sec.423 Existing applications for certificates of exemption
This section applies if— before the commencement, a person applied for a certificate of exemption under the expired regulation, section 71(1), 71A(1) or 73(1); and immediately before the commencement, the application had not been decided. The expired regulation continues to apply in relation to the application as if the expired regulation had not expired. A certificate of exemption granted under the expired regulation after the commencement for the application is taken to have been given under— for an application under the expired regulation, section 71(1)—section 236(1); or for an application under the expired regulation, section 71A(1)—section 239(1); or for an application under the expired regulation, section 73(1)—section 246(1). (sec.423-ssec.1) This section applies if— before the commencement, a person applied for a certificate of exemption under the expired regulation, section 71(1), 71A(1) or 73(1); and immediately before the commencement, the application had not been decided. (sec.423-ssec.2) The expired regulation continues to apply in relation to the application as if the expired regulation had not expired. (sec.423-ssec.3) A certificate of exemption granted under the expired regulation after the commencement for the application is taken to have been given under— for an application under the expired regulation, section 71(1)—section 236(1); or for an application under the expired regulation, section 71A(1)—section 239(1); or for an application under the expired regulation, section 73(1)—section 246(1).
- (a) before the commencement, a person applied for a certificate of exemption under the expired regulation, section 71(1), 71A(1) or 73(1); and
- (b) immediately before the commencement, the application had not been decided.
