338 Cancellation or alteration of licences (1) This section applies to an application made under section 146 before the commencement day by a licence holder for— (a) the cancellation of the licence; or (b) the alteration to the conditions attached to the licence; or (c) the alteration to the route or area in respect of which the licence was granted— and in respect of which the Secretary has not made a decision whether to approve or refuse to approve the application before that day. (2) On and after the commencement day, the TSC may make the decision, and for that purpose, anything done before that day by the Secretary for the purpose of making that decision is taken to have been done by the TSC.
