21 Token must be surrendered Reg. 21(1) amended by S.R. Nos 22/2019 reg. 12, 129/2024 reg. 11, substituted by S.R. No. 14/2026 reg. 17(2). (1) An authorised officer, a police officer or a protective services officer may request the holder of a token that proves or purports to prove the existence of a ticket to surrender the token or purported token to the officer if the officer believes on reasonable grounds that the token or purported token may be required as evidence or that its surrender is otherwise necessary for the enforcement of the Act or these Regulations. Reg. 21(1A) inserted by S.R. No. 14/2026 reg. 17(2). (1A) Subregulation (1) does not apply in relation to a token or purported token that is— (a) a smartcard that is not a State token; or (b) a digital token; or (c) a V/Line digital ticket; or (d) a software application or another form of token on a personal electronic device. Reg. 21(2) amended by S.R. No. 14/2026 reg. 17(3). (2) The holder of a token or purported token must without delay comply with a request made under subregulation (1). Reg. 21(3) amended by S.R. No. 14/2026 reg. 17(4). (3) An authorised officer, a police officer or a protective services officer to whom a token or purported token is surrendered under subregulation (1) must, at the time of the surrender, give to the holder of the token or purported token a receipt for the token or purported token. Reg. 21(4) amended by S.R. No. 14/2026 reg. 17(5). (4) A request must not be made under subregulation (1) for the surrender of a token unless a condition determined under section 220D of the Act specifies whether, if such a token is surrendered, the token will be replaced or a refund will be made, to the extent of the whole or part of any unused value remaining on the token at the time of surrender.
