65B Limitations on power of Minister to recommend the making of a Transport Restructuring Order (1) The Minister must not recommend that a Transport Restructuring Order be made unless the Minister is satisfied that— (a) the proposed Transport Restructuring Order is consistent with the vision statement and the transport system objectives; and (b) the restructuring to be effected by the proposed Transport Restructuring Order is necessary to facilitate— (i) the better integration or any improvement of the transport system; or (ii) the delivery of a specific strategy, policy, program, transport service or transport project. (2) Before the Minister makes a recommendation that a Transport Restructuring Order be made, the Minister must consult with— (a) any Minister responsible for a sector transport agency affected by the proposed restructuring; and (b) the Treasurer if— (i) the proposed restructuring includes the constitution of a new sector transport agency; or (ii) a provision of this Act which would be affected by the proposed restructuring requires the approval of, or consultation with, the Treasurer.
