   • The Bill does not create express civil causes of action for consumers to seek redress for overcharging; enforcement is via statutory penalties. Affected parties seeking civil remedies must rely on existing consumer protections outside the new Part 3C unless regulators take enforcement action.

1. Understand whether the duty applies to you (s 74, s 75)

   • Confirm that the business is captured as a "fuel retailer" selling fuel at a "service station" (s 74). If the primary business is hiring, leasing or selling motor vehicles, the premises are excluded (s 75).
   • Confirm which fuel types you offer are within the statutory definition of "fuel" (s 75), noting the cross-reference to the Commonwealth Fuel Quality Standards Act 2000 and hydrogen.

2. Establish daily pricing governance and a 2pm next-day reporting workflow (s 76(1)-(2))

   • Implement an internal daily pricing approval and notice workflow that produces a written fuel price notice by no later than 2pm on the day before the price applies (s 76(2)).

   • The retailer must ensure information in each fuel price notice or reduced price notice is entered into the aggregation system within 30 minutes of the notice being given to the commissioner (replacement s 6(2)-(3)).    • Prepare to use whatever technical interface is specified by the aggregation operator (API, portal, or other) and plan failover and audit logging. 5. Price control and the 5c/L inter-day cap (s 77(2), s 79)

   • During the relevant period, do not offer fuel for retail sale at a price above the lower of the stated price or any reduced price notified (s 77(2)). Ensure pump prices and POS systems reflect the ceiling.
   • When preparing a new stated price in a fuel price notice, ensure the price does not exceed the prior stated price by more than 5 cents per litre or, if a reduced price was given in the previous relevant period, the lowest reduced price by more than 5c/L (s 79).
   • Maintain per-fuel-type, per-site price histories (previous stated prices and any reduced prices) to calculate permissible increases.

6. Reconcile discounts and "no-discount" reporting baseline (s 75, s 77(2))

   • The "fuel price" and the "stated price" are required to be declared as prices without any discount being applied in any way (s 75, s 76(1)(a)). Review loyalty programs, bundled promotions and discount mechanisms and ensure the no-discount baseline is accurately documented.
   • Ensure pump displays and POS systems reconcile customer-facing discounts with the declared stated price so that during the relevant period actual charged prices do not exceed the statutory ceiling (s 77(2)).

7. Documentation, record-keeping and audit trail

   • Retain copies of each written fuel price notice and each reduced price notice given to the commissioner, including timestamps of transmission and any acknowledgements from the commissioner or the aggregation system.
   • Keep logs showing when aggregation-system entries were completed and retain evidence of any system unavailability or errors, with timestamps to demonstrate reasonable steps taken if an enforcement action arises.

8. Train staff and assign responsibilities

   • Identify and authorise the individuals who may sign and transmit fuel price notices and reduced price notices. Establish a clear internal escalation protocol for price reductions to meet the 30-minute notification window (s 78(2)).
   • Train forecourt staff and pricing managers on the legal ceiling during the relevant period and on the process to take corrective action if posted/pump prices are inconsistent with reported stated price or reduced price.

9. Monitor regulatory updates and guidance

   • Because the Bill removes certain definitions from subordinate regulations and centralises them in the Act (ss 7-9, s 11), monitor the Fair Trading regulations and any guidance from the commissioner for updated technical rules, aggregation-system specifications, and enforcement practice.
   • Track commencement dates: Parts 2-4 commence six months after assent or earlier by proclamation (s 2). Use the six-month lead-in to implement systems, pilot reporting and coordinate with aggregation-system operators.

10. For transport providers dealing with "50c service" fares

    • If you operate or contract a "50c service" as defined (a general route service with an initial fare of 50c), be aware that the chief executive cannot change the fare without Legislative Assembly approval on a motion of which at least 28 days’ notice has been given (new s 145(2)-(3)). Any planned fare change will require a political timetable and cannot be accomplished unilaterally or quickly.

11. Prepare for enforcement risk and penalty exposure

    • Each key contravention has a maximum penalty of 20 penalty units. Ensure compliance processes and documentation are in place to limit enforcement exposure and to support any defence under the broader Fair Trading enforcement framework.
