#### 32 How Australian subpoenas must be served in New Zealand (1) The subpoena must be served in New Zealand: (a) in the same way that the subpoena is required or permitted, under the procedural rules of the issuing Australian court or tribunal, to be served in the place of issue; and (b) in accordance with any directions given by the Australian court that gave leave for the subpoena to be served. (2) The subpoena must be accompanied by: (a) a copy of the order giving leave for the subpoena to be served in New Zealand; and (b) a notice in the form prescribed by the regulations or the procedural rules of the issuing Australian court or tribunal that: (i) sets out the rights and obligations of the person named in relation to the subpoena; and (ii) includes information about the way in which an application to have the subpoena set aside may be made. (3) If there is no form prescribed by the regulations or the procedural rules for the purposes of paragraph (2)(b), the subpoena must be accompanied by the corresponding form under the Federal Court Rules, with such modifications as are necessary.
