348 Proceedings (1) On the commencement day, the TSC is, by force of this section, substituted as a party to any proceeding pending in any court or tribunal in respect of a matter arising under Part VI to which the Secretary was a party immediately before that day. (2) On the commencement day, every order made by a court or tribunal in a proceeding (whether pending or otherwise) in respect of a matter arising under Part VI before that day applying to the Secretary that has not been abided by or complied with by the Secretary before that day is taken to be an order applying to the TSC.
