sch.5-sec.3-oc.2 Exceptions from requirement for marine zone
The requirement in section 2 does not apply to the operation of a ship by an employee of the Gladstone Area Water Board who is— a shipping inspector performing a function under section 153 of the Act ; or carrying out a water activity under the Water Act 2000 relating to the board’s main function as a water authority under section 569 of that Act ; or carrying out an activity under an authority issued to the board under the Fisheries Act 1994 , section 49 for the following purposes— broodstock collection; education; fish stocking. sch 5 pt 3 s 3 ins 2024 SL No. 34 s 4
- (a) a shipping inspector performing a function under section 153 of the Act ; or
- (b) carrying out a water activity under the Water Act 2000 relating to the board’s main function as a water authority under section 569 of that Act ; or
- (c) carrying out an activity under an authority issued to the board under the Fisheries Act 1994 , section 49 for the following purposes— (i) broodstock collection; (ii) education; (iii) fish stocking.
