sec.186 Meaning of eligible vehicle

In this division, a vehicle is an eligible vehicle if— the vehicle’s purpose of use is recorded in the register or nominated in a registration application as private purposes or farming purposes; and either— the vehicle’s garage address is in a drought-declared area or at a drought-declared property; or both of the following apply— the vehicle’s garage address is in a place that was previously a drought-declared area or at a drought-declared property; a drought relief measure for the vehicle was used while the place was in a drought-declared area or at a drought-declared property. However, none of the following vehicles is an eligible vehicle — a vehicle that is conditionally registered; a farm plate vehicle; a vehicle for which— the registered operator is not a primary producer; or a registration application in relation to which a drought relief measure applies is made, if the applicant is not a primary producer. In this section— drought relief measure means any of the following— registration or renewal of registration of a vehicle under section 187 ; an exemption from paying a surcharge or fee in relation to a registration application or renewal application for a vehicle under section 188 ; for a seasonal heavy vehicle—a deferral of the day by which a renewal application for a vehicle must be made under section 190 . (sec.186-ssec.1) In this division, a vehicle is an eligible vehicle if— the vehicle’s purpose of use is recorded in the register or nominated in a registration application as private purposes or farming purposes; and either— the vehicle’s garage address is in a drought-declared area or at a drought-declared property; or both of the following apply— the vehicle’s garage address is in a place that was previously a drought-declared area or at a drought-declared property; a drought relief measure for the vehicle was used while the place was in a drought-declared area or at a drought-declared property. (sec.186-ssec.2) However, none of the following vehicles is an eligible vehicle — a vehicle that is conditionally registered; a farm plate vehicle; a vehicle for which— the registered operator is not a primary producer; or a registration application in relation to which a drought relief measure applies is made, if the applicant is not a primary producer.
