not appear in the regulatory text but is noted in the endnotes. Practitioners should be aware that the scheme will need to re‑make regulations before that date or the Act's provisions will be left without operative regulations (and thus no definition of salary, no prescribed rate, etc.). The Interpretation of Legislation Act 1984 (Vic) also applies to the Regulations via the endnotes, which confirm that headings, examples, and provision numbers are part of the Regulations.

As at the date of publication (14 September 2018), there have been no amendments to the Transport Superannuation Regulations 2018. The endnotes explicitly state "Table of Amendments - There are no amendments made to the Transport Superannuation Regulations 2018 by statutory rules, subordinate instruments and Acts." The "Amendments Not in Operation" list is also empty. The only pre‑existing legislative history is the revocation of the Transport Superannuation Regulations 2008 (S.R. No. 110/2008). The 2008 regulations are revoked effective 14 September 2018. There is no indication of what substantive changes were made from 2008 to 2018; the Regulations simply revoke the old ones and replace them with a new but presumably similar text. The Explanatory Details endnote references the 2008 regulation as the source of the revocation.

Given that the Regulations were made on 11 September 2018 and came into operation on 14 September 2018, the instrument is relatively new. However, its content tracks heavily the prior regulation, meaning there is likely years of accumulated administrative practice built on similar provisions. The factor table in Schedule 1 is unchanged from the old scheme; it references data as at 30 June 1987, which suggests the interest crediting methodology is pre‑1987 legacy. The Board's power to publish annual interest rates in the Gazette (regulation 10(b)) means that the benefit calculations are dynamic, not static, but the base is effectively frozen.

Practitioners should note that the Regulations may have been subsequently amended after the version published here (version 001). This deep dive is based strictly on the text provided, which is the version as at 14 September 2018. Any later amendments would not be reflected.

The Regulations themselves have not been litigated in any case that is referenced in the source. The source provides no case law, and no litigation history is noted. Given the Regulations are a statutory rule that came into force only in 2018, it is not surprising that there are no published cases directly interpreting them. However, the underlying Act, the Transport Superannuation Act 1988, has been the subject of occasional decisions by the Victorian Civil and Administrative Tribunal and the Supreme Court of Victoria, particularly concerning benefit calculations and the Board's discretion. Those decisions would have considered the predecessor regulations (2008) rather than the current 2018 instrument, but the substantive provisions are so similar that the reasoning may be transferable.

The key areas of potential litigation centre on the Board's exercise of discretion. Regulation 7(2)(d) (salary reduction and Board agreement) could give rise to judicial review if a member alleges the Board unreasonably refused to agree that a reduction should be disregarded. The criteria for "cause or substantial contribution" under regulation 12 (medical classification) and "fault" under regulation 13 are also fertile ground for dispute: what does "substantially contributed to" mean? Is it a 50% or more test? What constitutes "fault" - mere negligence? A person "liable to benefit financially from the member's death" could include a spouse or child, creating a conflict of interest question if the Board suspects family involvement.

The definition of salary itself, particularly the exclusion of overtime allowances (reg 7(1)(c)) and the treatment of allowances paid continuously for 12 months (higher duties), may be litigated. The Board's determination of salary "computed as determined by the Board" (reg 7(1)) gives broad power; a member could argue that the Board's method is not authorised by the regulations.

No specific cases are cited in the source. A deep dive cannot invent cases. Practitioners should search for decisions under the Act and the 2008 regulations as persuasive authority. The Regulations themselves are unlikely to be the subject of direct challenge because they are procedural and largely replicate past practice. Challenges are more likely to arise in benefit disputes where the Board relies on these regulations.

Several provisions contain traps that could catch unwary members or employers.

Two‑month notice for contribution changes. A member who wishes to change their contribution rate under section 28 of the Act must give two months' notice in writing to the Board, and the change only takes effect from the first date for payment of salary on or after the date fixed by the Board for salary adjustment in that year (reg 9(1)). This means that if a member wants to increase their contributions at the start of the financial year, they must have submitted written notice at least two months before the Board's adjustment date. If the Board's salary adjustment date is 1 July, the notice must be received by 1 May. Missing that window means the member cannot change rates until the next adjustment date, effectively locking the member into a contribution rate for up to 13 months. The regulation does not provide for hardship exceptions.

Salary reduction and Board discretion trap. Regulation 7(2)(d) allows a member's salary to be preserved at the pre‑reduction level if the Board agrees. But the Board is not required to agree. If a member's salary is reduced (say, due to demotion or reclassification), and the Board does not agree to disregard the reduction, the salary for superannuation purposes becomes the actual (lower) salary. This can result in a permanent reduction in benefit accrual. Members should proactively seek Board agreement at the time of the reduction, not later. The regulation does not specify a timeframe for making the request, but delays risk the Board arguing that the reduction was already taken into account.

Shift workers and the three‑year rule. An employee performing shift work is entitled to have shift allowances included in salary for benefit calculations, but only if the shift work has been performed for no less than three years immediately prior to the date the benefits become payable (reg 7(2)(e)(i)). If a member changes shift patterns or stops shift work less than three years before retiring or claiming death/disability, the shift allowance is not included. This penalises members who shift to day work in their final years. Furthermore, if the member becomes eligible for benefits without having completed three years of shift work, any additional contributions paid in relation to shift work must be taken into account, but the regulation does not say how. The Board apparently has discretion to adjust benefits proportionately.

Accident exception - 12 months only. Regulation 13(1)(b)(ii) provides a limited exception to the medical classification reduction: the death or disability must be caused by an accident or medical trauma unrelated to any prior medical condition suffered within the 12 months prior to the death or retirement (or longer period approved by the Board). This is a very narrow window. A member who has a medical classification certificate and suffers an accident 13 months before retirement would not qualify for the exception unless the Board approves a longer period. The exception does not apply at all if the death or disability is caused by fault of the member or a beneficiary. The "fault" condition is ambiguous: does it include moral fault, legal fault, or only intentional act or omission? The regulation says "whether by intentional act or omission", which suggests it is limited to intentional behaviour, but the drafting is unclear.

Direct credit and same‑day reporting. Employers must pay contributions via direct credit to the Board's nominated bank account on the appropriate pay day, and must provide "particulars in writing" on the same day (reg 9(3)). This is an onerous requirement: the written particulars must be provided on the day of payment. If the employer's payroll system cannot generate and send the particulars on the same day as the payment, the employer is in breach. There is no exception for weekends or public holidays. The Board may accept particulars emailed, but the regulation says "on the day that the payment is made". Failure to comply could theoretically result in the Board refusing to accept the contribution or treating it as late.

Part‑time member full‑time salary. For a part‑time member, salary is the full‑time equivalent salary for a similar position (reg 7(2)(c)). This means that contributions and benefits are calculated as if the member were full‑time, but the member is only paid part‑time. The member must therefore make contributions on a notional full‑time salary, which will be a higher amount in dollar terms than their actual part‑time pay. This could be a cash‑flow shock for part‑timers who do not expect the higher contribution rate. The employing authority must deduct contributions from the after‑tax salary, but the salary is actual, not notional; the regulation defines salary for super purposes, but the actual deduction is from real salary. There is potential conflict: if the notional salary is higher than actual, the contribution could exceed the member's actual pay.

For members. To change a contribution rate, provide written notice to the Board at least two months before the next salary adjustment date fixed by the Board. Keep a copy of the notice and confirm receipt. For every pay period, ensure contributions are deducted. If you are on workers' compensation payments under the Accident Compensation Act 1985, contributions will be deducted from those payments; budget accordingly. If your salary is reduced, immediately apply to the Board in writing for an agreement that the reduction be disregarded for superannuation purposes. Provide evidence of the reduction and the circumstances. If you are a shift worker, maintain shift work continuously for at least three years before the benefit payment date. If you change to day work, consider whether it resets the three‑year clock. Review your medical classification certificate, if any, and understand that benefits will be lower for conditions related to the classification if you die or become disabled. If you suffer an accident or medical trauma, document that it is unrelated to any prior medical condition and occurred within 12 months of the event. Seek the Board's approval for a longer period if needed.

For employers (employing authorities) . Establish a payroll system that can compute contributions based on the salary definition in regulation 7, including adjustments for higher duties allowances paid for at least 12 months, shift work if applicable, and part‑time full‑time equivalency. Pay contributions on each pay day by direct credit to the bank account nominated by the Board. On the same day, provide written particulars to the Board showing the amount of contributions paid, the employee details, and any other money payable. If the normal contribution amount varies (e.g., because an employee changed rate or went on leave without pay), provide a written explanation on the day of payment showing the changes that caused the variation (reg 9(4)). Ensure this explanation is detailed enough for the Board to reconcile. Retain records of all payments and particulars for at least seven years (the general record‑keeping period under Victorian law). If an employee goes on leave without pay, continue to calculate salary based on the substantive classification (reg 7(2)(a)). For union officials, obtain from the union or the employee evidence of the last substantive classification and adjust accordingly. For part‑time employees, calculate contributions on the full‑time equivalent salary, even though the employee's actual salary is lower;

you may need to communicate to the employee that their contribution amount will be higher than a strict percentage of actual pay.

For the Board. Publish the schedule of shift allowances and the annual interest rates in the Government Gazette each year (regs 7(2)(e), 10(b)). Maintain a nominated bank account for contributions. When a member applies for a contribution rate change, process it only if the two‑month notice is given and the effective date is on or after the next salary adjustment date. When a member's salary is reduced, consider and decide on the application for non‑recognition of the reduction; record reasons. When a death or disability claim is made, check if a medical classification certificate is in force. If so, apply the reduction formula in regulation 12. Consider whether regulation 13 applies (no medical examination, accident within 12 months, no fault). If the Board decides to apply regulation 13, document satisfaction of the conditions. For transferred members, verify the member's entitlement to full death and disability benefits in the previous fund and confirm that the fund is a prescribed superannuation scheme under regulation 8.
