Transport Accident (Administration of Charges) Regulations 2021

The central concept is the “transport accident charge”. Although the instrument does not define it, the charge is imposed under the Transport Accident Act 1986 and funds Victoria’s no-fault transport accident compensation scheme (the TAC scheme). The regulations do not set the amount of the charge; they merely prescribe when it must be paid and for what duration it covers a vehicle. The concept of a “prescribed period” is thus the temporal scope of coverage for which a single payment of the charge applies. For most vehicles, this tracks exactly the registration period, meaning the charge is paid each time the vehicle is registered or its registration is renewed.

A second key concept is the classification of motor vehicles into eight categories. The classification is not based on vehicle type (car, truck, motorcycle) but on the vehicle’s registration status and the permit or authorisation under which it operates. The classes are: (1) vehicles registered under Part 2 of the Road Safety Act 1986 (the ordinary registration class); (2) vehicles that under regulation 58 of the Road Safety (Vehicles) Regulations 2021 may be registered for less than 12 months (e.g. short-term registrations); (3) recreation vehicles registered under the Road Safety Act; (4) vehicles under the control of a person with a general identification mark (trade plates); (5) vehicles with a club permit; (6) vehicles with an unregistered vehicle permit; (7) visiting overseas motor vehicles that are exempt from Victorian registration and not covered by interstate insurance; and (8) all other unregistered vehicles not otherwise referred to.

The third concept is the “prescribed time or interval”,that is, the deadline for paying the charge. For most categories, it is a single event: at registration, renewal, issuing of a permit, or arrival. For the residual unregistered vehicles, it is a recurring annual obligation: the date of application and each anniversary. This creates a distinct ongoing compliance requirement for owners of unregistered vehicles that do not fall into any other category (which would include vehicles kept on private land, or rare historical vehicles not eligible for permits, or vehicles between registration periods).

The refund mechanism under regulation 7 is another key concept. It provides a pro-rata refund when the charge is no longer required due to cancellation of registration or disposal/destruction of an unregistered vehicle. The formula includes any duty paid under the Duties Act 2000 as part of the amount paid. This means the refund is calculated on the total outlay including duty, not just the charge itself. The refund applies only if the charge is “no longer required to be paid” , a phrase that likely means the vehicle no longer needs TAC coverage because it is no longer used on public roads.

Also significant is the revocation of the 2011 regulations. The 2021 regulations are a remake, as required by the Subordinate Legislation Act 1994 (sunset after 10 years). The instrument preserves the basic structure of the former regulations but updates cross-references to the new Road Safety (Vehicles) Regulations 2021 and the current Duties Act 2000 references.

These regulations affect any person who owns, controls, or is responsible for a motor vehicle that is used or kept in Victoria and that is subject to the transport accident charge. That includes natural persons, businesses, government entities, and non-profit organisations. Because the charge is a condition of lawful use of a motor vehicle on public roads (through registration or permit), the regulations indirectly affect anyone who drives or operates a vehicle in Victoria.

The most directly affected group is owners of vehicles registered under the Road Safety Act 1986. This covers the vast majority of private and commercial vehicles. For them, the charge is collected as part of the registration system, so the compliance burden is minimal: they pay the charge at the same time and through the same channel as their registration fee. However, the regulations also create obligations for less common categories, where the payment point is less automatic.

Owners of vehicles with club permits (classic and historic vehicles) must ensure the transport accident charge is paid on or before the granting or renewal of the permit. Since club permits are often annual, the charge is effectively annual as well. Trade plate holders (general identification marks) similarly must pay on or before the issuing or renewal of the mark, which is also typically annual.

Holders of unregistered vehicle permits (used to move an unregistered vehicle for a specific purpose) must pay on or before granting of the permit. Since the permit itself is of short duration, the charge is tied to that short period, which may create a higher per-day cost if the charge is not pro-rated for the permit duration , the prescribed period is the period of validity of the permit, so the charge covers exactly that period.

Visiting overseas motor vehicle owners face a compliance point on or before arrival in Victoria. This creates a practical difficulty: the owner may not be aware of the requirement before entering Victoria, and the payment must be made even though the vehicle is not registered in Victoria. The category is narrow (exempt from registration as visiting overseas vehicles and not insured under another state/territory’s compulsory scheme). This is a potential trap for international visitors.

The residual category of unregistered vehicles (item 8 of each table) affects a heterogeneous group: owners of vehicles that are neither registered nor covered by any permit or exemption. This could include farm vehicles used only on private land, vehicles in storage, or vehicles awaiting registration. For these owners, the charge is payable on the date of application and on each anniversary. This imposes an affirmative obligation to apply for the charge and make payments annually, rather than having the charge collected with registration. The compliance burden is higher because it is not linked to an existing administrative process, and the owner must remember the anniversary date.

Those involved in vehicle sales or disposal are affected by the refund provision. When a vehicle is sold and its registration cancelled, or when an unregistered vehicle is disposed of, the owner may be entitled to a refund of the unused portion of the charge. The buyer does not get the refund; the original owner does. The refund formula requires calculation based on days remaining, which may be a minor administrative burden for individuals but a significant one for fleet operators.

Finally, the regulations affect the Transport Accident Commission itself and the body responsible for registration (VicRoads). They must administer the payment collection and refunds in accordance with the prescribed times and periods.

The primary duty imposed by these regulations is the obligation to pay the transport accident charge at the prescribed time or interval for the appropriate class of vehicle. This is not a self-standing duty; it flows from section 109 of the Transport Accident Act 1986, which requires the charge to be paid within the prescribed period. The regulations fill in the details. The duty is strict in the sense that the regulation provides no discretion for late payment or alternative payment arrangements , the time is fixed (e.g. “on or before registration or renewal”). Failure to pay means the vehicle is not covered by TAC insurance, and the owner may face penalties under the parent Act or may be unable to register the vehicle.

A related duty is the obligation to apply for the charge for vehicles in the residual unregistered category. The regulation says payment is due “on the date the application for the transport accident charge is made and on each anniversary of that date”. This implies that the owner must first apply to pay the charge , presumably through a process set by the TAC or VicRoads , and then continue payments annually. There is no automatic collection mechanism for this class.

Another duty is not to claim a refund that does not comply with the formula. Regulation 7 is the sole refund mechanism. The duty is on the person seeking the refund to provide accurate information about the cancellation or disposal, and to calculate the refund correctly. The regulation does not specify who must calculate the refund or how it is processed; it merely states the amount payable. In practice, the refund would be processed by the collecting authority, but the regulation imposes a duty on the authority to pay the correct amount, and a corresponding right of the owner to receive it.

The rights conferred by the regulations are limited but important. Owners have a right to a refund when registration is cancelled or when an unregistered vehicle is disposed of or destroyed, provided the charge is no longer required. The refund is calculated on a pro-rata daily basis, including duty paid. This is a right to recover money paid for a period that will not be used. The right is not contingent on any fault or action by the authority; it arises automatically upon the triggering event. However, the regulation does not specify a time limit for claiming the refund, nor does it provide for interest on delayed refunds. It also does not address partial refunds for changes in vehicle classification or reduction in charge rates.

Owners of vehicles in certain classes also have the right to pay the charge over the prescribed period rather than in a lump sum? No , the regulations require payment on or before the event. For item 8 (residual unregistered), the charge is due on application and on each anniversary, which effectively creates a series of lump sum payments. There is no instalment option.

The regulations also confer a right to have the charge period align with the registration period for most vehicles. This minimises administrative duplication. But for trade plate holders and club permit holders, the period is a fixed 12 months regardless of when the mark or permit is issued. This could lead to a mismatch: if a club permit is issued for only six months, the prescribed period is still 12 months (item 5 of regulation 5), so the owner would pay for a full year’s charge even though the vehicle may only be used for six months. There is no pro-rating for the charge payment itself (only for refunds upon cancellation). This is a potential unfairness but is not addressed in the regulations.

These regulations do not themselves create penalties. The penalty provisions for non-payment of the transport accident charge are found in the Transport Accident Act 1986, not in these subordinate regulations. The regulations merely set the periods and times; if a payment is not made at the prescribed time, it is a breach of the Act, not a breach of the regulations directly. Section 109 of the Transport Accident Act would be the relevant section, and any penalty for contravening that section would be imposed under the Act. The regulations do cross-reference the Act’s section 109 as the source of the obligation to pay within the prescribed period.

Enforcement of the payment obligation is likely integrated with the vehicle registration system. For registered vehicles, failure to pay the transport accident charge at registration or renewal means the vehicle cannot be registered. For vehicles with permits, the permit will not be granted or renewed if the charge is unpaid. For the residual unregistered category, there is no registration to block, so enforcement may rely on separate monitoring and prosecution under the Transport Accident Act. The regulations do not specify enforcement mechanisms, so one must look to the parent Act.

The refund provision in regulation 7 is enforceable by the owner as a right. If the collecting authority fails to pay the refund as calculated, the owner could seek judicial review or a civil remedy. The regulation states the amount “shall be paid” to the owner, using mandatory language. However, it does not provide a deadline for payment or a mechanism to compel payment. Owners may need to rely on administrative law remedies or debt recovery proceedings if the refund is not paid promptly.

There are no specific penalties for overstating a refund claim or for misrepresenting the class of vehicle to obtain a lower charge. Fraud provisions in the Crimes Act or general law would apply. The regulations do not impose any evidentiary or record-keeping requirements, but in practice, the claimant would need to prove the cancellation or disposal date.

The regulations also do not provide for late payment fees or interest. If a payment is late, the parent Act may impose a penalty or the registration may lapse. The regulations are silent on grace periods; the prescribed times are strict (e.g., “on or before registration or renewal”).

It is also notable that the regulations do not create any review or appeal rights. There is no provision for asking the Transport Accident Commission to extend a prescribed period or to vary a prescribed time. This is a mechanical instrument that leaves no room for administrative discretion. If a vehicle owner misses a payment deadline due to circumstances beyond their control, the regulations offer no relief; they would need to rely on any general provisions in the Act or seek an ex gratia payment.

These regulations are made under the Transport Accident Act 1986 and operate within that Act’s framework. Their primary interaction is with section 109 of that Act, which imposes the obligation to pay the transport accident charge within the prescribed period and at the prescribed times. The regulations fill in the gaps left by the Act. They do not change the rate of the charge, the liability for it, or the coverage provisions. They are purely procedural.

A key interaction is with the Road Safety Act 1986 and the Road Safety (Vehicles) Regulations 2021. Many of the prescribed periods and times are defined by reference to events under those instruments: “motor vehicles registered under Part 2 of the Road Safety Act 1986”; “regulation 58 of the Road Safety (Vehicles) Regulations 2021” (short-term registration); “recreation vehicles registered under the Road Safety Act 1986”; “regulation 155” (general identification marks); “regulation 177” (club permits); “Division 2 of Part 3” (unregistered vehicle permits); and “visiting overseas motor vehicles” as defined under those regulations. The transport accident charge regulations thus piggyback on the road safety framework. If the Road Safety (Vehicles) Regulations change, the cross-references would need updating. The 2021 regulations updated cross-references from the previous 2009 and 2017 versions of the road safety regulations.

The refund provision interacts with the Duties Act 2000. The formula includes “duty payable under the Duties Act 2000 in respect of the prescribed period” as part of amount A. This means that when a refund is paid, it includes the proportion of duty that was paid on the charge. The refund of duty would then be a matter between the taxpayer and the State Revenue Office under the Duties Act, but the transport accident charge regulations effectively treat the duty as part of the charge for refund purposes, simplifying the process for the vehicle owner.

The regulations also interact with interstate compulsory insurance schemes indirectly. For visiting overseas motor vehicles (item 7), the charge obligation only arises if the vehicle’s owners and drivers are not insured under a contract of insurance in accordance with the law of another state or territory. This means the regulations defer to interstate insurance: if the vehicle is already covered under another Australian state’s compulsory third party scheme, the Victorian transport accident charge is not payable. This avoids double coverage and reflects the national arrangements for CTP insurance.

The Subordinate Legislation Act 1994 governs the lifecycle of the regulations. The endnote states they will sunset 10 years after the day of making (18 May 2031) under section 5 of that Act. This sunset triggers a need for review and remake. The regulations are also subject to the Interpretation of Legislation Act 1984 for style changes, headings, examples, and punctuation, as noted in the endnotes.

The interaction with the general law of contract and property is minimal. The refund provision creates a statutory right to payment that is not based on contract; it is a right in rem attached to the vehicle. It does not affect the transfer of ownership or the sale of goods; it is a separate claim the seller can make after sale if registration is cancelled.

There is no explicit interaction with tax laws (other than the Duties Act) or with consumer protection laws. The regulations are essentially subordinate procedural rules.

The Transport Accident (Administration of Charges) Regulations 2021 (S.R. No. 46/2021) were made on 18 May 2021 and came into operation on 23 May 2021. The version currently in force (Version No. 002) incorporates amendments made by the Transport Accident (Administration of Charges) Amendment Regulations 2021 (S.R. No. 166/2021). That amending instrument was made on 14 December 2021 and commenced on the same date. Both regulations were made by the Governor in Council.

The amendment regulations amended regulations 5 and 6 of the principal regulations. Specifically, the table in regulation 5 (prescribed periods) and the table in regulation 6 (prescribed times and intervals) were amended. The nature of the amendments is not specified in the source text, but the amending instrument is identified as S.R. No. 166/2021. The version we have shows the amended regulation text. The original regulation 5 (as made in May 2021) may have had slightly different wording or classes, but the version before us is the consolidated post-amendment version.

The endnotes indicate that the version does not contain any amendments not yet in operation. So all amendments up to 14 December 2021 are incorporated. There are no further amendments listed as pending.

The principal regulations revoked the former Transport Accident (Administration of Charges) Regulations 2011 (S.R. No. 29/2011 as amended by S.R. No. 120/2017). That revocation means the 2011 regulations ceased to have effect from 23 May 2021. The 2021 regulations are a remake, not a minor update. This is typical under Victoria’s sunsetting regime: subordinate legislation must be remade every 10 years. The 2021 regulations will themselves sunset on 18 May 2031 unless remade.

The amendment in December 2021 is relatively minor , it adjusted the prescribed periods and times for some vehicle classes. It is plausible that the amendment was needed to fix a typographical error or to clarify the application to a particular class (e.g., recreation vehicles or short-term registration vehicles). Without the amending instrument’s explanatory memorandum (not provided), the precise reason is unknown.

Amendments to subordinate legislation in Victoria are published as separate statutory rules. The principal regulations and the amendment regulations are both available on the Victorian legislation website. The version numbering (Version 002) indicates two versions have been published: the original and the amended version.

The source text does not contain any reference to litigation. There are no case citations, no court decisions mentioned, and no indication that the regulations have been challenged or interpreted by a court. This is not surprising given that the regulations are procedural and have been in force only since May 2021 (as at the time of the version). The limited scope of the regulations , prescribing periods and times , is unlikely to generate significant litigation on its own. Any dispute about the interpretation of a prescribed period or the refund formula would more likely be a dispute under the Transport Accident Act 1986 itself, with the regulations being a secondary reference.

It is possible that the predecessor 2011 regulations were the subject of litigation, but the source does not mention any. If there were relevant cases, they would likely involve challenges to the collection of the charge or the validity of the regulations. Since the 2021 regulations are essentially a procedural remake, any case law interpreting the former regulations would still be relevant, but it is not provided.

The absence of litigation history in the source is not unusual for a subordinate instrument of this kind. The regulations are administrative and not rights-creating; they are more likely to be tested indirectly in proceedings about liability for unpaid charges or entitlement to refunds. For example, a court might need to determine whether a particular vehicle falls within a specific class for the purpose of the prescribed period. That would be a question of fact and statutory interpretation. However, without case citations, we can only note that the instrument is not the subject of known litigation.

Analysts requiring litigation history should search for Victorian judgments citing the Transport Accident (Administration of Charges) Regulations 2021 or its predecessor, and any cases under section 109 of the Transport Accident Act 1986.

Several aspects of these regulations could create unexpected compliance burdens or legal risks. The most significant is the residual category (item 8 in both tables). Any motor vehicle that is not registered under the Road Safety Act and is not otherwise referred to in the tables falls into this category. The prescribed period is 12 months, and the prescribed interval is “on the date the application for the transport accident charge is made and on each anniversary of that date”. This creates an ongoing annual payment obligation for owners of unregistered vehicles used only on private land, vehicles under restoration, or vehicles stored long-term. Many owners likely assume that if a vehicle is not used on public roads, no TAC charge is payable. The regulations suggest otherwise. The owner must affirmatively apply for the charge and keep paying annually until the vehicle is registered, disposed of, or destroyed. Failure to do so could result in the vehicle not having TAC coverage, and the owner may be liable for accidents occurring on private land (though the application of the TAC scheme to private land is a separate question under the parent Act). The obligation applies even if the vehicle is not driven.

Another trap is the refund formula. It requires calculating the number of days remaining in the prescribed period. For most vehicles, the prescribed period is the registration period, which may be 12 months or a shorter period. For vehicles with 12-month prescribed periods (items 4, 5, 8), the calculation is straightforward. However, for vehicles with a prescribed period tied to registration, if the registration is cancelled partway through, the refund is based on the number of days remaining in that specific registration period. If the registration was paid for 12 months but cancelled after 3 months, the refund covers 9 months. But if the vehicle had a registration of less than 12 months (item 2), the prescribed period is that shorter registration period, so the refund is calculated over that shorter period. This could result in a smaller refund than expected if the owner paid for a short-term registration.

The refund formula includes “duty payable under the Duties Act 2000”. If the duty is later varied or refunded separately, there could be a mismatch. The regulation does not say what happens if the duty is not actually paid; it assumes it is part of the amount paid. Also, the regulation does not address partial refunds for changes in vehicle use , for example, if a registered vehicle changes to a club permit or trade plates mid-registration. There is no provision to transfer the charge or to receive a refund for the unused period of the original registration. The owner may have to cancel the registration and re-register under a different class to get a refund, which is administratively burdensome.

For visiting overseas motor vehicles, the obligation to pay on or before arrival in Victoria is a trap for those not aware of the requirement. The condition that the vehicle’s owners and drivers are not insured under another state or territory’s law means that if they have interstate CTP insurance, they are exempt from the Victorian charge. But if they arrive without any insurance, they must pay at the border. There is no grace period. Non-compliance could result in the vehicle being uninsured in Victoria, with significant liability risks.

The regulations also do not provide for any notification of the anniversary date for residual unregistered vehicles. The owner must remember the date of application. There is no reminder system. Missing the anniversary means the charge is unpaid and the vehicle is not covered by the TAC scheme. The regulation does not say what happens if the anniversary is missed; the parent Act would govern.

Finally, the definition of “motor vehicles that are not registered under the Road Safety Act 1986 and are not otherwise referred to in this table” is very broad. It could include trailers (if they are motor vehicles under the Act), motorcycles, and any other vehicle that for some reason is not registered. The regulations do not cross-reference the definition of “motor vehicle” from the Transport Accident Act. It is essential to check that definition.

Compliance begins with correctly classifying the motor vehicle into one of the eight categories in the tables. For most vehicles, this is straightforward: if the vehicle is registered under the Road Safety Act 1986, it falls under item 1, 2, or 3 depending on the type of registration (standard, short-term, or recreation). The transport accident charge is then paid at the time of registration or renewal, and the prescribed period matches the registration period. No separate action is needed beyond ensuring the charge is included in the registration payment.

Owners of vehicles with club permits or general identification marks (trade plates) must pay the charge on or before the granting or renewal of the permit or mark. The prescribed period is 12 months, so the charge covers a full year. Compliance means ensuring payment is made at the same time as the permit or mark application. If the permit or mark is granted for a period shorter than 12 months, the charge still covers 12 months, so the payment is fixed regardless of the actual use period. Owners should budget accordingly.

Holders of unregistered vehicle permits must pay on or before the granting of the permit. The prescribed period matches the permit period. This is a single payment; no ongoing anniversary obligation.

Visiting overseas motor vehicle owners must assess whether they are covered by another Australian state or territory’s compulsory insurance. If not, they must pay the transport accident charge before arrival in Victoria. This may require contacting VicRoads or the TAC in advance. Proof of payment may be needed at the border.

The residual category of unregistered vehicles not otherwise covered is the most complex. The owner must apply to pay the charge, and pay on the date of application and on each anniversary. Compliance requires setting a reminder for the anniversary date. If the vehicle is subsequently registered, the classification changes, and the owner should seek a refund for the unused portion of the 12-month prescribed period under regulation 7. If the vehicle is disposed of or destroyed, the owner is entitled to a refund of the remaining days. It is essential to keep records of the application date and payment to calculate the anniversary correctly.

When a vehicle is sold and its registration is cancelled, the seller should apply for a refund under regulation 7. The refund is calculated as A × (B ÷ C). The owner must know the amount paid (including duty), the number of days in the prescribed period, and the number of days remaining from cancellation. It is prudent to obtain a cancellation receipt showing the date. For unregistered vehicles disposed of or destroyed, the same formula applies but using the ownership date as the start and the disposal/destruction date as the end. Proof of disposal or destruction (e.g. receipt from scrap dealer, statutory declaration) would be needed.

Records of payment are essential. The regulations do not specify a form for applications or refund claims, so owners should follow the procedures set by VicRoads or the TAC. In practice, the refund may be processed through the registration system. Owners should check that the refund amount is calculated correctly and includes the duty component.

For businesses managing fleets, compliance can be integrated into existing registration and permit management systems. The key risk is the residual unregistered category, which may trap vehicles that are temporarily unregistered. Fleet managers should ensure that any vehicle not registered for a period is either classified correctly or disposed of promptly.

Finally, stay alert to future amendments. The regulations were amended in December 2021. Any further changes to the Road Safety (Vehicles) Regulations or the Duties Act could affect the prescribed periods and refund formula. Since the regulations sunset in 2031, a remake will be required, and stakeholders should engage with any consultation processes to ensure the new instrument addresses gaps (such as the lack of pro-rating for permit holders or notification for anniversary payments).
