sec.312 Existing applications—driver authorisation

This section applies if— before the commencement, a person applied, under section 23, to the chief executive for the grant or renewal of driver authorisation; and immediately before the commencement, the chief executive— had not considered and decided the application under former section 25; or had considered the application under former section 25 and decided to grant driver authorisation to the person on a provisional basis under former section 30. Former part 3, division 2 continues to apply in relation to the application as if the amendment regulation had not been made. A decision made by the chief executive under former part 3, division 2 after the commencement in relation to the application is taken to have been made under new part 3, division 2. s 312 ins 2026 SL No. 4 s 36 (sec.312-ssec.1) This section applies if— before the commencement, a person applied, under section 23, to the chief executive for the grant or renewal of driver authorisation; and immediately before the commencement, the chief executive— had not considered and decided the application under former section 25; or had considered the application under former section 25 and decided to grant driver authorisation to the person on a provisional basis under former section 30. (sec.312-ssec.2) Former part 3, division 2 continues to apply in relation to the application as if the amendment regulation had not been made. (sec.312-ssec.3) A decision made by the chief executive under former part 3, division 2 after the commencement in relation to the application is taken to have been made under new part 3, division 2.

• (a) before the commencement, a person applied, under section 23, to the chief executive for the grant or renewal of driver authorisation; and
• (b) immediately before the commencement, the chief executive— (i) had not considered and decided the application under former section 25; or (ii) had considered the application under former section 25 and decided to grant driver authorisation to the person on a provisional basis under former section 30.

• (ii) had considered the application under former section 25 and decided to grant driver authorisation to the person on a provisional basis under former section 30.
• (i) had not considered and decided the application under former section 25; or
• (ii) had considered the application under former section 25 and decided to grant driver authorisation to the person on a provisional basis under former section 30.
