#### 110 Miscellaneous provisions relating to contracts of transport authority 110 Miscellaneous provisions relating to contracts of transport authority > > (1) A contract or arrangement made or entered into by a transport authority for the carrying out of works or the performance of services may provide for— > > > > > (a) the whole or any part of the works to be undertaken by the authority, or > > > > > (b) the whole or any part of the cost of the works to be paid by the authority, or > > > > > (c) a loan to be made by the authority to meet the whole or any part of the cost of the works, or > > > > > (d) the authority to pay the whole or any part of the cost of providing the services during a specified period. > > > (2) A transport authority may make and enter into contracts or agreements for the payment of money (or the carrying out of works) in settlement of a claim brought against the authority for compensation or damages in relation to the functions of the authority. > > > (3) A contract under this section shall be deemed for the purposes of the [Constitution Act 1902](/view/html/inforce/current/act-1902-032) to be a contract for or on account of the Public Service of New South Wales.
