Transport Accident (Impairment) Regulations 2020

The Regulations operate around a small set of interlocking concepts drawn from the Transport Accident Act 1986 and realised through numerical tables.

• Periodic payment: The Regulations make clear that periodic payments provided for under sections 47(4) and 48(1) of the Act are weekly payments (regulations 6 and 7). The Regulations supply the calculation mechanism and the numerical factors that convert an assessed impairment benefit or annuity into a weekly stream.

• Variables A and B: Both regulations 6 and 7 use two variables. "A" is the assessed benefit figure: in regulation 6 A is the impairment benefit assessed under section 47(2) less the part paid under section 47(3)(c) and any interim benefit paid; in regulation 7 A is the amount determined under the pre‑2004 form of section 48(1) (regulations 6 and 7). "B" is an amount pulled from Schedule 1 determined by the person's age at the date of assessment; B is specified differently depending on age bands so the lookup unit is completed years, completed months or completed weeks depending on the age at assessment (regulation 6(b)-(d)).

• Age tiering and lookup tables: Schedule 1 contains granular dollar amounts (Column 2) that correspond to age entries in Column 1. For ages 18 to 54 the table is indexed by completed years, for people aged 55 to under 72 it is indexed by years and completed months, for people aged 72 to under 75 it is indexed by years and completed weeks, and for people 75 years or over B is a flat $10 000 (regulation 6(a)-(d); Schedule 1). The Schedule thus implements an age‑sensitive conversion factor.

• Redemptions: Two distinct approaches are included for redemption of weekly payments into lump sum amounts depending on which statutory regime applies. Regulation 9 provides the mechanics for the former s56(1) (as it then operated). That mechanism feeds values from Schedule 2 and depends on the assessed degree of impairment, the period until payments would cease under certain sections of the Act, and the weekly payments for loss of earning capacity (regulation 9). Regulation 10 implements the current statutory redemption approach: for persons under 50 percent impairment the redemption is calculated with a fixed 78 week multiplier less weeks already received; for persons 50 percent or more the Commission forms an opinion about the likely future entitlement weeks and multiplies the weekly earning capacity payment by that number of weeks (regulation 10).

• Rounding: Small fractional cents in weekly payments may be addressed administratively by rounding up non‑final payments to the next cent and reducing the final payment accordingly (regulation 8).

• Transitional and textual cross‑references: Several provisions refer to the Act as in force immediately before certain amendments (regulations 6 and 7 refer to the pre‑2004 version of s 48(1) and regulation 9 refers to the pre‑2004 form of s 56(1) and to s 53 as it stood then). The Regulations therefore contain explicit cross‑references to different historical forms of the Act where necessary to administer legacy entitlements (regulations 6, 7 and 9).

• Commission discretion: Regulation 10(2) requires a Commission opinion to determine the number of weeks for which a person with 50 percent or more impairment is likely to be entitled to loss of earning capacity payments. That introduces an administrative judgement into redemption calculations (regulation 10(2)).

• Revocation and sunset: The Regulations revoke the 2010 instrument (regulation 4) and, per the Endnotes, will sunset after ten years from the date of making pursuant to the Subordinate Legislation Act 1994.

These concepts convert statutory labels (impairment benefit, annuity, loss of earning capacity) into arithmetic operations and table lookups to produce weekly payment amounts and redemption figures. The presence of two redemption regimes and age‑sensitive lookup rules means administrators must select the correct statutory reference point and table entry when computing entitlements.

The Regulations affect three principal groups directly and others indirectly.

• Injured persons and claimants under the Transport Accident Act 1986: Any person assessed to have an impairment benefit under section 47(2), any person whose entitlement arises under the pre‑2004 form of section 48(1) (impairment annuities), and any person receiving or eligible to receive weekly payments for loss of earning capacity under sections 49, 50 or 51 are affected. The Regulations specify how the assessed impairment benefit or annuity is converted into weekly periodic payments (regulations 6 and 7; Schedule 1), and how redemptions of continuing weekly payments into lump sums are to be calculated (regulations 9 and 10; Schedule 2).

• Administrators and the Commission: The Commission and the administrative officers who calculate entitlements are primary users. The Regulations require administrators to use schedules and age‑based lookups, to apply rounding rules and, in the case of redemptions for persons with 50 percent or more impairment, to form and record an opinion about future entitlement weeks (regulations 6-10). The Regulations were made under sections 132 and 191 of the Act, which delegate power to the Governor in Council, and they therefore impose discrete formulaic duties on those implementing the Act (regulation 2).

• Insurers, legal advisers and accountants: Practitioners advising claimants, insurers and employers will be required to translate assessed impairment amounts and weekly loss of earning capacity payments into the weekly payment or redemption amounts specified by the Regulations. The granular tables in Schedule 1 and Schedule 2 will be the operative conversion tools used when calculating present and future entitlements. Advisers will need to ensure they apply the correct table cells depending on age at assessment and impairment percentage, and to adjust for interim payments already made (regulation 6; regulation 10).

• Other public bodies and tribunals: Where disputes about calculation, rounding, the correct table entry or the Commission’s opinion arise, courts or tribunals will be required to interpret and apply these Regulations in the context of the Act. The Regulations reference the Act’s various sections governing cessation and entitlement (for example, sections 48-53 and 56), so dispute panels will need to align both the Act and these numerical rules.

Indirect consequences affect employers and the wider market. For example, the change of an assessed lump amount into weekly payments or into a redemption lump sum will affect cashflow for claimant households and potentially the liability profile of scheme administrators. Those effects flow from the arithmetic set out here rather than from broader policy signals, because the Regulations are operative rules rather than statement of entitlement scope.

The Endnotes also impose a time‑limit on the Regulations through the Subordinate Legislation Act 1994 sunset provision, which means that affected parties should expect a review or replacement by 19 May 2030 absent legislative extension (Endnotes).

The Regulations create duties for administrators and define mathematical rights for claimants in the sense of the manner in which statutory entitlements must be converted into payments.

Duties and processes

• Application of the prescribed formulae: Administrators must calculate weekly periodic payments in accordance with the formulae indicated in regulations 6 and 7. Although the printed reproduction contains formula images that are not shown here, the Regulations supply the necessary variable definitions: A (the assessed impairment amount, net of certain prior payments) and B (the amount obtained from Schedule 1 according to age at assessment) (regulations 6 and 7). Administrators therefore have a duty to obtain the correct assessed A figure and to select the correct B entry using the age lookup rules in regulation 6.

• Subtraction of prior payments: Regulation 6 defines A as the amount of the impairment benefit under section 47(2) less "the sum of the part of impairment benefit paid under section 47(3)(c) of the Act and any interim benefit paid". That imposes the duty to deduct prior partial impairment payments and interim benefits from the assessed total before applying the conversion mechanism.

• Use of age‑based lookup rules: Administrators must apply different lookup rules for B depending on the person’s age brackets. Regulation 6 provides explicit cutoffs: persons aged 18 to under 55 years and one month use Column 2 opposite the person’s age in completed years; people aged 55 years and one month to under 72 years and one week use years and completed months; people aged 72 years and one week to under 75 years use years and completed weeks; persons 75 years or over receive a B value of $10 000. This creates a precise duty to compute the person’s exact completed years, months or weeks at the date of assessment.

• Rounding rule application: Where a weekly payment contains a fraction of a cent, administrators may round non‑final payments up to the next cent and must reduce the final payment accordingly. That is an expressly authorised administrative action (regulation 8).

• Redemption calculations: For redemptions, the Regulations set out specific arithmetic depending on impairment degree and whether the redemption is under the former or current s56(1). Regulation 10(1) prescribes a precise formula for persons with impairment less than 50 percent: the redemption equals the weekly loss of earning capacity payment A multiplied by (78 minus the number of weeks already received C). For persons with impairment 50 percent or more, regulation 10(2) requires the Commission to form an opinion as to the number of weeks the person is likely to be entitled to receive loss of earning capacity payments; the redemption equals A multiplied by that number of weeks. These provisions create duties to (a) compute A correctly, (b) track weeks already paid, and (c) for the Commission, to record its opinion about future weeks (regulation 10).

Rights and entitlements

• Certainty of conversion: For claimants, the Regulations guarantee that an assessed impairment benefit or annuity, once determined under the Act, will be converted into weekly payments or redeemed into a lump sum by reference to the prescribed formula and tables. That is a right created by the instrument: the conversion mechanism is mandatory and specified (regulations 6-10; Schedules 1-2).

• Treatment of interim payments: The Regulations protect administrators from double counting by requiring the deduction of amounts already paid as interim benefits or under section 47(3)(c) from the A figure used in periodic payment calculations (regulation 6).

• Fixed multiplier for low impairment redemptions: Persons with less than 50 percent impairment receive a redemption calculated against a fixed 78 week multiplier (regulation 10(1)). That provides a transparent and bounded approach to redemptions in that category.

Discretion and scope for administrative judgement

• Commission opinion for higher impairments: Regulation 10(2) delegates a significant evaluative role to the Commission in determining the number of weeks to be used for persons with 50 percent or more impairment. That is a statutory delegation of evaluative discretion; the Commission’s view becomes the basis for the arithmetic conversion.

• Transitional and historical regimes: Some calculations depend on whether an entitlement arises under the old versions of sections 48 or 56 as they existed immediately before 2004 amendments (regulations 7 and 9). Administrators therefore have the duty to establish which statutory regime governs the particular entitlement before selecting the applicable calculation method.

Duty to follow published tables and definitions

• Use of Schedules: The Regulations require the use of Schedule 1 to determine the B value for periodic payments (regulations 6 and 7) and Schedule 2 to determine values for redemptions under the older regime (regulation 9). The Schedules are integral to the operation of the rule and therefore form part of the duty set out by the instrument.

Record‑keeping and proof burdens are implied by the prescriptive nature of the calculations. Administrators will need, as a practical matter, to record the date of assessment, the age expressed in the correct unit (completed years, months or weeks), the assessed A figure net of interim payments, the weeks already paid, and, where applicable, the Commission’s opinion and its basis. The Regulations themselves do not prescribe ancillary procedural records but their arithmetic demands imply such administrative work to ensure correct application.

The text of these Regulations does not itself create or specify criminal or civil penalties for non‑compliance with the numerical calculation rules. The instrument is a statutory rule made under the Transport Accident Act 1986 (regulation 2), and its primary function is prescription of method rather than punishment. Enforcement and remedies therefore arise through the machinery of the parent Act and the usual administrative and judicial review routes available under Victorian statute and common law, rather than by express penalties contained in these Regulations.

Key enforcement and compliance channels that follow from the instrument and its statutory context are as follows.

• Administrative enforcement via the Act and Commission processes: The Transport Accident Act 1986 provides the statutory framework for entitlements, administration and dispute resolution. The Regulations prescribe how certain numerical conversions are to be performed under that framework. If an administrator or the Commission fails to apply the Regulations correctly when determining weekly payments or redemptions, affected persons may seek remedies under the Act, including internal review, reconsideration, or external review where the Act permits. The Regulations themselves do not specify a penalty schedule.

• Judicial review and adjudication: Errors in calculation, misuse of discretion (for example, in the Commission’s opinion about future weeks under regulation 10(2)), or failure to deduct interim payments as required could be challenged before tribunals or courts on statutory construction, procedural fairness or correctness grounds. The Regulations are prescriptive; a court would interpret and enforce them in the context of the Act if asked to resolve a dispute. The instrument contains detailed cross‑references to specific subsections of the Act (for example, sections 47, 48, 49-51, 53 and 56) so adjudicators will apply the Regulations together with those Act provisions.

• Audit and administrative oversight: As a matter of public administration, the Commission and other bodies responsible for applying these Regulations will be subject to audit and oversight, including accuracy of calculations and compliance with rounding rules. The Regulations’ prescriptive method reduces the scope for divergent practice by requiring use of specified tables and formulas.

• No express offences in the instrument: Because the Regulations do not create express offences or pecuniary penalties, enforcement is achieved through the remedies and sanctions elsewhere in statute or the courts. The administrative remedies available to injured persons and the accountability of the Commission under the Act are therefore the practical enforcement mechanisms.

Practical implications for enforcement

• Burden of proof and record keeping: In any enforcement or review context the Commission or the administering body will need to show that it applied the prescribed formulae and selected the correct Schedule entries, that it deducted interim payments required by regulation 6, and that, where applicable, the Commission’s opinion under regulation 10(2) was formed on a proper factual basis. Good administrative record keeping is therefore essential for defensibility.

• Rounding adjustments: The rounding rule in regulation 8 permits rounding up of non‑final payments and reduction of the final payment. If the administering body applies rounding inconsistently across cases, disputes may arise. The Regulations authorise the rounding approach; the administration must document when and how rounding was applied.

• Transition and historical regimes: Enforcement challenges may arise where an entitlement spans multiple historical forms of the Act. Regulation 9 applies specifically to the former s56(1) as it existed immediately before 2004 amendments. Establishing which regime applies in a given case will be a threshold factual and legal question in disputes.

In short, the instrument prescribes calculation methods and leaves enforcement to the Act’s existing administrative and judicial mechanisms. The Commission’s exercise of opinion in regulation 10(2) will be a focal point for enforcement disputes where large lump sum redemptions are at stake and where judgment about future entitlement weeks materially affects present value calculations.

These Regulations are a subordinate legislative instrument made under the Transport Accident Act 1986 and operate as implementing rules for specific provisions of that Act. The interaction points in the text are explicit and must be observed when applying the numerical mechanics.

Primary interactions with the Transport Accident Act 1986

• Authorising Act and sections referenced: The Regulations are made under sections 132 and 191 of the Transport Accident Act 1986 (regulation 2). They reference and implement provisions of the Act, in particular sections 47, 48, 49, 50, 51, 53 and 56. The calculation of weekly periodic payments for impairment benefits is for the purposes of section 47(4) (regulation 6). Regulation 7 applies to section 48(1) "as in force immediately before the commencement of section 13 of the Transport Accident (Amendment) Act 2004", showing an explicit linking to different historical versions of the Act.

• Legacy provisions and transitional application: The Regulations make repeated reference to older versions of the Act. Regulation 7 concerns the pre‑2004 form of section 48(1) and regulation 9 concerns redemptions under section 56(1) "as in force immediately before the commencement of section 11 of the Transport Accident (Amendment) Act 2004". Those references create an interaction that requires administrators to determine which statutory regime governs a particular claim and then to apply the corresponding regulation and Schedule entries.

• Cessation rules in the Act: Regulation 9 refers to cessation of payments under section 53(3) and to the circumstances in which payments under sections 49, 50 or 51 would cease under section 53(1) or (3) (regulation 9). Thus the computations in the Regulations depend on the Act’s rules about entitlement duration and cessation.

Interaction with subordinate legislation and procedural Acts

• Subordinate Legislation Act 1994: The Endnotes record that these Regulations will sunset 10 years after making under section 5 of the Subordinate Legislation Act 1994. That interacts with the lifecycle rules for subordinate instruments and requires a renewal or replacement process for continued operation beyond 19 May 2030 (Endnotes).

• Interpretation of Legislation Act 1984 (ILA) effects: The Endnotes include explicit interpretative statements concerning the ILA (for example, that headings and notes form part of the Statutory Rule where applicable, and that punctuation matters). Those statements mean that Schedule headings and tables are legally operative for interpretation purposes and that the formatting in the published Rule is part of the legal text (Endnotes, Interpretation).

Administrative law and evidence

• Commission discretion and administrative law: Regulation 10(2) delegates evaluative judgment to the Commission in determining the number of weeks a person is likely to be entitled to loss of earning capacity payments. That delegation sits within the general administrative law framework. Decisions based on that opinion will engage the usual standards: whether the decision-maker acted within power, applied relevant considerations, avoided irrelevant considerations, and observed procedural fairness where required. Those constraints are not restated in the Regulations but exist in the broader statutory and common law context.

• Evidence and medical assessment: The Regulations rely on quantified outcomes from assessments under the Act (for example, the "amount of the impairment benefit assessed in accordance with section 47(2)" is the A variable in regulation 6). Thus medical assessments, reports and evidence required by the Act are operational inputs to the calculations mandated by the Regulations.

No express cross‑conflict clauses or inconsistencies are present in the text. The Regulations effectively operationalise the Act’s entitlements rather than alter entitlement scope. Where multiple statutory versions apply, the Regulations explicitly signal which version governs (for example, "as in force immediately before" language in regulations 7 and 9), reducing the risk of inadvertent conflict.

Practical points of interaction

• Determining applicable law: A practitioner must identify whether an entitlement arises under the then‑current Act provisions or under an earlier version (pre‑2004). That determines whether to use regulation 7 or regulation 6, and whether redemption calculations follow regulation 9 or 10.

• Using the Act’s definitions and assessments: The Regulations do not redefine the substantive assessments the Act requires. They require administrators to take the Act’s assessed figures as inputs and then convert them per the tables. If a dispute exists about the assessed impairment under s 47(2) or the weekly loss of earning capacity payment under sections 49 to 51, that substantive dispute will be resolved under the Act before these Regulations can be applied.

• Publication and authoritative text: The Endnotes and Interpretation material indicate that the published form, tables, headings and punctuation of the Regulations are part of the instrument. Practitioners must therefore consult the official published Rule, including Schedules and any explanatory material, when computing payments.

In summary, these Regulations implement and interact directly with specific parts of the Transport Accident Act 1986, draw on the Act’s substantive assessments as inputs, and must be applied in the context of both current and pre‑2004 statutory regimes depending on the particular entitlement. They are anchored to the Act and to the subordinate legislation lifecycle rules under the Subordinate Legislation Act 1994.

The published instrument records a succinct amendment history.

• New instrument and revocation of predecessor: Regulation 4 revokes the Transport Accident (Impairment) Regulations 2010. The Endnotes confirm the Regulations were made on 19 May 2020 and came into operation on 24 May 2020 (regulations 3 and 4; Endnotes).

• No subsequent amendments at publication: The Endnotes include a "Table of Amendments" section which, as published, states there are no amendments made to the Transport Accident (Impairment) Regulations 2020 by statutory rules, subordinate instruments or Acts (Endnotes, Table of Amendments). It also records that there are no amendments "Not in Operation" at the date of publication (Endnotes, Amendments Not in Operation).

• Sunset provision under Subordinate Legislation Act 1994: The Endnotes state that the Regulations will sunset 10 years after the day of making on 19 May 2030 pursuant to section 5 of the Subordinate Legislation Act 1994. That imposes an automatic lifecycle expiry unless the Regulations are remade or extended in accordance with the Subordinate Legislation Act (Endnotes).

• Style and interpretative changes: The Endnotes reference the Interpretation of Legislation Act 1984 (ILA) and provide notes about how headings, examples, punctuation and provision numbers form part of the Statutory Rule. Those statements are not amendments to the substance of these Regulations but confirm that standard interpretative rules apply to the presentation and structure of the instrument (Endnotes, Interpretation of Legislation Act 1984).

No further amendment history, transitional modification, repeal or replacement is recorded within this text. Practitioners should therefore treat the 2020 Regulations as the operative instrument for calculation method until either amended or replaced, subject to the sunset date in 2030.

Because the instrument references historical versions of the Act (particularly provisions as in force immediately before specified 2004 amendments), the effective operational history of how the Act and Regulations interact includes the prior 2010 Regulations that were revoked. Any transition arrangements required by those revocations or by changes between the old and new Regulations must be located in supplementary materials or in the parent Act; the text here does not supply additional transitional clauses beyond the explicit cross‑references to historic statutory versions.

The text of the Transport Accident (Impairment) Regulations 2020 and its Endnotes do not record any litigation history. There are no cases, judgments or tribunal decisions cited or referred to in the printed instrument. The Endnotes contain only administrative and interpretative notes about the instrument’s making, commencement and sunset. The "Table of Amendments" section records that there have been no amendments to these Regulations by later instruments as at the date of publication.

Practical consequence

• Absence of reported decisions in the instrument: Because the Regulations are technical and were only made in 2020, and because this printed copy contains no litigation references, there is no litigation history recorded within the instrument itself. That does not mean no disputes have arisen in practice; it means that no case law is included in the text.

• Likely focal points for future litigation: Although not recorded in the instrument, the most likely areas where litigation or tribunal challenges might arise, based on the instrument’s content, are identifiable from the Regulations themselves. They include (a) disputes about the correct interpretation or application of the lookup rules in Schedule 1 (for example, the precise computation of completed years, months or weeks at the date of assessment and thus the correct B entry), (b) challenges to whether interim payments were correctly deducted when computing A under regulation 6, (c) disputes about whether the Commission correctly formed its opinion under regulation 10(2) about the number of weeks a person with 50 percent or more impairment is likely to be entitled to receive loss of earning capacity payments, and (d) issues arising from the rounding mechanism in regulation 8 where final payment reductions are contested.

• Record and proof requirements in disputes: In any litigation about calculation the administrator will need to supply documentary proof of the assessments and calculations, the date of assessment, interim payment records and, where relevant, the Commission’s reasons or basis for its opinion. The Regulations’ prescriptive nature means errors in arithmetic or in selection of table rows will be readily identified in any review.

In sum, the instrument contains no internal litigation history. Practitioners should expect possible disputes in the predictable technical areas set out above and should prepare evidentiary materials accordingly. Any reported decisions construing or applying these Regulations will need to be located in public case law databases rather than in the text of the Regulations themselves.

The Regulations are numerically precise but contain several points where mistakes are easy and consequences significant. Below are practical "gotchas" drawn from the instrument.

• Missing formula images in some reproductions: In the version reproduced here the arithmetic formulae in regulations 6, 7 and 9 appear as graphic placeholders and are not shown in the text body. The variable definitions for A and B are present. Practitioners should consult the official published instrument (the authoritative version on the Victorian legislation website) to view the formula graphics or their textual representation before performing calculations. The rules still require application of the formulae as published (regulations 6, 7 and 9).

• Different age units across bands: Schedule 1 uses different indexing units depending on the age at the date of assessment. For ages 18 to under 55 years and one month, the lookup is by completed years; for 55 years and one month up to 72 years and one week it is by completed months; for 72 years and one week up to 75 years it is by completed weeks; for 75 and over B is a flat $10 000 (regulation 6(a)-(d); Schedule 1). Miscomputing the age or using the wrong unit (for example using years instead of months when the person is 56 years and some months) will produce incorrect B and therefore an incorrect weekly payment.

• Exact cutoff points: The Regulations use precise cutoffs expressed in combined units (for example "55 years and one month", "72 years and one week"). Practitioners must compute these thresholds accurately using the date of assessment. Slight errors in the date arithmetic will produce a different column lookup.

• Deducting prior payments from A: Regulation 6 requires that the impairment benefit A be reduced by the amount paid under section 47(3)(c) and any interim benefit. Failure to identify or deduct these payments will overstate A and therefore the weekly payment.

• Rounding reduces the final payment: Regulation 8 authorises rounding up non‑final weekly payments to the next cent and reducing the final payment accordingly. If administrators round up routinely and do not account for the compensating reduction in the final payment, they will produce overpayments or inconsistent payment streams.

• Two redemption regimes and legacy references: Regulation 9 applies to redemptions under the Act "as in force immediately before" the 2004 amendment, while regulation 10 applies under the current s56(1). Claims that straddle the 2004 amendment or that arise from older decisions require attention to which redemption formula applies. Using regulation 10 when regulation 9 should apply (or vice versa) will generate materially different lump sums.

• Fixed 78 week multiplier for <50 percent impairment: For persons assessed with less than 50 percent impairment, regulation 10(1) fixes B at 78 weeks and requires subtraction of weeks already paid. Practitioners should confirm the number of weeks already paid (C) with administrative records and ensure it is accurate at the redemption time. Miscalculating weeks received will overstate or understate the redemption amount.

• Commission opinion is a discretionary pivot: For persons with 50 percent or more impairment, regulation 10(2) converts the Commission’s opinion about likely future entitlement weeks into the lump sum multiplier. The regulations do not specify the evidentiary criteria or process for forming that opinion. That leaves a potential area of contest as to whether the Commission acted reasonably, took relevant considerations into account, or properly documented its opinion.

• Schedule 2 granularity and legacy conversion factors: Schedule 2 contains many cells mapping periods to dollar amounts for the former s56(1) redemption mechanism. Using the wrong cell (for example misreading weeks versus months or mislocating the number of complete weeks) will produce incorrect redemption figures. Regulation 9(2) states that a period of less than a week is taken as a complete week for definitions B and D in regulation 9, which affects how fractional week periods are rounded up for table lookup.

• Interaction with Act cessation rules: Regulation 9(a)(i) links the calculation period to the day on which payments under sections 48-51 would cease in accordance with section 53(3) "as in force immediately before" the 2004 amendment. Practitioners must therefore review the historical s53(3) rules when applying regulation 9. Misapplying the current s53 to a former regime case can create calculation errors.

• Record and evidence burden for opinion-based redemptions: If a claimant challenges a Commission opinion under regulation 10(2), the absence in the Regulations of a statutory criteria list for forming that opinion shifts emphasis to administrative practice and records. Poor documentation of the opinion’s basis will make the decision vulnerable to review.

• Reliance on official published tables and formatting: The Endnotes emphasise that headings, tables and punctuation form part of the Statutory Rule under the Interpretation of Legislation Act 1984. That means that mistakes caused by relying on an abridged or formatted copy that omits a table cell or misaligns columns may be legally consequential. Always consult the official published version.

These "gotchas" are procedural and arithmetic in nature. The Regulations are explicit about the methods to use; the common sources of error are selection of the wrong Schedule entry, date arithmetic errors for the age and weeks, omission of required deductions from A, incorrect rounding treatment, and inadequate documentation of the Commission’s opinion under regulation 10(2).

Compliance requires a combination of correct legal identification (which statutory regime applies), precise data capture (dates and interim payments), use of the correct lookup table entries, accurate arithmetic, and good administrative records. Below is a practical checklist and process that implements the Regulations’ requirements.

1. Identify the governing statutory regime

• Confirm whether the entitlement arises under the current Transport Accident Act provisions or under an earlier form of the Act cited in the Regulations. Regulation 7 and regulation 9 explicitly apply to the pre‑2004 forms of section 48(1) and section 56(1) respectively. Establish the relevant date on which the entitlement arose to determine which regulation applies.

2. Establish the A input

• For periodic impairment payments (regulation 6), obtain the impairment benefit amount assessed under section 47(2) of the Act.
• Deduct the sum of any part paid under section 47(3)(c) and any interim benefit paid, as required by regulation 6. Record the dates and amounts of those prior payments.
• For impairment annuities under regulation 7, identify the A figure determined under the pre‑2004 section 48(1) where applicable.

3. Determine the B lookup entry from Schedule 1

• Record the person’s age at the date of assessment precisely.
• Apply the correct lookup unit in regulation 6:
  • If the person is 18 up to but not including 55 years and one month, use the Schedule 1 entry opposite the age in completed years.
  • If the person is 55 years and one month up to but not including 72 years and one week, use the entry opposite the age in years and completed months.
  • If the person is 72 years and one week up to but not including 75 years, use the entry opposite the age in years and completed weeks.
  • If the person is 75 years or over, B is $10 000.
• Use the official published Schedule 1 to select the Column 2 dollar amount precisely.

4. Apply the formula

• Consult the authoritative published text of the Regulations to view the formula graphic (regulations 6 and 7). Use the defined A and B inputs to compute the weekly periodic payment as prescribed.
• Where performing manual or spreadsheet calculations, verify arithmetic and cell references carefully.

5. Apply rounding rule if required

• If the weekly payment includes a fraction of a cent and the payment is not the final payment, you may round that weekly payment up to the next cent. Keep a running adjustment to reduce the final payment by the cumulative extra cents rounded up in prior payments (regulation 8).
• Document how rounding was applied and show the calculation that leads to the final payment reduction.

6. Redemptions under section 56

• Determine whether redemption is under the current s56(1) (use regulation 10) or under the former s56(1) (use regulation 9). For older entitlements, use Schedule 2 conversions as prescribed by regulation 9.
• For current s56(1):
  • If the assessed degree of impairment is less than 50 percent, calculate the redemption amount using regulation 10(1): A × (78 − C), where A is the weekly loss of earning capacity payment at the time of redemption and C is the number of weeks already received. Confirm the accuracy of C in payment records.
  • If the assessed degree of impairment is 50 percent or more, proceed as regulation 10(2) requires: A × B, where B is the number of weeks which, in the opinion of the Commission, the person is likely to be entitled to loss of earning capacity payments. The Commission must form and record its opinion and the factual basis for it.
• For redemptions under the former s56(1):
  • Use regulation 9 and Schedule 2. Determine A as the weekly payment per regulation 7 and use the correct Schedule 2 entry for B and D depending on impairment degree and the relevant period to be converted. Note that regulation 9(2) treats periods of less than one week as a complete week for the B and D definitions.

7. Commission opinions and documentation

• Where the Commission must form an opinion (regulation 10(2)), ensure that the opinion is based on documented evidence (medical reports, employment history, vocational prognosis). Record the opinion, its date, its basis, and the decision maker within the Commission who formed the opinion. Good record keeping will be critical if the opinion is later subject to review.

8. Verify historic cessation rules where relevant

• If regulation 9 applies, identify the relevant cessation date under the former section 53(1) or (3) as the Regulation requires, because the length of the period to be converted can depend on those cessation rules.

9. Use authoritative published materials

• Because the printed reproduction used here contains placeholder images in some regulations, always work from the official published statutory instrument on the Victorian legislation website to ensure you use the correct formula representations and table values in Schedules 1 and 2.

10. Record keeping and audit trail

• Maintain a clear audit trail for each calculation showing:
  • the assessed impairment amount and source (section 47(2) paperwork),
  • interim payments and amounts deducted,
  • the date of assessment used to compute the age and the corresponding B entry,
  • the computed weekly payment and formulae used,
  • rounding applied and the impact on the final payment,
  • for redemptions, the weeks already paid, the Commission opinion (if required), and supporting medical/vocational evidence.

11. Reconciliation and communication

• Provide the claimant with a calculation breakdown showing the inputs (A, B, C where applicable), the applied table entries, rounding adjustments and the final weekly or lump sum amount. This transparency reduces disputes and supports administrative efficiency.

12. Quality control

• Implement peer review for calculations that produce large lump sums or redemptions. Where a Commission opinion drives the result, have a second senior officer review the reasoning and documentation.

This compliance approach follows the letter of the Regulations. The instrument requires precise arithmetic, correct table selection, and documented administrative judgment where required. Following the steps above will reduce the risk of miscalculation, improper rounding, or insufficient documentation of the Commission’s discretionary opinions.
