82 Injunctions for non‑compliance with notices

S. 82(1) amended by No. 34/2023 s. 127(Sch. 1 item 18.19).

(1) Safe Transport Victoria may apply to the Magistrates' Court for an injunction—

(a) compelling a person to comply with a notice; or

(b) restraining a person from contravening a notice.

(2) Safe Transport Victoria may do so—

(a) whether or not a proceeding has been commenced for an offence against a transport safety law in connection with any matter in respect of which the notice was served; and

(b) whether or not any period for compliance with the notice has expired.
