16A Personal electronic device inoperable not a defence (1) Without limiting the generality of regulations 13(1) and 14(1), for the purposes of those regulations, if, in the case of a ticket or purported ticket that is a digital token, the primary reason that the person did not possess a ticket valid for the travel or entry was because the personal electronic device on which the digital token is stored was inoperable, the person did not take all reasonable steps that were available. (2) Without limiting the generality of regulations 13(2) and 14(2), for the purposes of those regulations, if, in the case of a ticket or purported ticket that is a digital token, the primary reason that the person did not produce for inspection a token that proves the existence of a ticket valid for the travel or entry was because the personal electronic device on which the digital token is stored was inoperable, the person did not take all reasonable steps that were available. (3) Without limiting the generality of regulations 13(1) and 14(1), for the purposes of those regulations, if, in the case of a ticket or purported ticket that is a V/Line digital ticket, the primary reason that the person did not possess a ticket valid for the travel or entry was because a personal electronic device on which the V/Line digital ticket is capable of being displayed was inoperable, the person did not take all reasonable steps that were available. (4) Without limiting the generality of regulations 13(2) and 14(2), for the purposes of those regulations, if, in the case of a ticket or purported ticket that is a V/Line digital ticket, the primary reason that the person did not produce for inspection a token that proves the existence of a ticket valid for the travel or entry was because a personal electronic device on which the V/Line digital ticket is capable of being displayed was inoperable, the person did not take all reasonable steps that were available.
