147 Chief executive officer and other employees (1) The board of directors of a Transport Corporation, with the approval of the Minister after consultation with the Treasurer, may appoint a person as the chief executive officer of the Transport Corporation and may at any time remove or suspend a person from that office. (2) The chief executive officer of a Transport Corporation holds office, subject to this Act, on a full-time or part-time basis and on such terms and conditions as are determined by the Minister after consultation with the Treasurer and specified in the instrument of appointment. (3) The chief executive officer may be a director of the Transport Corporation but may not be the chairperson of the board of directors. (4) The chief executive officer may resign from the office in writing signed by the chief executive officer and delivered to the chairperson of the board of directors. (5) If the chief executive officer is unable, whether because of illness, suspension, absence or otherwise, to perform the duties of the office of chief executive officer, the board of directors may appoint another person to act in the place of the chief executive officer during the period of the inability. (6) A person appointed under this section to act in the place of the chief executive officer while so acting— (a) has all the rights and powers, and must perform all the duties, of the chief executive officer of the Transport Corporation; and (b) is to be paid any remuneration and travelling or other allowances fixed by the board of directors from time to time, having regard to the rate of remuneration and allowances for the time being payable to the chief executive officer of the Transport Corporation. (7) The board of directors of a Transport Corporation may employ any persons it considers are necessary for the performance of its functions. S. 147(8) amended by No. 34/2023 s. 124. (8) If the chief executive officer or a person employed by a Transport Corporation was immediately before their appointment an officer within the meaning of the **State Superannuation Act 1988** or a member within the meaning of the **Transport Superannuation Act 1988**, the officer or person continues to be such an officer or member while serving with the Transport Corporation.
