159 Notice of certain accidents affecting uninsured motor cars (1) On the happening of any accident affecting an uninsured motor car and resulting in the death of or bodily injury to any person it is the duty of— (a) the driver of the uninsured motor car as soon as practicable after the accident; or (b) (if the owner of the motor car was not the driver) the owner as soon as practicable after he or she first becomes aware of the accident— to notify in writing the Commission of the fact of the accident with particulars as to the date nature and circumstances of it. (2) The owner or driver of any motor car who fails to notify the Commission is liable to a penalty of not more than 4 penalty units. (3) It is a good defence in any proceedings under this section against the driver if the driver establishes to the satisfaction of the court that he or she did not know that the motor car was an uninsured motor car.
