sec.242 Meaning of restricted driving period

For this division, the restricted driving period for the person is a period of 1 year starting on the relevant day for the person. For a person mentioned in section 241 (1) (a) (i) , the relevant day is the person’s sanction day. For a person mentioned in section 241 (1) (a) (ii) whose Queensland driver licence is suspended under section 266 (5) or 285 (5) , the relevant day is— if a special hardship order is made for the person—the day the special hardship order is made; or otherwise—the day after the last day of the suspension. For a person mentioned in section 241 (1) (a) (ii) whose Queensland driver licence is suspended under section 265 (2) , 278 (4) or 289 (5) , the relevant day is the day after the last day of the suspension. For a person in relation to whom this division applies under section 241 (2) and who is the subject of an order mentioned in section 81 (7) of the Act or made under section 87(1) of the Act , the relevant day is the day the court makes the order. For a person in relation to whom this division applies under section 241 (2) and who is not the subject of an order mentioned in subsection (5) , the relevant day is the day after the last day the person is disqualified from holding or obtaining a Queensland driver licence. (sec.242-ssec.1) For this division, the restricted driving period for the person is a period of 1 year starting on the relevant day for the person. (sec.242-ssec.2) For a person mentioned in section 241 (1) (a) (i) , the relevant day is the person’s sanction day. (sec.242-ssec.3) For a person mentioned in section 241 (1) (a) (ii) whose Queensland driver licence is suspended under section 266 (5) or 285 (5) , the relevant day is— if a special hardship order is made for the person—the day the special hardship order is made; or otherwise—the day after the last day of the suspension. (sec.242-ssec.4) For a person mentioned in section 241 (1) (a) (ii) whose Queensland driver licence is suspended under section 265 (2) , 278 (4) or 289 (5) , the relevant day is the day after the last day of the suspension. (sec.242-ssec.5) For a person in relation to whom this division applies under section 241 (2) and who is the subject of an order mentioned in section 81 (7) of the Act or made under section 87(1) of the Act , the relevant day is the day the court makes the order. (sec.242-ssec.6) For a person in relation to whom this division applies under section 241 (2) and who is not the subject of an order mentioned in subsection (5) , the relevant day is the day after the last day the person is disqualified from holding or obtaining a Queensland driver licence.

• (a) if a special hardship order is made for the person—the day the special hardship order is made; or
• (b) otherwise—the day after the last day of the suspension.
