190 Immunity S. 190(1) amended by No. 34/2023 s. 113(1). (1) The Chief Investigator, Transport Safety or acting Chief Investigator, Transport Safety is not personally liable for anything done or omitted to be done in good faith— S. 190(1)(a) amended by No. 49/2019 s. 96. (a) in the exercise of a power or the performance of a function or duty under this Act or under any other Act; or S. 190(1)(b) amended by No. 49/2019 s. 96. (b) in the reasonable belief that the act or omission was in the exercise of a power or the performance of a function or duty under this Act or under any other Act. S. 190(2) amended by No. 34/2023 s. 113(2). (2) Any liability resulting from an act or omission that would, but for subsection (1), attach to the Chief Investigator, Transport Safety or acting Chief Investigator, Transport Safety attaches instead to the Crown.
