sec.110 Div 1 applies to application for renewal

Division 1 applies to an application for renewal of an authority in the same way it applies to an application for an authority. However, the administering agency may also refuse an application for renewal of an authority if— the authority was granted in error or because of a document or representation that— was false or misleading; or was obtained or made in another improper way; or the applicant has contravened a condition of the authority; or for a buoy mooring approval—there has been a significant change in circumstances affecting marine safety in the vicinity of the buoy mooring. (sec.110-ssec.1) Division 1 applies to an application for renewal of an authority in the same way it applies to an application for an authority. (sec.110-ssec.2) However, the administering agency may also refuse an application for renewal of an authority if— the authority was granted in error or because of a document or representation that— was false or misleading; or was obtained or made in another improper way; or the applicant has contravened a condition of the authority; or for a buoy mooring approval—there has been a significant change in circumstances affecting marine safety in the vicinity of the buoy mooring.

• (a) the authority was granted in error or because of a document or representation that— (i) was false or misleading; or (ii) was obtained or made in another improper way; or
• (i) was false or misleading; or
• (ii) was obtained or made in another improper way; or
• (b) the applicant has contravened a condition of the authority; or
• (c) for a buoy mooring approval—there has been a significant change in circumstances affecting marine safety in the vicinity of the buoy mooring.
