Trans-Tasman Mutual Recognition (Western Australia) Act 2007

This Act rests on several tightly circumscribed concepts that determine what it does and does not do. Those concepts are defined or used in specific ways in the text.

• Adoption (defined and used): The Act defines "adopt" with the same meaning as in section 51(xxxvii) of the Commonwealth Constitution (s 3). Practically, adoption here means that Western Australia gives effect to the Commonwealth Act within the State by statutory incorporation (s 4(1)). The Act also makes clear that the adopted Commonwealth Act is adopted "as originally enacted and as amended from time to time by regulations made under the Commonwealth Act" (s 4(1)), which creates an ongoing incorporation mechanism for later Commonwealth regulations.

• Commonwealth Act: The Act defines "Commonwealth Act" as the Trans‑Tasman Mutual Recognition Act 1997 (Commonwealth) (s 3). The long title and background describe the Commonwealth Act as the instrument through which the Commonwealth, States, Territories and New Zealand implement recognition of regulatory standards regarding goods and occupations. The WA Act therefore does not replicate the detailed content of that scheme but imports the Commonwealth instrument responsible for those regulatory rules.

• Temporal commencement and non-operationality before Commonwealth commencement: The Act distinguishes between incorporation and effect. Section 4(2) provides that adoption "does not operate so as to give effect to any adopted provision before that provision commences as a law of the Commonwealth." That preserves the Commonwealth's sequencing: WA will not be ahead of Commonwealth commencement dates.

• Statutory instruments and registration: Section 4(4) ties the State's parliamentary transparency duties to the Commonwealth registration system , the Federal Register of Legislation maintained under the Commonwealth Legislation Act 2003 , by requiring the Minister to lay copies of any such Commonwealth regulations before each House of the WA Parliament within 14 sitting days after registration in that Federal Register.

• Governor's regulation power for temporary exemptions for goods: Section 5 authorises the Governor to make regulations "for the purposes mentioned in section 46 of the Commonwealth Act as adopted under this Act." The Act therefore creates a State-level power to mirror or implement certain temporary exemptions for goods referred to in the Commonwealth Act, subject to the Commonwealth provision’s content.

• Scheme review and intergovernmental arrangement: Section 6 refers to the Trans‑Tasman Mutual Recognition Arrangement (the intergovernmental arrangement) and to "scheme reviews" as reviews carried out under specified paragraphs of that arrangement. The Act requires tabling of scheme-review reports in WA Parliament when the Minister receives them, with a redaction gateway for sensitive material (s 6(2)-(4)).

• Termination and revocation by proclamation: Sections 7 and 8 provide executive mechanisms to terminate the State's adoption and to revoke a termination proclamation, with a specific effect , a revoking proclamation that has effect causes the revoked proclamation to be "taken never to have been made" (s 8(3)). Section 8(2) adds a publication timing condition in the Gazette for the revoking proclamation to have effect.

These concepts structure the allocation of decision-making authority: the content and timing of the substantive mutual recognition rules remain primarily within the Commonwealth Act and its regulations, while the State retains formal powers over commencement (proclamation commencement, s 2), temporary exemptions for goods (Governor regulations, s 5), and the power to terminate or reinstate adoption (ss 7-8). The Minister is given two specific transparency duties (s 4(4) and s 6(3)). The Act therefore operates mainly as a vehicle of legal incorporation plus limited State-level levers for exemptions, termination and parliamentary tabling.

The Act names few classes of persons directly but, by its operation and background, affects several groups in law and practice.

• Western Australian government actors: The Governor, the Minister and both Houses of the WA Parliament have defined roles. The Governor may make regulations for temporary exemptions for goods (s 5), may fix the day on which adoption terminates by proclamation (s 7), and may revoke a termination proclamation subject to Gazette publication conditions (s 8). The Minister must lay copies of Commonwealth regulations referred to in s 4(1) before each House within 14 sitting days after registration in the Federal Register of Legislation (s 4(4)), and must cause scheme-review reports received by the Minister to be tabled (s 6(3)), with an express power to remove sensitive, confidential or personal information before tabling (s 6(4)).

• Western Australian Parliament: Both Houses are recipients of the transparency duties in s 4(4) and s 6(3). They receive copies of Commonwealth regulations and scheme-review reports; the Act imposes timing and redaction rules which will affect parliamentary committees and parliamentary records.

• Businesses and practitioners dealing with goods and regulated occupations that are subject to the Trans‑Tasman scheme: The long title and background identify the subject matter of the Commonwealth scheme as recognition of regulatory standards regarding goods and occupations. By adopting the Commonwealth Act, WA gives effect to that mutual recognition scheme in the State, subject to the timing rule in s 4(2). Therefore regulated suppliers of goods and persons in regulated occupations in WA will be affected to the extent that the Commonwealth Act or its regulations affect recognition of standards arising from New Zealand or other parties to the Trans‑Tasman arrangement (long title; Background; s 4(1)-(2)).

• Persons engaged in scheme reviews and report authors: Section 6 anticipates that scheme reviews will be conducted under the intergovernmental arrangement and that reports will be delivered to the State Minister. Those undertaking the reviews and preparing reports should expect parliamentary tabling and possible public disclosure; the Minister may remove sensitive, confidential or personal information before tabling (s 6(4)).

• Users of the Federal Register and legal advisers: Because s 4(4) expressly ties the laying obligation to registration of Commonwealth regulations in the Federal Register of Legislation (Legislation Act 2003 (Cth)), legal advisers and regulated entities must monitor that register to know when Commonwealth regulations have been registered and to track the State tabling timetable.

• Persons affected by termination or revocation proclamations: The Governor’s proclamation to terminate the adoption (s 7) and any revocation (s 8) have legal effects. The revocation mechanism includes a retroactive legal fiction if the revoking proclamation has effect (s 8(3)), which may alter legal rights or regulatory positions depending on timing.

The Act does not itself create new licensing regimes, penalties or private rights; instead it alters the legal source of mutual recognition by importing a Commonwealth instrument and by creating State-level administrative mechanics. Therefore the practical effect on persons and businesses depends on the content and commencement of provisions in the Commonwealth Act and its regulations, and on the exercise of the covered State powers (ss 4-8; background).

This Act imposes a small set of ministerial, executive and parliamentary duties and confers specific State-level rights or powers. The text is prescriptive in a few narrow respects; the rest of the substantive duties and rights are located in the Commonwealth Act that the State adopts.

Duties placed on the Minister

• Lay Commonwealth regulations: The Minister must cause a copy of any Commonwealth regulations referred to in s 4(1) to be laid before each House of the WA Parliament within 14 sitting days of that House after the registration of the regulations in the Federal Register of Legislation (s 4(4)). This is a strict timing duty linked to Federal registration. The duty is to lay the copy before each House; the Act does not itself prescribe consequences for failure to lay within the time, but the requirement establishes a parliamentary oversight mechanism.
• Table scheme-review reports: If a scheme review (as defined in s 6(1)) is carried out, a report is prepared and the Minister receives it, the Minister "must cause the report to be laid before each House of Parliament as soon as practicable after the Minister receives the report" (s 6(3)). The Act allows the Minister to remove sensitive, confidential or personal information from the report before tabling (s 6(4)). The duty is triggered by reception of the report.

Powers and rights of the Governor and State executive

• Make regulations for temporary exemptions for goods: The Governor may make regulations for the purposes mentioned in s 46 of the Commonwealth Act, as adopted (s 5). The Act expressly states this regulation power is in addition to any other power under other Acts (s 5). The Governor therefore holds an executive regulatory power targeted at temporary exemptions for goods linked to the Commonwealth instrument.
• Terminate adoption: The Governor may, by proclamation, fix a day as the day on which the adoption under s 4(1) is to terminate (s 7). This is an executive power to withdraw the State’s adoption of the Commonwealth Act at a specified date.
• Revoke termination proclamations: The Governor may make a revoking proclamation which revokes a previous proclamation under s 7 (s 8(1)). Such a revoking proclamation only has effect if published in the Gazette before the day fixed in the termination proclamation (s 8(2)). If effective, the revoked proclamation is taken never to have been made (s 8(3)). The revoking proclamation does not prevent further termination proclamations (s 8(4)).

Rights and constraints deriving from the adoption mechanism

• Incorporation of Commonwealth Act and its regulations: By adopting the Commonwealth Act "as originally enacted and as amended from time to time by regulations made under the Commonwealth Act" (s 4(1)), WA law tracks both the Act and those Commonwealth regulations. This creates an ongoing legal effect: the State's law will incorporate later Commonwealth regulations that are within the scope of s 4(1), subject to the timing rule in s 4(2).
• Timing constraint: Adoption does not give effect to an adopted provision before that provision commences as a law of the Commonwealth (s 4(2)). Practically, a business or regulator cannot assume a provision is in force in WA simply because it is in the Commonwealth Act text; the Commonwealth's own commencement steps must have occurred first.
• Parliamentary transparency and redaction rights: The Minister must table documents but retains a statutory right to remove sensitive, confidential or personal information in scheme-review reports before tabling (s 6(4)).

Absence of express rights and duties in the Act itself

• No substantive licensing duties, penalty schedules or private rights are created by this Act itself. The Act's core function is incorporation; the substantive duties, rights and enforcement machinery governing goods, occupations and the mutual recognition scheme are contained in the Commonwealth Act and the Commonwealth regulations that the Western Australian Act adopts (s 4(1)). Where the Commonwealth Act confers duties or rights, those will operate in WA by virtue of this Act, subject to the commencement and termination mechanics set out here (ss 4(1)-(2), 7-8).

In sum, the Act creates specific administrative duties for the Minister and executive powers for the Governor, and otherwise imports the substantive duties and rights from the Commonwealth Act while adding procedural constraints on timing, tabling and termination (ss 4-8).

The Act itself contains no penalty provisions, criminal offences, civil penalties, or detailed enforcement procedures. Its enforcement implications arise indirectly from the fact that it adopts the Commonwealth Act, which contains the substantive regulatory and enforcement provisions for the Trans‑Tasman mutual recognition scheme. The Act’s text focuses on incorporation, timing, tabling, regulation-making for exemptions, and termination mechanics (ss 4-8). The following are the only enforcement-relevant mechanics in this State Act.

• No standalone penalty framework in this Act: There are no penalty clauses, infringement notices or enforcement mechanisms specified within this WA Act. Any penalties or compliance enforcement will be those created by the Commonwealth Act and Commonwealth regulations adopted under s 4(1). Because the WA Act adopts the Commonwealth Act "as... amended from time to time by regulations made under the Commonwealth Act" (s 4(1)), enforcement measures in the Commonwealth instrument will apply in WA subject to the commencement rule in s 4(2).

• Effect of timing on enforceability: Section 4(2) provides that adoption does not give effect to any adopted provision before that provision commences in Commonwealth law. A regulation or provision that has been made by the Commonwealth but has not yet commenced as a Commonwealth law will not be enforceable in WA through this Act until the Commonwealth commencement has occurred. This is a material constraint on when enforcement steps derived from Commonwealth law can be taken in WA.

• Governor-made regulations for temporary exemptions for goods: The Governor may make regulations for the purposes mentioned in s 46 of the Commonwealth Act (s 5). Any regulatory instruments made by the Governor under s 5 may themselves include enforcement mechanisms if the enabling provision in WA law permits; the Act does not specify the content or penalties of such regulations. The Act also expressly preserves other regulation-making powers (s 5), so enforcement for temporary exemptions might also be effected through other State Acts that confer enforcement powers.

• Termination and revocation legal effects: The Governor may fix a day to terminate adoption (s 7), and revoke such a proclamation subject to Gazette publication timing (s 8). Section 8(3) makes a revocation retroactive in the sense that the revoked proclamation is "taken never to have been made." That legal fiction could affect the enforceability of actions taken during the purported termination period; the Act itself does not specify remedies, but the retroactivity rule is a state of the law that could be relevant in disputes over enforcement during the relevant periods.

• Parliamentary oversight as indirect enforcement: The duty to lay Commonwealth regulations before Parliament within 14 sitting days after registration in the Federal Register (s 4(4)) and the duty to table scheme-review reports (s 6(3)) create transparency and parliamentary scrutiny. While not enforcement in the coercive sense, those duties impose accountability obligations on the Minister that could generate parliamentary or political pressure influencing the application and enforcement of the mutual recognition measures.

Because this WA Act is an adoption statute rather than a substantive regulatory statute, anyone seeking to identify precise offences, penalty amounts, inspection powers, or regulatory sanctions must examine the Commonwealth Act and any Commonwealth regulations adopted under s 4(1) as those instruments carry the substantive enforcement architecture. The WA Act’s own enforcement-relevant provisions are limited to temporal constraints on effect (s 4(2)), and executive proclamations and regulation-making powers that can alter the State-level legal status (ss 5, 7-8).

The Act is expressly constructed as a mechanism of statutory incorporation and interacts with Commonwealth and State instruments in tightly defined ways. The Act defines a set of interlocking legal relationships and procedural linkages.

• Incorporation of Commonwealth law: The central interaction is direct incorporation of the Trans‑Tasman Mutual Recognition Act 1997 (Commonwealth) and its regulations into WA law (s 4(1)). That means the WA Act operates largely through the Commonwealth Act; substantive rules, offences, licensing consequences and mutual-recognition processes will be those contained in the Commonwealth Act and its regulations, as adopted by WA.

• Dependence on Commonwealth commencement: The adoption is qualified by s 4(2): adopted provisions have no effect in WA until those provisions commence as law of the Commonwealth. This creates a sequencing interaction: commencement decisions, commencement dates and any staggered commencements made at Commonwealth level determine when provisions operate in WA.

• Link to Commonwealth legislative instruments register: Section 4(4) ties parliamentary transparency to the Federal Register of Legislation maintained under the Commonwealth Legislation Act 2003 by requiring the Minister to lay copies of any Commonwealth regulations referred to in s 4(1) before each House within 14 sitting days after registration in that Federal Register. This is a procedural bridge between Commonwealth instrument registration and State parliamentary oversight.

• Governor's regulation power vis-à-vis other State powers: Section 5 authorises the Governor to make regulations "for the purposes mentioned in section 46 of the Commonwealth Act as adopted under this Act", but it qualifies that power with the non-limitation clause "Without limiting any other power to make regulations under any other Act" (s 5). That means s 5 is intended to sit alongside, and not to curtail, other WA regulatory powers. In practice, temporary exemptions for goods may be implemented via s 5 regulations or, where relevant, by other State Acts that confer regulatory power; the Act does not displace existing State regulatory frameworks.

• Intergovernmental arrangement and referral history: The background records the constitutional and intergovernmental context. It notes that New South Wales referred matters to the Commonwealth under section 51(xxxvii) of the Commonwealth Constitution to enable the Commonwealth to enact mutual recognition legislation (Background para 2). That background explains why the Commonwealth Act exists and why States adopt it; the WA Act therefore operates within the constitutional referral architecture described in the background and the Commonwealth's legislative competence.

• Tabling of scheme-review reports and redaction: Section 6 defines an "intergovernmental arrangement" and "scheme review" with reference to the Trans‑Tasman Mutual Recognition Arrangement, and mandates tabling of scheme-review reports. The Minister's redaction power for sensitive material (s 6(4)) interacts with Freedom of Information and parliamentary procedures in practice, although the WA Act does not itself purport to displace freedom-of-information laws; it simply permits redaction before tabling.

• Proclamation and Gazette publication interaction: The termination and revocation mechanics require publication steps. A revoking proclamation has effect only if published in the Gazette before the day fixed in the termination proclamation (s 8(2)). That interacts with WA statutes and the operation of statutory instruments that rely on Gazette publication for legal effect. The Act’s revocation rule also creates a retroactive legal fiction where a revoking proclamation "has effect" (s 8(3)).

• Absence of conflict resolution text: The Act does not set out procedures to resolve conflicts between Commonwealth Act provisions and State law beyond the adoption and timing clauses. Where conflicts or overlaps arise, they will be resolved by general constitutional and statutory principles, and by the content of the Commonwealth Act and any State regulations exercising the powers under this Act (particularly s 5).

Overall, the Act is a connector piece. It makes the Commonwealth Act and its regulations part of WA law (s 4(1)), ties State parliamentary processes to Commonwealth registration (s 4(4)), creates a State regulatory power tied to a particular Commonwealth provision (s 5), and provides executive means to terminate or reinstate adoption (ss 7-8). The precise legal outcomes in any sector will therefore depend on the text and timing of Commonwealth provisions and on how the State exercises the limited powers this Act creates.

The Act has been amended in two later statutes; the compilation table and marginal notes in the Act provide the amendment record and commencement dates.

• Original enactment: The Trans‑Tasman Mutual Recognition (Western Australia) Act 2007 (No. 30 of 2007) received assent on 6 December 2007. Sections 1 and 2 commenced on 6 December 2007; the remainder of the Act commenced on 1 February 2008 (see compilation table).

• 2012 amendment: The Trans-Tasman Mutual Recognition (Western Australia) Amendment Act 2012 (No. 57 of 2012) received assent on 6 December 2012. The compilation table records s 1 and s 2 commenced on 6 December 2012 and the remainder on 7 December 2012. The long title amendment notes that the long title was amended by No. 57 of 2012 s 4, and s 4 of the principal Act was amended by No. 57 of 2012 s 6 (see marginal notes). The long title now expressly includes the phrase "including the amendments made to it before the day on which the Trans-Tasman Mutual Recognition (Western Australia) Amendment Act 2012 receives the Royal Assent", reflecting a temporal aspect to the initial adoption language.

• 2022 amendment: The Trans‑Tasman Mutual Recognition (Western Australia) Amendment Act 2022 (No. 45 of 2022) received assent on 1 December 2022. The compilation table shows s 1 and s 2 commenced on 1 December 2022 and the remainder on 2 December 2022. The 2022 amendments inserted and amended a number of provisions: s 3 (Terms used) was inserted by No. 45 of 2022 s 4; sections 4(1)-(5) are shown as amended by No. 45 of 2022 s 5; sections 6-8 were inserted by No. 45 of 2022 s 6. The Act's notes record that Sections 3 and 6-8 were included by the 2022 amending Act.

• Effect of amendments: The main functional effects recorded in the amending Acts are (a) the explicit definition additions and scheme-review tabling mechanics inserted in 2022 (s 3 and s 6), (b) the reworking of s 4 to clarify adoption mechanics and a ministerial tabling duty for Commonwealth regulations (s 4(4)), and (c) the addition of specific termination and revocation proclamation mechanics (ss 7-8). The 2012 amendment adjusted the long title and amended s 4 in ways reflected in the current text.

• Commencement logistics: The compilation table provides the precise assent and commencement dates for each enactment and amendment. Practitioners should consult that table when tracking the operative form of the Act; the 2007 Act's later commencement date (1 February 2008 for sections other than s 1 and 2) and the near-immediate commencements for the 2012 and 2022 amendments are recorded (compilation table).

This record shows that the State legislature has refined the adoption mechanics and added procedural transparency and executive proclamation mechanics by way of amendment rather than by replacing the underlying Commonwealth scheme. The current text therefore reflects both initial adoption and later additions to the State-level administrative interface with the Commonwealth Act (compilation table; s 3; s 4; ss 6-8).

The statutory text and compilation notes provided do not include any judicial decisions, reported litigation, or references to cases decided under this Act. The Act's notes and compilation table list enactment and amendment history only; there are no entries for judicial interpretation or litigation in the documents supplied.

Potentially litigable issues identifiable from the Act’s text Although no litigation is recorded in the provided materials, the Act contains provisions that could give rise to legal disputes. The Act itself does not prescribe remedies or create detailed procedural mechanisms for many of its functions, which may make particular issues likely candidates for litigation if contested. The following are concrete points of legal uncertainty identified within the Act that could reasonably form the subject-matter of litigation, were disputes to arise.

• Timing and commencement disputes: Section 4(2) states that adoption "does not operate so as to give effect to any adopted provision before that provision commences as a law of the Commonwealth." Litigation could arise about whether a given Commonwealth provision has properly "commenced as a law of the Commonwealth" and therefore whether it is in force in WA. Disputes of that nature would require examination of Commonwealth commencement instruments and may involve questions of statutory interpretation and inter-jurisdictional sequencing.

• Proclamation revocation and retrospective effect: Section 8(3) provides that a revoked proclamation is "taken never to have been made." Litigation could arise over the legal consequences of retroactive revocation, for example where regulatory action, licensing decisions, or enforcement steps were taken during the period between a termination proclamation and a revoking proclamation. Courts may be asked to resolve questions about the legal status of acts done in that interval and the proper remedies.

• Tabling and redaction obligations: The Minister's duties under s 4(4) and s 6(3) create parliamentary obligations tied to timing. Litigation might arise related to alleged failures to lay documents or disputes over the scope of permissible redaction under s 6(4) if a party claimed that redaction impeded parliamentary scrutiny or the public interest. Any such litigation would engage the interpretation of the Act’s tabling and redaction language.

• Scope of Governor regulation power under s 5: Because s 5 refers to "the purposes mentioned in section 46 of the Commonwealth Act," disputes could arise about the ambit of that reference or about whether particular State regulations exceed the authorised purposes. Such disputes would involve construction of both the WA Act and the referenced Commonwealth provision.

• Interaction and potential inconsistency with other State or Commonwealth laws: Given the Act’s function as an adoption mechanism, litigation could arise where there is claimed inconsistency between Commonwealth provisions adopted by WA and other State provisions, particularly in areas where WA has existing regulatory frameworks for goods or occupations. Constitutional questions, or statutory definition questions, might be litigated.

The source text contains no actual litigation examples or reported decisions. For authoritative statements on past litigation or judicial treatment of the Trans‑Tasman mutual recognition scheme as adopted by Western Australia, practitioners must consult case law and court databases beyond the Act text supplied here.

This Act is short and tightly focused, but it contains a handful of provisions and procedural linkages that can produce practical traps if ignored. Below are concrete, source-grounded items to watch.

1. Timing mismatch between Commonwealth commencement and WA effect (s 4(2))

• Why it matters: The Act adopts Commonwealth provisions and regulations, but s 4(2) says adopted provisions do not take effect in WA before they commence as Commonwealth law. Parties may wrongly assume that because a provision exists in the Commonwealth Act text or a Commonwealth regulation has been made, it is immediately effective in WA. That assumption would be incorrect if the Commonwealth provision has not yet commenced.
• Practical consequence: Compliance planning, regulatory approvals and enforcement actions that rely on the presence or absence of a Commonwealth provision must wait for the Commonwealth commencement step.

2. Ministerial tabling linked to Federal registration, not to State publication (s 4(4))

• Why it matters: The 14‑sitting‑day clock for laying Commonwealth regulations in State Parliament runs from the registration of the Commonwealth regulations in the Federal Register of Legislation. If a practitioner monitors only the Commonwealth Gazette or other Commonwealth channels and misses registration timing, they may miscalculate when the Minister must table the instrument.
• Practical consequence: Regulatory stakeholders should monitor the Federal Register for registration events; asking the Minister for confirmation may be necessary to ensure parliamentary tabling has occurred.

3. Governor’s regulations for temporary exemptions reference a Commonwealth provision (s 5)

• Why it matters: Section 5 authorises State regulations "for the purposes mentioned in section 46 of the Commonwealth Act." That ties the content and permitted uses of State regulations to the Commonwealth provision. The Act does not reproduce s 46, so the permitted scope is not self-evident within the WA Act text.
• Practical consequence: To understand what temporary exemptions a Governor can enact under s 5, consultees must check the corresponding Commonwealth provision(s) , the WA Act gives no standalone list.

4. Revocation precondition: Gazette publication before the fixed day (s 8(2))

• Why it matters: A revoking proclamation only "has effect" if published in the Gazette before the day fixed in the termination proclamation. If a revoking proclamation is published too late, it has no effect; the termination proclamation remains effective.
• Practical consequence: Timing and formality in Government Gazette publication are decisive. Parties should confirm Gazette publication timing before relying on the legal effect of a revocation.

5. Retroactive legal fiction for revoked proclamations (s 8(3))

• Why it matters: If a revoking proclamation has effect, the revoked proclamation is "taken never to have been made." That can have retrospective implications for rights, licences, or enforcement actions that were premised on the initial termination. The Act does not itself set out remedies or transitional arrangements for acts done in the interstitial period.
• Practical consequence: Parties should document actions taken during any purported termination period and seek legal advice regarding uncertainties created by a subsequent revocation. The retroactivity may generate disputes over whether acts taken in reliance on the terminated status must be unwound.

6. Tabling of scheme-review reports with redactions (s 6(3)-(4))

• Why it matters: The Minister must table scheme-review reports but may remove sensitive, confidential or personal information before doing so. This gives the Minister discretion to redact; that discretion is not bounded by detailed criteria in the WA Act.
• Practical consequence: Interested third parties should be aware that published reports may be redacted and, if redaction is contentious, may need to seek disclosure through other legal channels.

7. The Act does not itself create offences or penalties; enforcement depends on Commonwealth law (s 4(1))

• Why it matters: Users expecting the WA Act to provide a complete enforcement regime will be disappointed. To identify applicable offences and penalties one must consult the Commonwealth Act and adopted Commonwealth regulations.
• Practical consequence: Compliance and enforcement advice must be based on the Commonwealth texts as adopted, and one must check which Commonwealth provisions have commenced.

8. Non-exhaustive interaction with other State regulatory powers (s 5)

• Why it matters: Section 5 expressly does not limit other regulation-making powers. That leaves open the coexistence of parallel State regulatory frameworks for goods and occupations, creating potential overlap or uncertainty about which instrument controls in particular circumstances.
• Practical consequence: Practitioners should map the applicable State and Commonwealth instruments to identify overlaps, and check whether conflict or inconsistency principles apply.

These "gotchas" are all grounded in the statutory text. They highlight that the main difficulties with this Act are procedural and timing-related, not substantive technicalities within the Act itself. Careful monitoring of Commonwealth commencements, Federal registration, Gazette publication, and the content of the Commonwealth Act and regulations is essential to avoid surprises (ss 4(2), 4(4), 5, 6(3)-(4), 7-8).

Compliance under this Act is primarily about process monitoring, documentation and timely engagement with the Commonwealth instruments that the State adopts. The Act imposes a series of procedural triggers and creates a small set of powers that the State may exercise; the practical compliance actions below are all traceable to the statutory text.

For regulated businesses and advisers

• Monitor Commonwealth commencements and the Federal Register of Legislation: Because s 4(2) makes WA effect contingent on Commonwealth commencement, monitor commencement notices and the Federal Register of Legislation for registration events. Do not rely on text alone; check the Commonwealth commencement instruments so you know when adopted provisions actually operate in WA.
• Track Commonwealth regulations and anticipate WA tabling: Section 4(4) obliges the Minister to lay copies of Commonwealth regulations before each House within 14 sitting days after registration in the Federal Register of Legislation. Track registration dates and ask the Minister’s office for copies or confirmation of tabling if the instrument affects your activities.
• Map applicable instruments: Identify which parts of the Commonwealth Act and its regulations apply to your goods or occupational activities, then confirm whether the relevant provisions have commenced at Commonwealth level and therefore in WA under s 4(2).
• Prepare for temporary-exemption processes: If your activity may be impacted by temporary exemptions for goods, note that the Governor may make regulations under s 5 for purposes mentioned in s 46 of the Commonwealth Act. Identify the Commonwealth provision’s criteria and prepare submissions or compliance plans that reference both Commonwealth criteria and potential WA regulation-making.
• Document reliance periods: Because termination and revocation proclamations (ss 7-8) can change the State’s adoption status, keep records of any regulatory reliance actions carried out during a period in which the adoption appears terminated or in effect. Those records will be essential if a revoking proclamation (s 8) creates retroactive effects.

For State officials and Ministers

• Observe the 14‑sitting‑day laying obligation: Establish administrative processes to ensure any Commonwealth regulations registered in the Federal Register are copied and laid before each House within the 14 sitting days required by s 4(4).
• Manage scheme-review reports: When the Minister receives a scheme-review report, cause it to be laid before each House "as soon as practicable" (s 6(3)). Implement internal procedures for prompt tabling and for redaction consistent with s 6(4) where the report contains sensitive, confidential or personal information.
• Ensure formal Gazette publication for revoking proclamations: If a decision is made to revoke a termination proclamation, ensure that the revoking proclamation is published in the Gazette before the day fixed in the termination proclamation, otherwise the revoking proclamation "has effect" (s 8(2)) will not be satisfied and the termination will remain operative.
• Use s 5 regulations carefully and in consultation: Regulations under s 5 are expressly linked to s 46 of the Commonwealth Act. When drafting such regulations, coordinate with Commonwealth counterparts to ensure consistency with the stated Commonwealth purposes and to avoid inconsistent application across jurisdictions.

For legal advisers and compliance teams

• Cross-reference the Commonwealth Act and regulations: Because the WA Act adopts the Commonwealth Act and its regulations, the primary compliance texts will be the Commonwealth Act and the specific Commonwealth regulations. Use s 4(1) and s 4(2) as reminders to cross-reference Commonwealth commencement information.
• Advise clients on proclamation risks: Inform clients that the Governor may terminate adoption by proclamation (s 7) and that such termination can be revoked under tight Gazette timing conditions (s 8). Plan for contingencies where State adoption status might change, particularly for licensing, approvals and cross-border trading arrangements.
• Prepare parliamentary-material submissions: If industry input is relevant to scheme reviews, remember that the Minister must table scheme-review reports and may redact sensitive material (s 6(3)-(4)). Provide clients with options for confidentiality protections in submissions.

Checklist summary (source-grounded)

• Monitor Federal Register of Legislation for registration events (s 4(4)).
• Confirm whether relevant Commonwealth provisions have commenced before treating them as operative in WA (s 4(2)).
• If affected by temporary exemptions for goods, identify the content and scope of s 46 of the Commonwealth Act and prepare to engage with potential Governor regulations under s 5.
• Keep records of actions during any period where a termination proclamation is in force; verify Gazette publication if a revocation is claimed (ss 7-8).
• When preparing or handling scheme-review reports, plan for prompt tabling and potential redactions under s 6(3)-(4).

Following these steps aligns compliance activity with the Act’s mechanics and minimises timing and procedural risk. The substantive compliance obligations, enforcement tools and penalties will be found in the Commonwealth Act and its regulations as adopted under this Act; therefore accurate compliance requires reading both the WA adoption statute (this Act) and the current Commonwealth instruments it incorporates (s 4(1)-(2), s 4(4), s 5, ss 6-8).
