(3) The Head, Transport for Victoria must not delegate a function or power to a person who is performing functions or exercising powers as an employee in the Department or as a delegate of the Secretary that is inconsistent with the person's functions or powers as an employee in the Department or a delegate of the Secretary.

(4) Despite subsection (3), an act or decision or the performance of a function or exercise of any power by a person as a delegate of the Head, Transport for Victoria is not invalid only because of any inconsistency between—
(a) that function or power; and
