Transfer of Prisoners Regulations

The Regulations revolve around a small set of recurring legal and administrative concepts, expressed in statutory references and prescribed forms. Those concepts are:

• Prisoner-initiated welfare transfer: The mechanism under which a prisoner may apply to be moved to another State or Territory “in the interests of the welfare of the prisoner” (the Act’s test referenced in regulation 3(1)). Regulation 3 prescribes Form 1, the routing of the application through the Superintendent, and required attachments (regulation 3(3)(a)-(d)). Regulation 4 lists the welfare-related matters a prisoner must address (family support, accommodation, social circumstances, medical reasons, employment prospects, and “any other matters”).
• Documentary bundle and departmental reports: Several provisions require the Superintendent and Department to compile and forward detailed material to inform decision-making. Regulation 3(3)(a) requires a statement of convictions and sentences including probation/non-parole periods and estimated release date by remission. Regulation 3(3)(b) requires a comprehensive report on conduct and behaviour. Regulation 3(3)(c) requires a parole officer’s report and an opinion on whether transfer would be in the prisoner’s welfare interests. Regulation 5 allows (or requires, if the Attorney-General asks) the Department to supply medical, psychiatric or psychological reports and mandates that any furnished report include “any further information available” likely to assist the Attorney-General (regulation 5(2)).
• Intergovernmental consent and notification: When the Attorney-General decides transfer is appropriate on welfare grounds, the Attorney-General must seek written consent from the appropriate Minister of the receiving State and must accompany that request with the prisoner’s application, reports and a statement of the Attorney-General’s reasons (regulation 6). For welfare transfer orders to a State, Form 2 requires that the State Minister’s written consent be appended (Form 2(c)).
• Court-based trial transfers and review: Part III prescribes how a State Minister’s request for consent is handled, the prisoner’s right to be informed and to comment within 14 days (regulation 9(1)-(2)), and what material the Department may or must provide to the Attorney-General (regulation 9(3)). Prisoner-initiated requests to be transferred to face outstanding charges are made on Form 4 (regulation 10) and must be supported by a Departmental report containing convictions, sentences, minimum terms, periods served, remissions, parole grants and conduct records (regulation 10(2)). Applications to courts for trial transfer orders are made on Form 5 (regulation 11); courts issue orders in Forms 7 and 8 depending on jurisdiction (Magistrate’s court or Supreme Court) and may be the forum for revocation or review (Form 9).
• Return, revocation and exemption: Part IV prescribes notice to prisoners prior to return transfers (Form 10), the form of return transfer orders (Form 11), revocation of return transfer orders (Form 12), orders to return a prisoner for appeal purposes (Form 13), and a prisoner’s written request to serve imprisonment without return (regulation 19). Regulation 20 contemplates the Attorney-General declaring a prisoner an “exempt prisoner” under s 14(2) of the Act and issuing a corresponding order of imprisonment (Form 14).
• Financial allocation and exceptions: Regulation 21 is categorical in placing the cost burden on the Commonwealth except for transfers pursuant to an order under section 9 of the Act, subject to any arrangement under s 17(7) of the Act.

Taken together, these concepts show the Regulations’ function: to standardise information flows and the sequence of administrative steps, allocate responsibility for preparation of evidence and reports, enable prisoner participation at defined points, and provide the fixed wording that operational staff use to execute transfers and returns.

The Regulations directly allocate tasks and consequences across four principal groups and several ancillary actors.

• Prisoners: The Regulations affect prisoners in multiple ways. Prisoners initiate welfare transfer applications on Form 1 (regulation 3(1) and Form 1) and must answer specific welfare-related questions (regulation 4). A prisoner who is the subject of a proposed trial transfer can be informed of the substance of the State Minister’s request and has 14 days to comment (regulation 9(1)-(2)). Prisoners may also request transfers to face outstanding charges (regulation 10 and Form 4) and request to serve imprisonment where return would otherwise be ordered (regulation 19). The forms advise prisoners that, upon transfer, their sentence “shall be deemed to have been imposed upon me” in the receiving State/Territory and that they will be subject to that jurisdiction’s rules and possible reclassification (Form 1, paragraphs (a)-(c)). That creates a legal and practical effect on classification, parole prospects and applicable prison regime.
• Superintendent and prison officers: Superintendents (or other officers in charge) are charged with receiving prisoner applications, preparing and attaching the prescribed statements and reports (regulation 3(2) and 3(3)(a)-(b)), forwarding copies to a parole officer (regulation 3(3)(c)) and the Department (regulation 3(3)(d)). Superintendents are addressees of transfer, revocation and return orders (Forms 2, 3, 6, 7, 8, 11, 12, 13, 14) and are commanded by those forms to deliver or retain custody as appropriate; every operative form contains a command that the order shall be “your sufficient authority.”
• Parole officers and departmental staff: Parole officers are required to prepare a detailed report and express an opinion on welfare transfer suitability (regulation 3(3)(c)(i)-(ii)). The Department compiles and forwards detailed reports, including medical, psychiatric and psychological material when appropriate (regulation 5), and sends to the Attorney-General the bundle required when a prisoner requests transfer for trial (regulation 10(2)). The Department is the central aggregator and transmitter of records for ministerial and judicial decision-making.
• Attorney-General and Departmental decision-makers: The Attorney-General is the primary Commonwealth decision-maker with power to seek State consent for welfare transfers (regulation 6), to issue welfare transfer orders (Form 2) and to issue return transfer orders (Form 11) and exempt-prisoner orders (Form 14). Regulation 5 confers discretion to request or accept certain reports; regulation 6 imposes documentary requirements when the Attorney-General requests State consent.
• Appropriate Ministers of States and Territories: Transfers to a State require the written consent of the appropriate State Minister where the transfer is to a State (Form 2(c), regulation 6(c)-(e)). The Regulations formalise an intergovernmental gate: a Commonwealth request must be accompanied by the prisoner’s application and the reports, and the Attorney-General’s statement of reasons (regulation 6).
• Courts, Magistrates and Judges: Part III contemplates courts issuing trial transfer orders (Forms 7 and 8), courts issuing orders to bring prisoners before them for transfer hearings (Form 6), courts revoking transfer orders (Form 9) and courts ordering return for appeal (Form 13). The Regulations therefore affect judicial caseload and require courts to use specified forms and to record particular findings (for instance, that the prisoner is subject to an arrest warrant).
• Escorts and police: Many forms are addressed to “the escort(s) for the purposes of executing this order” and to “members of the police force” as appropriate (Forms 2, 6, 7, 8, 11, 13). Escorting agencies are directed to take custody and convey prisoners; the forms are the operative authority for physical removal and transit.

Collateral affected parties include families and potential employers, whose circumstances are required information under regulation 4 and Form 1, and State agencies that will receive the prisoner and apply State transfer law or rules. The Regulations therefore generate administrative burdens on prisons, parole services, the Department and courts, and create data flows to State Ministers that may affect classification, release conditions and reintegration planning.

The Regulations allocate a set of duties, a small number of time-limited rights for prisoners, and ministerial and judicial procedural obligations. The text is prescriptive in form content and routing; it is also discretionary as to some information-gathering obligations.

Primary duties

• Prisoner duty to apply using Form 1 for welfare transfers: Regulation 3(1) requires a prisoner’s application to be “in or to the effect of Form 1,” signed by the prisoner and forwarded through the Superintendent (regulation 3(2)). The application must include statements addressing the matters listed in regulation 4 (family support, accommodation, social circumstances, medical reasons, employment prospects and other supporting matters).
• Superintendent duty to compile attachments and forward: Regulation 3(3) imposes specific steps on a Superintendent who receives a prisoner’s application. Those include preparing and attaching (a) a statement of convictions and sentences with probation/non-parole and an estimated release date by remission (regulation 3(3)(a)), (b) a comprehensive conduct report (regulation 3(3)(b)), (c) forwarding a copy to a parole officer for a detailed report and welfare opinion (regulation 3(3)(c)(i)-(ii)), and (d) forwarding the application to the Department (regulation 3(3)(d)).
• Parole officer duty to report and opine: Under regulation 3(3)(c), the parole officer must produce a detailed report on the application and give an opinion on whether transfer would be in the prisoner’s welfare interests. That report is part of the decision record forwarded to the Attorney-General.
• Departmental duty to supply reports when requested: Regulation 5(1) allows, or if requested by the Attorney-General requires, the Department to supply medical, psychiatric and psychological reports and assessments, as available. Regulation 5(2) requires that any furnished report include “any further information available” likely to assist the Attorney-General.
• Attorney-General duty when requesting State consent: Regulation 6 requires that where the Attorney-General is of the opinion a welfare transfer is appropriate and makes a written request to the appropriate State Minister, that request be accompanied by the prisoner’s application, the reports and assessments referred to in regulations 3 and 5, and a statement setting out the matters upon which the Attorney-General’s opinion is based (regulation 6(c)-(e)). This creates an evidentiary duty and a transparency duty toward the State Minister.
• Court duties when ordering transfers: Applications to courts for trial transfer orders must be in or to the effect of Form 5 (regulation 11). Orders to produce the prisoner to a court must be Form 6 (regulation 12). Trial transfer orders and revocations must follow Forms 7-9 (regulations 13-14). Courts and judges therefore must issue their orders using the prescribed wording and record the findings required by those forms.

Prisoner rights (procedural)

• Right to be informed and to comment: Regulation 9(1) permits the Attorney-General, upon receiving a State Minister’s request for consent under s 9(2) of the Act, to inform the prisoner of the substance of the request and to seek the prisoner’s comments in writing. The prisoner has 14 days to respond (regulation 9(2)).
• Right to request transfer for trial: Regulation 10(1) prescribes Form 4 for prisoner-initiated requests under sub-section 8(1) or 9(1) of the Act, establishing a formal channel for prisoners to seek transfer to face outstanding charges.
• Right to apply to be declared an exempt prisoner or to make representations upon notice of return: Form 10 (regulation 15) warns prisoners that they may, by a date specified in the notice, apply to the Attorney-General setting out welfare matters in support of an order declaring them exempt (s 14(2) of the Act and Form 10 paragraphs (d)-(e)). Regulation 19 creates a process for a prisoner to request to serve imprisonment where return would otherwise be ordered, with particulars and routing comparable to welfare applications (regulation 19(1)-(4)).

Discretion and mandatory steps

• The text shows a mixture of mandated form and discretionary information-gathering. For example, regulation 5(1) states the Department may, or shall if requested by the Attorney-General, supply medical etc. reports. Regulation 3 prescribes mandatory attachments; regulation 6 mandates accompanying materials when the Attorney-General seeks State consent. The Attorney-General’s substantive determinations , whether transfer is “in the interests of the welfare of the prisoner” or whether to declare a prisoner an exempt prisoner , are framed as opinions or exercises of discretion under the Act and the Regulations provide the record and steps for those exercises.

Operational effects

• The forms and textual commands function as operational authority: each transfer, return and revocation form contains explicit language commanding Superintendents and escorts to deliver or retain custody and stating that the order is “your sufficient authority.” That language makes the forms the enabling document for custodial movement and retention.

In short, duties in the Regulations are mainly documentary and routing duties for prison officials, parole officers and Departmental staff; the substantive discretionary decisions are reserved to the Attorney-General and courts, but those actors rely on the documentary files the Regulations require.

The Regulations are procedural and do not create criminal offences or civil penalties within their text. They set out the administrative instruments and commands that legal actors must use to effect transfers and returns but they do not prescribe sanctioning provisions for breach within the instrument itself.

Enforcement mechanisms and effects provided in the Regulations

• Operative commands authorising custody and movement: Each operative order form (Forms 2, 3, 6, 7, 8, 11, 12, 13, 14) contains explicit commands directed to Superintendents and escorts, concluding with language such as “for your so doing, this order shall be your sufficient authority.” That wording functions as the legal basis for a Superintendent or escort to deliver or to retain custody; in practice it is the authorising instrument for enforcement by correctional officers and police during transfer.
• Judicial oversight and remedies implicit in the forms: Part III contemplates court involvement in issuing trial transfer orders (Forms 7 and 8), in ordering production to court for hearings (Form 6), and in revoking orders (Form 9). Those processes place an adjudicative check on transfer decisions where transfers involve prosecution or trial. The Regulations therefore channel some enforcement questions into existing court processes rather than into administrative penalty regimes within the Regulations.
• No express penalties in the Regulations: There are no provisions imposing fines, imprisonment, administrative penalties or civil liability tied to failure to comply with a Regulation’s prescription. The absence of explicit penalty provisions in the Regulations means that enforcement of compliance with documentary duties will typically be operational (orders will not be accepted by receiving States without proper documentation) or reached through administrative review channels available under the Act or general public law remedies rather than by penalties created in these Regulations.

Practical enforcement implications and risk points

• Compliance risk for prison staff and parole officers: Because the forms are required to be in a specific format and because many orders require an attached documentary bundle (for example regulation 6 requires the Attorney-General’s request to be accompanied by the prisoner’s application and reports), failure to prepare or forward the prescribed material will obstruct transfer approvals and may be treated as non-compliance operationally. Enforcement in such cases is practical: a receiving State may decline to accept a transfer if the required documentation or Ministerial consent is absent.
• Financial enforcement implication: Regulation 21 allocates cost responsibility for transfers and return transfers to the Commonwealth except for transfers in pursuance of an order under section 9 of the Act. That financial allocation creates a budgetary enforcement rule: agencies must charge or account transfers differently depending on the statutory basis, and financial compliance may be monitored internally.
• Judicial enforcement avenues remain: Where a party seeks to challenge the lawfulness of a transfer, revocation or the administrative process underpinning the Attorney-General’s decisions, the Regulations provide procedural stages (court applications, revocation applications, production orders) that would be used in any litigation. The Regulations themselves do not prescribe the litigation remedies; they create the procedural record and the formal orders that courts will rely upon.

In sum, the Regulations regulate process and produce authorising documentation for custodial movements and retention. They do not create new penalty provisions; enforcement operates through command language to operational actors, judicial processes for transfers tied to trial, and practical intergovernmental consent mechanics that make documentation and ministerial assent conditions of transfer.

The Regulations are expressly made under, and repeatedly reference, the Transfer of Prisoners Act 1983 (the Act) and they were made with the advice of the Executive under the Acts Interpretation Act 1901 (prefatory note). The Regulations therefore function as subordinate instruments that implement and operationalise provisions of the Act. The text repeatedly cross-refers to statutory sections of the Act and to State transfer law to be “declared under section 5 of the abovementioned Act” (Forms and regulation 7).

Direct interplay with the Act

• Statutory hooks: Numerous provisions in the Regulations are tied to particular subsections of the Act. Examples include regulation 3(1) which locates prisoner applications under sub-section 6(1) of the Act; regulation 7 which prescribes the form for a welfare transfer order under section 6 of the Act; regulation 8 which prescribes the revocation form under section 7 of the Act; Parts III and IV similarly reference sections 8-16 of the Act for trial transfers and returns. The Regulations do not rewrite statutory standards (for example the “interests of the welfare of the prisoner” test remains a statutory test) but require the documentary record the Act presumes.
• Operationalising intergovernmental consent: The Regulations require the Attorney-General to accompany a request to an appropriate State Minister with the prisoner’s application and the reports relied upon (regulation 6(c)-(e)). That procedure operationalises the Act’s intergovernmental consent architecture and creates a standard information set a State Minister will expect.

Interaction with State transfer law

• Receiving State’s law and classification: Form 2 (Welfare Transfer Order) expressly states that where a prisoner is transferred to a State, the prisoner “shall be transferred … to serve the balance of the sentence(s) of imprisonment in accordance with the State transfer law of that State as declared under section 5 of the abovementioned Act.” The Regulations thereby recognise that the receiving State’s transfer and prison law will apply to the transferred prisoner. Form 1 further warns the prisoner they “will be subject to the provisions of any rules, regulations, &c., applying to prisoners in that State [or Territory]” and may be reclassified (Form 1 paragraphs (b)-(c)). The Regulations therefore effect an interaction: Commonwealth administrative action triggers application of State rules on classification, parole and prison regime.
• State Minister consent and reciprocal administrative requirements: For transfers to occur, consent by the appropriate State Minister is required where the transfer is to a State (Form 2(c)). The Regulations ensure that State Ministers receive the same documented materials the Attorney-General used to form his opinion (regulation 6), aligning Commonwealth procedure with the receiving State’s need for information to accept custody.

Interplay with court powers and jurisdictional processes

• Courts as decision venues for trial transfers and reviews: Part III sets out that applications under sections 8 or 9 of the Act to a court must follow Form 5 (regulation 11), and courts issue transfer orders in Forms 7 and 8. The Supreme Court may quash a lower court’s decision and issue an order (Form 8). The Regulations coordinate Commonwealth administrative steps with State judicial processes, recognising courts as the venue where evidentiary findings about warrants and procedural propriety are made.
• Production and appeals: The Regulations provide for production orders for trial or appeal purposes (Forms 6 and 13) under sections 10 and 16 of the Act. That creates a legal route to move prisoners between jurisdictions for court business while tracking the custody chain.

Limits on external interaction

• The Regulations do not purport to displace State law; instead they create a transfer protocol that integrates Commonwealth decision-making and the receiving State’s consent and legal regime. They do not create exceptions to State criminal law, parole regimes or sentencing; rather, they state that transferred sentences shall be “deemed” imposed in the receiving State (Form 1), thereby signalling that State treatment governs many day-to-day consequences.
• Financial interplay under regulation 21 establishes an exception for transfers made pursuant to section 9 of the Act; the Regulations therefore interact with the Act’s allocation of expenses and with any intergovernmental arrangements contemplated by s 17(7) of the Act.

In short, the Regulations are a subordinate instrument that interfaces with the Act, the receiving State’s transfer and corrections laws, and State courts. They standardise the paperwork and information flows that bridge Commonwealth administrative choices and State custody and judicial processes.

The instrument contains specific dates and the original notification but does not list subsequent amendments. From the text itself the following points about the Regulations’ origin and amendment status are available:

• Making and commencement: The prefatory material records that the Regulations were made by the Governor-General on 26 July 1984, signed by the Attorney-General, and were notified in the Commonwealth of Australia Gazette on 2 August 1984 (note at end of Schedule and prefatory paragraphs). The instrument is identified as Statutory Rules 1984 No. 180, with cataloguing and pricing information included in the table of provisions.
• No amendment schedule included: The printed text presented here does not include any amending instrument, consolidated history or notation of subsequent amendments. The Schedule contains the forms and the text of the Regulations as made in 1984 but does not record later changes.
• References to the Act: The Regulations repeatedly refer to parts and subsections of the Transfer of Prisoners Act 1983. Any amendment to the Act that changes a referenced subsection could affect the operational validity of the Regulations; the Regulations themselves contain no provisions setting transitional arrangements for later amendments to the Act. The Regulations therefore rely on the statutory structure of the Act as it stood when the instrument was made.
• Administrative practice and updating: Because the Regulations rely heavily on fixed forms and on cross-reference to statutory subsections and State ministerial consent requirements, any change in the Act, or in the practice of State transfer law (for example a new procedure for State Ministers to accept transfers), would put a premium on updating either the Regulations or departmental practice to preserve compatibility. The text as printed offers no revision history.

If a reader needs authoritative, up-to-date amendment information, that will require consulting the current compilation of the Transfer of Prisoners Regulations in the Federal Register of Legislation or the relevant Commonwealth Gazette entries. The printed instrument as provided shows the original text and the date of notification but contains no internal record of subsequent amendment.

The Regulations themselves do not include or cite any judicial decisions. The text contains no reported cases, no footnotes to litigation, and no internal references to case law. From the content we can record procedural litigation pathways and the points at which courts are engaged, but the instrument does not record any litigation that has interpreted it.

What the Regulations make available to courts (procedural pathways):

• Court applications for trial transfer orders: Regulation 11 prescribes the form of application to a court under sections 8 or 9 of the Act (Form 5). That sets out the procedural vehicle by which the Attorney-General or a State Minister, or a prisoner (via a permitted route), brings a matter before a court to authorise transfer for trial.
• Magistrates and Supreme Court orders: Forms 7 and 8 are tailored to different judicial fora. Form 7 is a Trial Transfer Order for a Court of Summary Jurisdiction (a Magistrate) and requires the Magistrate to be satisfied that the prisoner is the subject of an arrest warrant and that the application/consent criteria are met. Form 8 is a Supreme Court order quashing a lower court decision and substituting a transfer order. That structure contemplates judicial review by higher courts and judicial fact-finding as part of the transfer regime.
• Revocation and review mechanisms: Form 9 provides the form for a court to revoke a trial transfer order where fresh evidence or a material change of circumstances is shown and an application for revocation is made by the Attorney-General, the State Minister or the prisoner. This is an explicit procedural remedy inside the transfer regime.
• Return for appeal: Form 13 is the instrument by which a court may order production of a prisoner for appeal purposes under section 16(1) of the Act.

Implications for litigation practice (based on the instrument’s procedural content)

• The Regulations supply the forms and documentary thresholds that will frame judicial proceedings on transfers. Any litigation about process, whether a transfer was properly authorised, whether required reports were obtained or disclosed, whether prisoner comment rights were respected, will be framed in practice by the presence or absence of the prescribed paperwork the Regulations require.
• The text signals that the Supreme Court may quash decisions of lower courts and issue transfer orders after review (Form 8). That indicates a potential appellate route within State courts for parties challenging lower-court decisions on transfers, but the Regulations themselves do not canvass the scope of such judicial review or judicial remedies beyond the forms and prescribed findings.

Because the instrument provides no recorded cases or external litigation history, a practitioner looking for judicial interpretation of these Regulations will need to consult case law databases and the current report of authorities; none are mentioned in the Regulations’ text.

The Regulations establish many precise documentary steps and some subtle procedural traps that practitioners and administrators should note because they affect admissibility of a transfer request, timing and authority to move prisoners.

• Mandatory attachments and the risk of incomplete files (regulation 3(3)): A prisoner’s welfare application must be forwarded with a statement of convictions/sentences including probation/non-parole period and estimated release date by remission (regulation 3(3)(a)); a comprehensive prison conduct report (regulation 3(3)(b)); and a parole officer’s report with an opinion on welfare suitability (regulation 3(3)(c)). Failure to prepare and attach all elements may delay the Attorney-General’s decision and may result in the receiving State withholding consent because the Regulations make the bundle the basis for intergovernmental requests (regulation 6). Administrative practice must ensure checklists are complete.
• Prisoner consent to disclosure differs for States and Territories (Form 1): Form 1 includes a prisoner’s consent “to any reports, assessments or other information obtained or supplied in respect of me being sent to the appropriate Minister in [State]. (Not applicable to transfer to a Territory.)” This distinction must be observed: transfers to Territories are not treated identically in the consent paragraph, which could require separate privacy and disclosure planning when trans-border health or psychiatric records are involved.
• Timing for prisoner comments (regulation 9(1)-(2)): When the Attorney-General receives a request from an appropriate State Minister, the Attorney-General may inform the prisoner of the substance of the request and seek comments in writing, which “shall be made within 14 days of receipt by the prisoner of the advice.” Failure to act within that 14-day window may forfeit the prisoner’s opportunity to influence the Attorney-General’s decision; administrative officers must ensure the prisoner receives prompt, documented notice and that the 14-day deadline is recorded.
• Departmental discretion to supply reports (regulation 5): Regulation 5(1) says the Department may, or shall if the Attorney-General requests, supply medical, psychiatric or psychological reports. This bifurcation gives the Attorney-General the practical control to trigger extensive medical production; practitioners should not assume that all such reports will be routinely sent unless requested by the Attorney-General.
• Financial allocation exception for s 9 transfers (regulation 21): Regulation 21 places transfer expenses on the Commonwealth except for transfers “in pursuance of an order under section 9 of the Act.” Section 9 is referenced in the Regulations as the provision under which certain transfers for trial are requested; the exception means a fiscal reading must be performed before committing to costs. Agencies should verify whether particular trial transfers attract State cost responsibility and what arrangements under s 17(7) exist.
• Revocation procedures and evidential thresholds (Forms 3, 9, 12): The process to revoke welfare, trial or return orders is prescribed by the relevant forms and requires an administrative or judicial application with particulars. For trial transfer revocation the court requires “short particulars of new evidence or change in matter material to making of trial transfer order” (Form 9). Parties must ensure adequate material is compiled to meet those particulars.
• Interaction with State classification and regime upon transfer (Form 1 and Form 2): Form 1 warns the prisoner that upon transfer the sentence “shall be deemed to have been imposed upon me” in the receiving jurisdiction and that the prisoner “will be subject to the provisions of any rules, regulations, &c., applying to prisoners in that State [or Territory]” and may be reclassified. Legal advisors should caution prisoners that transfer may change parole eligibility, remission prospects and security classification.
• Use of standard forms may conceal discretionary substance: The Regulations prescribe wording for orders and notices, but the Attorney-General’s underlying discretionary findings (for example the welfare assessment) are not mechanically adjudicated by the forms. Practitioners must ensure that the substantive decision record supports the form; a neatly completed form without underlying substantiation will not answer legal challenge grounded in the Act or public law.
• Multiple jurisdictions, multiple outstanding matters: Form 4 notes that if outstanding offences occur in more than one State or Territory, a separate request is needed in respect of each State or Territory. That creates potential complexity with concurrent warrants and custodial claims.
• Confusion over “appropriate Minister” and “State” vs “Territory”: Several provisions distinguish State and Territory treatment (Form 1 consent note, Form 2 references to State transfer law declared under s 5 of the Act). Administrative practice must track whether the receiving jurisdiction is a State or a Territory to apply correct procedural steps.

These are concrete operational hazards rather than novel legal doctrines; they derive directly from the Regulations’ prescribed forms, specified deadlines, required attachments and the interplay with State consent and cost allocation.

Compliance under these Regulations is largely documentary and process-driven. This section sets out practical steps for the principal actors so that transfer and return workflows meet the instrument’s requirements.

For prison administrators (Superintendents and officers in charge)

• Use Form 1 for welfare applications and ensure it is signed by the prisoner (regulation 3(1)-(2), Form 1). Record the date of receipt and the forwarding route to the Attorney-General through the Department.
• Prepare and attach the required documents immediately upon receipt of the prisoner’s application, per regulation 3(3):
  • A statement of convictions and sentences, including probation / non-parole periods and current estimated date of release by remission (regulation 3(3)(a)).
  • A comprehensive report on the prisoner’s conduct and behaviour while in prison (regulation 3(3)(b)).
  • Forward a copy to a parole officer and seek the detailed report and welfare opinion required (regulation 3(3)(c)(i)-(ii)). Record chase up actions and dates.
  • Forward the complete application and attachments to the Department for consideration by the Attorney-General (regulation 3(3)(d)).
• Where a prisoner makes a request under regulation 19 to serve imprisonment without return, handle the request like a welfare application. Ensure the prisoner signs the request and sets out grounds (regulation 19(1)), and apply regulation 3(3) and regulation 5(1) equivalents per regulation 19(2)-(3).
• Maintain secure records of all communications, including copies of Form 1, the parole officer’s report, and the Department’s transmit sheet. A missing document will delay intergovernmental consent and movement.

For parole officers

• Prepare detailed reports when requested by the Superintendent and include an express opinion on whether transfer to the nominated State or Territory would be in the prisoner’s welfare interests (regulation 3(3)(c)). Reference the factors listed at regulation 4 to structure the report: family support, accommodation availability, social circumstances, medical reasons, employment prospects and any other relevant matters.
• Provide the report to the Superintendent and, where required, to the Department. Preserve original source documents for audit.

For the Department and Attorney-General’s Office

• On receipt of a prisoner’s application and attachments, ensure the bundle is complete as required by regulation 6 when seeking State consent. Regulation 6 mandates that the Attorney-General’s request be accompanied by the prisoner’s application (regulation 6(c)), the reports/assessments referred to in regulations 3 and 5 (regulation 6(d)), and a statement setting out the matters upon which the Attorney-General’s opinion is based (regulation 6(e)). The statement of reasons should summarise the factual basis and be signed by the Attorney-General or authorised delegate.
• For medical, psychiatric or psychological reports, act under regulation 5(1): provide such reports to the Attorney-General where available, or obtain them if the Attorney-General requests. Ensure that any furnished report includes “any further information available” which may assist (regulation 5(2)). Secure necessary consents for disclosure where the prisoner has signed Form 1 for State transfers, noting the Territory exception in Form 1.
• When the Department receives a prisoner’s request to be transferred for trial (regulation 10(1) and Form 4), compile the report that the Attorney-General will rely upon in any application to court. Regulation 10(2) requires convictions, sentences, minimum terms, periods served, entitlements to remission, grants of parole and copies of conduct records.
• Track timing obligations: If the Attorney-General informs a prisoner of a State Minister’s request and seeks comments, record the prisoner’s date of receipt and note the 14-day comment period (regulation 9(2)). Ensure prisoner comments are included in the bundle to the Attorney-General.
• Consult counsel or legal advisers when preparing court applications under regulation 11 and when responding to or initiating revocation or review processes under Part III and Part IV.

For State Ministers and receiving authorities

• Expect to receive a complete documentary bundle when the Attorney-General requests consent: a prisoner’s application, the reports and assessments, and the Attorney-General’s statement of reasons (regulation 6). If any element is missing, request the missing material before consenting.
• Consider the implications of Form 2: the welfare transfer order indicates the receiving State will apply its State transfer law as declared under s 5 of the Act. Ensure that internal procedures exist to integrate incoming Commonwealth prisoners into the State’s classification and prison rules and to confirm custodian responsibilities upon receipt.

For courts

• Where an application is made under section 8 or 9, proceed using Form 5 for the application (regulation 11) and issue production and transfer orders in Forms 6-9 as required. Ensure findings required by the form (e.g., existence of an arrest warrant) are recorded on the court file as they are prerequisites to the prescribed form language.

Practical compliance checklist

1. Use the exact prescribed form (or a form “to the effect of” it) and ensure it is the completed version referenced in the Schedule (regulation 2(2)-(3)).
2. For welfare applications: confirm the presence of the prisoner’s signed Form 1, the Superintendent’s statement of convictions/sentences, the comprehensive conduct report, and the parole officer’s report and opinion (regulation 3(3)).
3. For Attorney-General requests to States: attach everything required by regulation 6(c)-(e) and a clear statement of the Attorney-General’s reasons.
4. For trial transfers: ensure the Department supplies to the Attorney-General the report mandated by regulation 10(2) before any court application is filed; use Form 5 for court applications.
5. Observe the 14-day prisoner comment period under regulation 9 and securely log service dates.
6. Check financial responsibility for transfer under regulation 21 and confirm whether the transfer is a section 9 transfer (which is excluded from Commonwealth borne expenses).
7. Retain proof of transmission to State Ministers, departmental requests for reports, and all signed consents in the prisoner file (Form 1 contains the prisoner’s data-sharing consent for State transfers).

Following these steps will align operational practice with the Regulations’ documentary obligations and reduce the risk of administrative delay or legal challenge rooted in procedural non-compliance.
