64V Delegations giving rise to conflict and effect S. 64V(1)(2) repealed by No. 49/2019 s. 26(2). S. 64V(3) amended by Nos 49/2019 s. 26(3), 34/2023 s. 126(a). (3) The Head, Transport for Victoria must not delegate a function or power to a person who is performing functions or exercising powers as an employee in the Department or as a delegate of the Secretary that is inconsistent with the person's functions or powers as an employee in the Department or a delegate of the Secretary. S. 64V(4) amended by No. 49/2019 s. 26(3). (4) Despite subsection (3), an act or decision or the performance of a function or exercise of any power by a person as a delegate of the Head, Transport for Victoria is not invalid only because of any inconsistency between— (a) that function or power; and S. 64V(4)(b) amended by No. 34/2023 s. 126(b).
