Trans-Tasman Mutual Recognition (South Australia) Act 1999

This Act adopts, as the law of South Australia, the Commonwealth Trans‑Tasman Mutual Recognition Act 1997 (the Commonwealth Act) for the purpose of recognising within Australia regulatory standards adopted in New Zealand with respect to goods and occupations. The South Australian statute performs three mechanical functions.

First, it incorporates the Commonwealth Act into South Australian law by placing the Commonwealth Act and any amendments made to it by regulations within the State's legal order under section 51(xxxvii) of the Commonwealth Constitution, as provided in s 4(1) of the South Australian Act. The adoption operates from the day this Act commences, but not so as to give effect to any provision of the Commonwealth Act before that provision came into operation at Commonwealth level, see s 4(2).

Second, the South Australian Governor is given a power to fix the day on which that adoption will terminate, via proclamation, under s 4(3). The Act also expressly provides for regulations made by the Governor of South Australia to implement temporary exemptions under the Commonwealth Act, see s 5. The State Act therefore creates a mechanism both to adopt the Commonwealth regime and to opt out or terminate that adoption at a future date by proclamation, and to make local regulations for temporary exemptions in support of the Commonwealth temporary exemption power in s 46 of the Commonwealth Act.

Third, the State Act contains an expiry mechanism: the State Act expires at the end of the period for which the Commonwealth Act is adopted under s 4, see s 6. The legislative history shows the Act was amended in 2004 by the Trans‑Tasman Mutual Recognition (South Australia) (Removal of Sunset Clause) Amendment Act 2004, which substituted s 4 and inserted s 4(3), changes commenced on 5 August 2004. That amendment is recorded in the legislative history.

South Australia Trans-Tasman Mutual Recognition (South Australia) Act 1999 An Act to facilitate the recognition within Australia of regulatory standards adopted by New Zealand regarding goods and occupations and, for that purpose, to adopt the Trans-Tasman Mutual Recognition Act 1997 of the Commonwealth as a law of the State.

The Parliament of Australia enacts: Part 1—Preliminary 1—Short title This Act may be cited as the Trans-Tasman Mutual Recognition Act 1997. 2—Commencement (1) This Part commences on the day on which this Act receives the Royal Assent. (2) The remaining provisions of this Act commence on a day or days to be fixed by Proclamation. 3—Principal purpose (1) The principal purpose of this Act is to enact legislation authorised by the Parliaments of States under paragraph (xxxvii) of section 51 of the Commonwealth Constitution, and requested by the legislatures of the Australian Capital Territory and the Northern Territory, for the purpose of recognising within Australia regulatory standards adopted in New Zealand regarding goods and occupations. (2) The legislation is as contemplated by the Trans‑Tasman Mutual Recognition Arrangement entered into on 9 July 1996 between the Commonwealth of Australia, New Zealand, the States of New South Wales, Victoria, Queensland, Western Australia, South Australia and Tasmania, the Australian Capital Territory and the Northern Territory. 4—Interpretation (1) In this Act, unless the contrary intention appears: Australia means Australia in a geographical sense, and does not include the external territories. Australian jurisdiction means a participating jurisdiction, other than New Zealand. Australian Tribunal means the Administrative Appeals Tribunal or a successor to that body. conditions, when used in relation to occupations, means conditions, limitations or restrictions. deemed registration means deemed registration as defined in section 24. designated person means: (a) for New Zealand—a Minister of the Crown for New Zealand; or (b) for the Commonwealth—the Governor-General of Australia; or (c) for a State (other than a Territory)—the Governor of the State or a Minister of the Crown for the State; or (d) for the Australian Capital Territory—the Chief Minister for the Territory; or (e) for the Northern Territory—the Administrator of the Territory. equivalent, when used in relation to occupations, has a meaning affected by Division 4 of Part 3. goods means goods of any kind, and includes: (a) animals or plants; or (b) material of microbial origin; or (c) a package containing goods; or (d) a label attached to goods. grant, when used in relation to registration, means grant, issue or otherwise confer registration. import into an Australian jurisdiction means import from outside Australia. labelling of goods includes any means by which, at the point of sale, information is attached to goods or is displayed in relation to goods without being attached to them. local registration authority of a participating jurisdiction for an occupation means the person or authority in the jurisdiction having the function conferred by legislation of registering persons in connection with their carrying on that occupation in the jurisdiction. New Zealand has the meaning given by the Acts Interpretation Act 1924 of New Zealand, as in force from time to time. New Zealand Act means the Act of the Parliament of New Zealand (as amended and in force from time to time) that deals with Trans‑Tasman mutual recognition and corresponds to this Act, and includes any Act replacing that Act (as amended and in force from time to time). New Zealand Tribunal means the Trans‑Tasman Occupations Tribunal of New Zealand or a successor to that body. occupation means an occupation, trade, profession or calling of any kind that may be carried on only by registered persons, where registration is wholly or partly dependent on the attainment or possession of some qualification (for example, training, education, examination, experience, character or being fit or proper), and includes a specialisation in any of the above in which registration may be granted. participating jurisdiction has the meaning given by section 50. produce includes to manufacture, and also includes to harvest or otherwise produce in the course of any form of primary production. registration includes the licensing, approval, admission, certification (including by way of practising certificates), or any other form of authorisation, of a person required by or under legislation for carrying on an occupation. requirements, when used in relation to goods, means requirements, prohibitions, restrictions or conditions. sell includes sell by wholesale or retail, and includes distribute for sale, expose or offer for sale or have in possession for sale or agree to sell, and includes barter, and includes supply by way of exchange, lease, hire or hire-purchase. State includes the Australian Capital Territory or the Northern Territory. substantive registration means registration under a law of a participating jurisdiction, but does not include deemed registration. (2) A law specified or described in a Schedule to this Act includes (unless otherwise stated in the Schedule) any relevant regulations or other statutory instruments under that law. (3) A law specified or described in a Schedule to this Act, including any relevant regulations or other statutory instruments under that law, includes (unless otherwise stated in the Schedule) any amendment or replacement of that law, but only to the extent that the effect of the amendment or replacement does not restrict the scope of this Act. (4) A reference in this Act to the designated person is, in relation to a participating jurisdiction for which there is or can be more than one designated person, a reference to any one of them. (5) This Act is to be interpreted in accordance with the Acts Interpretation Act 1901 as in force at the date on which this Act receives the Royal Assent. 5—Operation of this Act in relation to the Commonwealth (1) Subject to this section: (a) this Act has effect despite anything in any other law of the Commonwealth enacted or made before the commencement of this section; and (b) any law of the Commonwealth enacted or made after the commencement of this section is to be construed as having effect subject to this Act, except where that law expressly overrides this Act. (2) Subject to subsection 51(2), nothing in this Act affects the operation of the Mutual Recognition Act 1992. 6—Operation of this Act in relation to the States (1) This Act applies to a State, but only while it is a participating jurisdiction. (2) Accordingly, a reference in this Act to a State is a reference to a State that is a participating jurisdiction, and this Act does not affect the operation of the laws of a State that is not a participating jurisdiction. (3) This Act does not affect the operation of a law of a State so far as it can operate concurrently with this Act. 7—Operation of this Act in relation to New Zealand (1) The Governor-General may declare by Proclamation that this Act will cease to have effect on a specified day, if satisfied that: (a) New Zealand is not a participating jurisdiction and is not likely to become a participating jurisdiction in the near future; or (b) New Zealand is a participating jurisdiction but is likely to cease to be a participating jurisdiction in the near future. (2) Such a Proclamation cannot be made unless the designated person for each of the participating jurisdictions (other than New Zealand and the Commonwealth) has published a notice in the official gazette of the jurisdiction requesting the making of the Proclamation. (3) Such a Proclamation is effective according to its terms. 8—Crown bound Subject to section 6, this Act binds the Crown in right of the Commonwealth and of each of the States. Part 2—Goods 9—Trans‑Tasman mutual recognition principle (1) The Trans‑Tasman mutual recognition principle as applying to goods is as set out in this Part. (2) This Part deals with goods produced in or imported into New Zealand and their sale in Australia. 10—Entitlement to sell goods The Trans‑Tasman mutual recognition principle is that, subject to this Part, goods produced in or imported into New Zealand, that may lawfully be sold in New Zealand, either generally or in particular circumstances, may, by virtue of this Act, be sold in an Australian jurisdiction either generally or in particular circumstances (as the case may be), without the necessity for compliance with further requirements imposed by or under the law of that jurisdiction as described in section 11. 11—Requirements that do not need to be complied with The further requirements referred to in section 10 are any one or more of the following requirements relating to sale that are imposed by or under the law of the Australian jurisdiction concerned: (a) a requirement that the goods satisfy standards of the jurisdiction relating to the goods themselves, including for example requirements relating to their production, composition, quality or performance; (b) a requirement that the goods satisfy standards of the jurisdiction relating to the way the goods are presented, including for example requirements relating to their packaging, labelling, date stamping or age; (c) a requirement that the goods be inspected, passed or similarly dealt with in or for the purposes of the jurisdiction; (d) a requirement that any step in the production of the goods not occur outside the jurisdiction; (e) any other requirement relating to sale that would prevent or restrict, or would have the effect of preventing or restricting, the sale of the goods in the jurisdiction. 12—Requirements that do need to be complied with (1) The Trans‑Tasman mutual recognition principle is subject to the exceptions specified in this section. (2) The first exception is that the principle does not affect the operation of any laws of an Australian jurisdiction that regulate the manner of the sale of goods in the jurisdiction or the manner in which sellers conduct or are required to conduct their business in the jurisdiction (including laws set out in the examples below), so long as those laws apply equally to goods produced in or imported into the jurisdiction. Examples: Laws relating to the following: (a) the contractual aspects of the sale of goods; (b) the registration of sellers or other persons carrying on occupations; (c) the requirement for business franchise licences; (d) the persons to whom goods may or may not be sold; (e) the circumstances in which goods may or may not be sold. (3) The second exception is that the principle does not affect the operation of any laws of an Australian jurisdiction regarding the transportation, storage or handling of goods within the jurisdiction, so long as: (a) those laws apply equally to goods produced in or imported into the jurisdiction; and (b) those laws are directed at matters affecting health and safety of persons in the jurisdiction or at preventing, minimising or regulating environmental pollution (including air, water, noise or soil pollution) in the jurisdiction. (4) The third exception is that the principle does not affect the operation of any laws of an Australian jurisdiction regarding the inspection of goods within the jurisdiction, so long as: (a) inspection or the requirement for inspection is not a prerequisite to the sale of the goods in the jurisdiction; and (b) those laws apply equally to goods produced in or imported into the jurisdiction; and (c) those laws are directed at matters affecting the health and safety of persons in the jurisdiction or at preventing, minimising or regulating environmental pollution (including air, water, noise or soil pollution) in the jurisdiction. 13—Defences to offences regarding sale (1) It is a defence to a prosecution for an offence against a law of an Australian jurisdiction in relation to the sale of any goods if the defendant expressly claims that the Trans‑Tasman mutual recognition principle applies and establishes that: (a) the goods were labelled at the point of sale with a statement to the effect that the goods were produced in or imported into New Zealand; and (b) the defendant had no reasonable grounds for suspecting that they were not so produced or imported. (2) The defence is not available if the prosecution proves that the Trans‑Tasman mutual recognition principle did not apply in the circumstances of the alleged offence (because for example the goods did not comply with requirements imposed by the law of New Zealand). (3) Any relevant presumptions or evidentiary procedures under the law of New Zealand are available to the prosecution or defendant in relation to matters sought to be proved by the prosecution under subsection (2). (4) Any relevant defences under the law of New Zealand are available to the defendant in relation to matters sought to be proved by the prosecution under subsection (2). (5) This section does not affect any defence that is available apart from this section. 14—Goods that comply with local law Nothing in this Part prevents goods from being sold in an Australian jurisdiction if (apart from this Act) they comply with the relevant requirements of the law in force in the jurisdiction. Part 3—Occupations Division 1—Preliminary 15—Trans‑Tasman mutual recognition principle (1) The Trans‑Tasman mutual recognition principle as applying to occupations is as set out in this Part. (2) This Part deals with the ability of a person who is registered in connection with an occupation in New Zealand to carry on an equivalent occupation in Australia. 16—Entitlement to carry on occupation (1) The Trans‑Tasman mutual recognition principle is that, subject to this Part, a person who is registered in New Zealand for an occupation is, by virtue of this Act, entitled after notifying the local registration authority of an Australian jurisdiction for the equivalent occupation: (a) to be registered in the jurisdiction for the equivalent occupation; and (b) pending such registration, to carry on the equivalent occupation in the jurisdiction. (2) However, the Trans‑Tasman mutual recognition principle is subject to the exception that it does not affect the operation of laws that regulate the manner of carrying on an occupation in an Australian jurisdiction, so long as those laws: (a) apply equally to all persons carrying on or seeking to carry on the occupation under the law of the jurisdiction; and (b) are not based on the attainment or possession of some qualification or experience relating to fitness to carry on the occupation. 17—Application of this Part (1) This Part applies to individuals and occupations carried on by them. (2) This Part extends to an occupation carried on by an individual, where the individual is subject to more than one system of registration or more than one local registration authority in a participating jurisdiction, and accordingly this Part applies in relation to each such system of registration and each such authority. (3) Without limiting subsection (2), an example of such an occupation is that of a legal practitioner, which involves both the admission as a legal practitioner by a court and the issue of a practising certificate by another body. Division 2—Entitlement to registration 18—Notification to local registration authority (1) A person who is registered in New Zealand for an occupation may lodge a written notice with the local registration authority of an Australian jurisdiction for the equivalent occupation, seeking registration for the equivalent occupation in accordance with the Trans‑Tasman mutual recognition principle. (2) The notice must: (a) state that the person is registered for the occupation in New Zealand; and (b) state the occupation for which registration is sought and that it is being sought in accordance with the Trans‑Tasman mutual recognition principle; and (c) specify all the participating jurisdictions in which the person has substantive registration for equivalent occupations; and (d) state that the person is not the subject of disciplinary proceedings in any participating jurisdiction (including any preliminary investigations or action that might lead to disciplinary proceedings) in relation to those occupations; and (e) state that the person's registration in any participating jurisdiction is not cancelled or currently suspended as a result of disciplinary action; and (f) state that the person is not otherwise personally prohibited from carrying on any such occupation in any participating jurisdiction, and is not subject to any special conditions in carrying on that occupation, as a result of criminal, civil or disciplinary proceedings in any participating jurisdiction; and (g) specify any special conditions to which the person is subject in carrying on any such occupation in any participating jurisdiction; and (h) give consent to the making of inquiries of, and the exchange of information with, the authorities of any participating jurisdiction regarding the person's activities in the relevant occupation or occupations or otherwise regarding matters relevant to the notice. (3) The notice must be accompanied by a document that is either the original or a copy of the instrument evidencing the person's existing registration (or, if there is no such instrument, by sufficient information to identify the person and the person's registration). (4) As regards the instrument evidencing the person's existing registration, the person must certify in the notice that the accompanying document is the original or a complete and accurate copy of the original. (5) The statements and other information in the notice must be verified by statutory declaration. (6) The local registration authority may permit the notice to be amended after it is lodged. 19—Entitlement to registration and continued registration (1) A person who lodges a notice under section 18 with a local registration authority of an Australian jurisdiction is entitled to be registered in the equivalent occupation, as if the law of the jurisdiction that deals with registration expressly provided that registration in New Zealand is a sufficient ground of entitlement to registration. (2) The local registration authority may grant registration on that ground and may grant renewals of such registration. (3) Once a person is registered on that ground, the entitlement to registration continues, whether or not registration (including any renewal of registration) ceases in New Zealand. (4) Continuance of registration is otherwise subject to the laws of the jurisdiction, to the extent to which those laws: (a) apply equally to all persons carrying on or seeking to carry on the occupation under the law of the jurisdiction; and (b) are not based on the attainment or possession of some qualification or experience relating to fitness to carry on the occupation. (5) The local registration authority may impose conditions on registration, but may not impose conditions that are more onerous than would be imposed in similar circumstances (having regard to relevant qualifications and experience) if it were registration effected apart from this Part, unless they are conditions that apply to the person's registration in New Zealand or that are necessary to achieve equivalence of occupations. (6) This section has effect subject to this Part. 20—Action following notice (1) Registration must be granted within one month after the notice is lodged with the local registration authority under section 18. (2) When granted, registration takes effect as from the date the notice was lodged. (3) However, the local registration authority may, subject to this Part and within one month after the notice was lodged, postpone or refuse the grant of registration. (4) If the local registration authority neither grants the registration nor takes action under subsection (3) within the period of one month after the notice is lodged, the person is entitled to registration immediately at the end of that period and no objection may be taken to the notice on any of the grounds on which refusal or postponement may be effected, except where fraud is involved. 21—Postponement of registration (1) A local registration authority may postpone the grant of registration, if: (a) any of the statements or information in the notice as required by section 18 are materially false or misleading; or (b) any document or information as required by section 18(3) has not been provided or is materially false or misleading; or (c) the circumstances of the person lodging the notice have materially changed since the date of the notice or the date it was lodged; or (d) the authority decides that the occupation in which registration is sought is not an equivalent occupation. (2) If the grant of registration has been postponed, the local registration authority may in due course grant or refuse the registration. (3) The local registration authority may not postpone the grant of registration for longer than a period of 6 months, and the person is entitled to registration immediately, at the end of that period, unless registration was refused at or before the end of that period. (4) Nothing in subsection (3) prevents earlier registration from being granted on a review by the Australian Tribunal. 22—Refusal of registration (1) A local registration authority may refuse the grant of registration, if: (a) any of the statements or information in the notice as required by section 18 are materially false or misleading; or (b) any document or information as required by section 18(3) has not been provided or is materially false or misleading; or (c) the authority decides that the occupation in which registration is sought is not an equivalent occupation and equivalence cannot be achieved by the imposition of conditions. (2) A decision to refuse to grant registration on the ground that the occupation in which registration is sought is not an equivalent occupation takes effect at the end of a specified period (not less than 2 weeks) after the person is notified of the decision, unless it has been previously revoked or there is an application for review to the Australian Tribunal, in which case the Tribunal may make whatever orders it considers appropriate. 23—Notification of decision A local registration authority must give the person who lodges a notice in accordance with section 18 a notice in writing of its decision to grant registration, or to postpone or refuse the grant of registration, or to impose conditions on registration. Division 3—Interim arrangements 24—Deemed registration (1) A person who lodges a notice under section 18 with a local registration authority of an Australian jurisdiction is, pending the grant or refusal of registration, taken to be registered as provided in section 19. (2) Such registration is called deemed registration in this Act. (3) Deemed registration in one Australian jurisdiction does not of itself provide a basis for registration in another Australian jurisdiction. 25—Duration of deemed registration (1) A person's deemed registration in an Australian jurisdiction continues until it is cancelled or suspended or otherwise ceases in accordance with this Part. (2) A person's deemed registration in an Australian jurisdiction ceases if the person becomes substantively registered in the jurisdiction in connection with the occupation concerned. (3) A person's deemed registration in an Australian jurisdiction ceases if the local registration authority of the jurisdiction refuses to grant registration, subject to any determination of the Australian Tribunal. (4) A person's deemed registration in an Australian jurisdiction ceases if the person ceases to be substantively registered in every other participating jurisdiction mentioned in the notice as required by section 18(2)(c). (5) A local registration authority of an Australian jurisdiction may cancel a person's deemed registration in the jurisdiction if the person requests cancellation. (6) Deemed registration is not affected by postponement of the grant of substantive registration. 26—Activities under deemed registration (1) A person who has deemed registration in an Australian jurisdiction may carry on the occupation in the jurisdiction as if the deemed registration were substantive registration in the jurisdiction. (2) However, the person may do so only: (a) within the limits conferred by the person's substantive registration in New Zealand; and (b) within the limits conferred by the person's deemed registration in the Australian jurisdiction; and (c) subject to any conditions or undertakings applying to the person's registration in New Zealand, unless waived by the local registration authority of the Australian jurisdiction under this section; and (d) subject to any conditions applying to the person's deemed registration. (3) Without limiting anything in this Division: (a) the person may not carry on the occupation in the Australian jurisdiction without complying with any requirements regarding insurance, fidelity funds, trust accounts and the like that are designed to protect the public, clients, customers or others; and (b) a person who has deemed registration in an occupation in the Australian jurisdiction is subject to any disciplinary provisions and arrangements that are applicable to persons who are substantively registered in the jurisdiction; and (c) references in the law of the Australian jurisdiction to persons registered in an occupation under the law of the jurisdiction (however expressed) extend to persons who have deemed registration for the occupation under this Act. (4) However, the local registration authority of the Australian jurisdiction may waive any condition imposed under the law of New Zealand, or any undertaking given to the local registration authority of New Zealand, if it thinks it appropriate in the circumstances. (5) The local registration authority of the Australian jurisdiction may impose conditions as if deemed registration were substantive registration, but it must not impose conditions that are more onerous than would be imposed in similar circumstances (having regard to relevant qualifications and experience) if it were registration effected apart from this Part, unless they correspond to conditions or undertakings that apply to the person's registration in New Zealand or that are necessary to achieve equivalence of occupations. Division 4—Equivalent occupations 27—Equivalent occupations The equivalence of occupations carried on in different participating jurisdictions is, for the purposes of this Act, to be determined in accordance with this Part. 28—General principle (1) An occupation for which persons may be registered in New Zealand is taken to be equivalent to an occupation for which persons may be registered in an Australian jurisdiction if the activities authorised to be carried out under each registration are substantially the same (whether or not this result is achieved by means of the imposition of conditions). (2) Conditions may be imposed on registration under this Part so as to achieve equivalence between occupations in different participating jurisdictions. (3) This section has effect subject to any relevant declarations in force under this Division. 29—Declarations as to equivalent occupations (1) This Part is to be given effect in accordance with relevant declarations (if any) made under this Division regarding equivalent occupations. (2) If a declaration made by the Australian Tribunal under section 30 and a declaration made by Ministers under section 31 are inconsistent, the ministerial declaration prevails. (3) A declaration under this Part does not affect the registration of any person already registered (except in the case of a declaration made by the Australian Tribunal in relation to that person specifically). 30—Declarations by Australian Tribunal (1) On a review, the Australian Tribunal may make an order that a person who is registered in a particular occupation in New Zealand is or is not entitled to registration in an Australian jurisdiction in a particular occupation, and may specify or describe conditions that will achieve equivalence. (2) On a review, the Australian Tribunal may make a declaration that occupations carried on in New Zealand and an Australian jurisdiction are not equivalent, but only if the Australian Tribunal is satisfied that: (a) the activities involved in the occupations are not substantially the same (even with the imposition of conditions); or (b) registration in New Zealand should not entitle registered persons to carry on a particular activity or class of activity in an Australian jurisdiction, where: (i) the activity or class of activity is a material part of the practice of a person registered in New Zealand for the occupation; and (ii) the activity or class of activity, if carried out by a person not conforming to the appropriate standards, could reasonably be expected to expose persons in the Australian jurisdiction to a real threat to their health or safety or could reasonably be expected to cause significant environmental pollution (including air, water, noise or soil pollution); and (iii) it is not practicable to protect the health or safety of such persons from that threat or the environment from such pollution by regulating the manner in which services in the occupation are provided. (3) The Registrar or other proper officer of the Australian Tribunal must cause a notice setting out the terms of a declaration under this section to be promptly published in the Commonwealth of Australia Gazette. (4) A declaration made on the basis of paragraph (2)(b) has effect for no longer than 12 months, and the local registration authority must promptly notify appropriate authorities in each other participating jurisdiction of the declaration. (5) The local registration authority is to give effect to the decision on the review, and must thereafter act in conformity with the decision in relation to other persons seeking registration. 31—Declarations by Ministers (1) A Minister from New Zealand and a Minister from each of one or more Australian jurisdictions may jointly declare, by notice in the Commonwealth of Australia Gazette, that specified occupations are equivalent, and may specify or describe conditions that will achieve equivalence. (2) The declaration may be amended or rescinded in the same way. (3) The declaration has effect only in relation to the participating jurisdictions concerned. (4) The appropriate local registration authority is to give effect to the declaration. Division 5—General provisions 32—Disciplinary action (1) If a person's registration in an occupation in New Zealand: (a) is cancelled or suspended; or (b) is subject to a condition; on disciplinary grounds, or as a result of or in anticipation of criminal, civil or disciplinary proceedings, then the person's registration in the equivalent occupation in an Australian jurisdiction is affected in the same way. (2) However, the local registration authority of the Australian jurisdiction may reinstate any cancelled or suspended registration or waive any such condition if it thinks it appropriate in the circumstances. (3) This section extends to registration effected apart from this Act. (4) This section has effect despite any other provisions of this Part. 33—Review of decisions (1) Subject to the Administrative Appeals Tribunal Act 1975, application may be made to the Australian Tribunal for review of a decision of a local registration authority of an Australian jurisdiction in relation to its functions under this Act. (2) In subsection (1): decision has the same meaning as in the Administrative Appeals Tribunal Act 1975. (3) If a local registration authority gives a person written notice of the making of a decision referred to in subsection (1), the notice must include a statement to the effect that: (a) subject to the Administrative Appeals Tribunal Act 1975, application for review of the decision may be made to the Australian Tribunal by a person whose interests are affected by the decision; and (b) except where subsection 28(4) of that Act applies, application may be made in accordance with section 28 of that Act by or on behalf of that person for a statement in writing setting out the findings on material questions of fact, referring to the evidence or other material on which those findings were based, and giving the reasons for the decision. (4) Any failure to comply with a requirement of subsection (3) does not affect the validity of the decision. 34—Costs The Australian Tribunal may order a party in proceedings before it to pay costs if the party has acted unreasonably. 35—Co-operation with and membership of Trans‑Tasman Occupations Tribunal (NZ) (1) The purpose of this section is to promote consistency between decisions made by the Australian Tribunal for the purposes of this Act and decisions made by the New Zealand Tribunal for the purposes of the New Zealand Act. (2) In making decisions for the purposes of this Act, the Australian Tribunal is to have regard to decisions of the New Zealand Tribunal. (3) For the purposes of a review of a decision referred to in subsection 33(1) of this Act, the President of the Australian Tribunal may, in the exercise of the power under paragraph 20(1A)(b) of the Administrative Appeals Tribunal Act 1975, direct that the persons who are to constitute the Australian Tribunal for the purposes of that review include: (a) the Chairperson of the New Zealand Tribunal; or (b) a person included on the panel maintained under the New Zealand Act who is nominated by the Chairperson of the New Zealand Tribunal for the purposes of that review. (4) The President of the Australian Tribunal must exercise the power given by subsection (3) in accordance with arrangements made from time to time between the President and the Chairperson of the New Zealand Tribunal. (5) A reference in Part III, IIIA, IV or VI of the Administrative Appeals Tribunal Act 1975 to a member includes a reference to a person included in a direction under subsection (3). (6) In spite of anything in any other Act, the Chairperson of the New Zealand Tribunal, or a person included on the panel maintained under the New Zealand Act, is not entitled to remuneration or allowances in respect of service as a member of the Australian Tribunal as permitted by this Act. (7) Service by a member of the Australian Tribunal on the New Zealand Tribunal under the New Zealand Act is taken for all purposes of Australian law to be service as a member of the Australian Tribunal. 36—Residence or domicile Residence or domicile in a particular participating jurisdiction is not to be a prerequisite for or a factor in entitlement to the grant, renewal or continuation of registration arising under this Part. 37—Furnishing information (1) A local registration authority of an Australian jurisdiction must furnish without delay any information reasonably required by a local registration authority of another participating jurisdiction about a person substantively registered under a law of the Australian jurisdiction. (2) The obligation imposed under this section does not apply unless the authority of the other participating jurisdiction notifies the authority of the firstmentioned jurisdiction that the information is required in connection with: (a) a notice lodged by a person seeking registration; or (b) a person's deemed registration; or (c) actual or possible disciplinary action against the person. (3) The authority of the firstmentioned jurisdiction is empowered to provide the information, despite any law relating to secrecy, confidentiality or privacy. (4) Nothing in this section affects any obligation or power to provide information apart from this section. 38—Receiving information If a local registration authority of an Australian jurisdiction receives information under section 37 of this Act or the corresponding provision of the New Zealand Act, the information is subject to any law relating to secrecy, confidentiality or privacy that would apply if the information were provided under the law of the jurisdiction under which the authority is constituted or exercises its functions. 39—General responsibilities of local registration authorities (1) It is the duty of each local registration authority of an Australian jurisdiction to facilitate the operation of this Part in relation to the occupations for which the authority is responsible, and in particular to make use of the power to impose conditions in such a way as to promote the Trans‑Tasman mutual recognition principle. (2) It is the duty of each local registration authority of an Australian jurisdiction to prepare and make available guidelines and information regarding the operation of this Part in relation to the occupations for which the authority is responsible. (3) The first such guidelines and information are to be available within 6 months after the commencement of this section. (4) In dealing with information obtained or to be obtained under this Act, a local registration authority of an Australian jurisdiction must have regard to the principles relating to information privacy set out in Schedule 5. (5) Nothing in subsection (4) or in Schedule 5: (a) affects the operation or validity of any decision or other action taken under this Act; or (b) gives rise to, or can be taken into account in, any civil cause of action; or (c) creates rights or duties that are enforceable in judicial or other proceedings. 40—Fees (1) A local registration authority of an Australian jurisdiction has power to impose fees in relation to substantive or deemed registration or the continuance of registration arising under this Part, but any such fees may not be greater than are applicable for registration apart from this Part. (2) Nothing in this section prevents the fixing or prescribing of fees referred to in this section under any other law of an Australian jurisdiction, but the fees may not be greater than can be imposed under this section. (3) The local registration authority may impose a condition on substantive or deemed registration arising under this Part to the effect that a person may not carry out activities under registration unless a fee or other payment has been paid, but such a condition may not be imposed unless it corresponds to a requirement attaching to registration apart from this Part. (4) This section does not authorise the imposition of a tax. 41—Formalities requiring personal attendance (1) Neither substantive or deemed registration, nor entitlement to registration, under this Part requires compliance with any statutory or other formalities requiring personal attendance in the Australian jurisdiction concerned. (2) This section applies to formalities that would otherwise have to be complied with before, at or after registration. 42—Saving Nothing in this Part prevents a person from seeking registration or being registered for an occupation under a law apart from this Part. Part 4—Exclusions and exemptions 43—References to endorsing a proposed regulation (1) For the purposes of this Part, a jurisdiction endorses a regulation if the designated person for the jurisdiction publishes a notice in the official gazette of the jurisdiction setting out and endorsing the terms of the regulation before it is made. (2) However, the making of a recommendation by a Minister to the Governor-General for the making of a regulation amounts to endorsement of the regulation by the Commonwealth, and the Commonwealth is taken to have endorsed the regulation for the purposes of this Part if the regulation is in fact made. 44—Exclusions (1) This Act does not affect laws of an Australian jurisdiction specified or described in Schedule 1, to the extent that Schedule 1 indicates that they are excluded from the operation of this Act. (2) The Governor-General may make regulations amending Schedule 1. (3) A regulation may not be made for the purposes of this section unless all of the then participating jurisdictions have endorsed the regulation. (4) However: (a) if such a regulation merely omits or reduces the extent of an exclusion of a law of a State from Schedule 1, the regulation may be made if the State has endorsed the regulation; or (b) if such a regulation amends Part 2 of Schedule 1 by substituting or adding a law of a State that relates to a matter referred to in paragraph (a), (b), (c) or (d) of subclause 1(1) of Part 1 of that Schedule, the regulation may be made if the State has endorsed the regulation. 45—Permanent exemptions (1) This Act does not affect the operation of laws of an Australian jurisdiction specified or described in Schedule 2, to the extent that Schedule 2 indicates that they are exempt from the operation of this Act. (2) Such an exemption may be limited or unlimited in its application. If a law is specified or described in Schedule 2 without any limitation, it is taken to be wholly exempt from the operation of this Act. (3) The Governor-General may make regulations amending Schedule 2. (4) A regulation may not be made for the purposes of this section unless all of the then participating jurisdictions have endorsed the regulation. (5) However: (a) if such a regulation relates solely to one or more laws specified or described in Schedule 3 and will not take effect within 5 years after the commencement of section 48, the regulation may be made if at least two-thirds of the then participating jurisdictions have endorsed the regulation; or (b) if such a regulation merely omits or reduces the extent of an exemption of a law of a State from Schedule 2, the regulation may be made if the State has endorsed the regulation. 46—Temporary exemptions (1) This Act does not: (a) apply to the sale in an Australian jurisdiction of exempt goods; or (b) affect the operation of exempt laws of an Australian jurisdiction relating to a particular kind of goods. (2) For the purposes of this section, goods or laws are exempt if the goods are of a kind, or the laws are, for the time being declared by or under an Act or regulation of the jurisdiction to be exempt from the operation of this Act. (3) Any such exemptions have effect only if they are substantially for the purpose of protecting the health and safety of persons in the jurisdiction or preventing, minimising or regulating environmental pollution (including air, water, noise or soil pollution) in the jurisdiction. (4) No such exemption operates (together with the period of any previous exemption) for longer than a period of 12 months or an aggregate period of 12 months. 47—Continuation of temporary exemptions to enable implementation of ministerial agreements (1) The purpose of this section is to create a mechanism to provide an additional period not exceeding 12 months for legislative or other action to be taken to implement a ministerial agreement arising out of consideration of an exemption under section 46. However, this subsection does not provide grounds for invalidating any regulations made for the purposes of this section. (2) This Act does not: (a) apply to the sale in an Australian jurisdiction of exempt goods; or (b) affect the operation of exempt laws of an Australian jurisdiction relating to a particular kind of goods. (3) For the purposes of this section, goods or laws are exempt if the goods are of a kind, or the laws are, for the time being declared by regulations under this Act to be exempt from the operation of this Act. (4) The Governor-General may make regulations for the purposes of this section, but any such regulations may be made only if they have the effect of continuing or reviving, wholly or partly, and with or without modification, the effect of an exemption under section 46. (5) Such a modification may only: (a) in the case of an exemption relating to goods: (i) limit the circumstances in which the goods are exempt; or (ii) provide that the exemption does not apply if certain standards or conditions are complied with in relation to the goods; or (b) in the case of an exemption relating to a law: (i) modify the operation of the law while the exemption operates; or (ii) provide that the exemption does not apply in relation to particular goods if certain standards or conditions are complied with in relation to the goods. (6) The regulations may discontinue any exemption under this section. (7) A regulation may not be made for the purposes of this section unless at least two-thirds of the then participating jurisdictions have endorsed the regulation. (8) No exemption under this section operates (together with the period of any previous such exemption) for longer than a period of 12 months or an aggregate period of 12 months after the corresponding exemption under section 46 ceases to operate. (9) In this section: ministerial agreement means an agreement of Ministers of participating jurisdictions made in relation to goods or laws that are the subject of an exemption under section 46. 48—Special exemptions (1) This Act does not affect the operation of laws of an Australian jurisdiction that relate to goods and that are specified or described in Schedule 3, to the extent that Schedule 3 indicates that they are exempt from the operation of this Act. (2) Such an exemption operates for no longer than a period of 12 months after the commencement of this section, but may be extended in whole or in part by the regulations from time to time by one or more further periods each not exceeding 12 months. (3) A regulation may not be made for the purposes of subsection (2) if the exemption has expired or has otherwise ceased to be in force. (4) The Governor-General may make regulations amending Schedule 3 for the purposes of subsection (2) or (6). (5) A regulation may not be made for the purposes of this section unless at least two-thirds of the then participating jurisdictions have endorsed the regulation. (6) However, if such a regulation merely omits any matter relating to an exemption that has expired or has otherwise ceased to be in force, the regulation may be made if the Commonwealth has endorsed the regulation. 49—Exemptions relating to occupations (1) This Act does not affect the operation of laws of an Australian jurisdiction that relate to occupations and that are specified or described in Schedule 4, to the extent that Schedule 4 indicates that they are exempt from the operation of this Act. (2) The Governor-General may make regulations amending Schedule 4. (3) A regulation may not be made for the purposes of this section unless all of the then participating jurisdictions have endorsed the regulation. (4) However, if such a regulation amends Schedule 4 by omitting a law of a State, the regulation may be made if the State has endorsed the regulation. Part 5—General 50—References to participating jurisdictions For the purposes of this Act, a participating jurisdiction is: (a) New Zealand, while there is in force an Act of its Parliament that corresponds to this Act; or (b) the Commonwealth; or (c) a State (other than a Territory) for which there is in force an Act of its Parliament that refers to the Parliament of the Commonwealth the power to enact this Act, or that adopts this Act, under paragraph (xxxvii) of section 51 of the Commonwealth Constitution; or (d) a Territory (being the Australian Capital Territory or the Northern Territory) for which there is in force an Act of its legislature that requests the Parliament of the Commonwealth to enact this Act or that enables this Act to apply in relation to it. 51—Application of Trans‑Tasman mutual recognition principle (1) The Trans‑Tasman mutual recognition principle and the provisions of this Act may be taken into consideration in proceedings of any kind and for any purpose. (2) Nothing in this Act or the Mutual Recognition Act 1992 prevents a person from relying on the Trans‑Tasman mutual recognition principle in relation to more than one Australian jurisdiction. 52—Machinery provisions regarding limitations etc. In cases where Part 3 provides that conditions or undertakings that apply or are relevant to registration in New Zealand also apply or are relevant to registration in an Australian jurisdiction, they are to be construed with any necessary adaptations, including the following (where appropriate and so far as practicable): (a) references to New Zealand are to be read as references to the Australian jurisdiction; (b) references to officers or authorities of New Zealand are to be read as references to the corresponding officers or authorities of the Australian jurisdiction. 53—Determining place of production (1) For the purpose of determining where goods are produced for the purposes of this Act, goods are taken to be produced in New Zealand if the most recent step in the process of producing the goods (including for example processing, harvesting or packaging the goods) has occurred there. (2) Subsection (1) applies even though: (a) the process of production may be incomplete; or (b) some steps in the process have not yet been carried out; or (c) some steps in the process were carried out elsewhere; or (d) the goods or a component of the goods were imported into New Zealand. 54—Commonwealth regulations for temporary exemptions Without limiting any other power under any other Act, the Governor-General may make regulations for the purposes mentioned in section 46. Schedule 1—Exclusions Note: See section 44. Part 1—Introduction 1—Excluded laws (1) The laws specified or described in this Schedule are excluded from the operation of this Act, so far as they relate to: (a) customs controls and tariffs—but only to the extent that the laws provide for the imposition of tariffs and related measures (for example, anti-dumping and countervailing duties) and the prohibition or restriction of imports; and (b) intellectual property—but only to the extent that the laws provide for the protection of intellectual rights and relate to requirements for the sale of goods set out in section 11; and (c) taxation and business franchises—but only to the extent that the laws relate to taxes imposed on the sale of locally produced and imported goods in a non-discriminatory way, including, for example, wholesale sales tax (Commonwealth) and business franchise and stamp duties (States); and (d) the implementation of international obligations—but only to the extent that the laws implementing those obligations deal with the requirements relating to the sale of goods set out in section 11. Part 2—Principles 2—Solicitation of personal information from individual concerned Where: (a) a local registration authority collects personal information under this Act; and (b) the information is solicited by the authority from the individuals concerned; the authority must ensure that the forms issued to individuals in connection with collecting the information specify: (c) the purpose for which the information is being collected; and (d) any person to whom, or any body or agency to which, it is the authority's usual practice to disclose personal information of the kind so collected, and (if known by the authority) any person to whom, or any body or agency to which, it is the usual practice of that first-mentioned person, body or agency to pass on that information. 3—Storage and security of personal information A local registration authority who has possession or control of a record that contains personal information must ensure: (a) that the record is protected, by such security safeguards as it is reasonable in the circumstances to take, against loss, against unauthorised access, use, modification or disclosure, and against other misuse; and (b) that if it is necessary for the record to be given to a person in connection with the provision of a service to the local registration authority, everything reasonably within the power of the authority is done to prevent unauthorised use or disclosure of information contained in the record. 4—Limits on use of personal information (1) A local registration authority who has possession or control of a record that contains personal information that was obtained under this Act for a particular purpose must not use the information for any other purpose unless: (a) the individual concerned has consented to use of the information for that other purpose; or (b) use of the information for that other purpose is required or authorised by or under law; or (c) use of the information for that other purpose is reasonably necessary for enforcement of the criminal law or of a law imposing a pecuniary penalty, or for the protection of the public revenue. (2) Where personal information is used for enforcement of the criminal law or of a law imposing a pecuniary penalty, or for the protection of the public revenue, the local registration authority must include in the record containing that information a note of that use. 5—Limits on disclosure for personal information (1) A local registration authority who has possession or control of a record that contains personal information must not disclose the information to a person, body or agency (other than the individual concerned) unless: (a) the individual concerned is reasonably likely to have been aware, or made aware under the principle set out in clause 2, that information of that kind is usually passed to that person, body or agency; or (b) the individual concerned has consented to the disclosure; or (c) the disclosure is required or authorised by or under law; or (d) the disclosure is reasonably necessary for the enforcement of the criminal law or of a law imposing a pecuniary penalty, or for the protection of the public revenue. (2) Where personal information is disclosed for the purposes of enforcement of the criminal law or of a law imposing a pecuniary penalty, or for the purpose of the protection of the public revenue, the local registration authority must include in the record containing that information a note of the disclosure. (3) A person, body or agency to whom personal information is disclosed under subclause (1) must not use or disclose the information for a purpose other than the purpose for which the information was given to the person, body or agency. An Act to provide for the recognition within Australia of regulatory standards adopted in New Zealand regarding goods and occupations [Assented to 7 December 1997]

The core legal concepts incorporated into South Australian law by this enactment are mutual recognition for goods and mutual recognition for occupations, plus a detailed system of exclusions, permanent and temporary exemptions, regulatory machinery, information exchange and review mechanisms. The Commonwealth Act (adopted by the State Act) frames these concepts into operational rules.

Mutual recognition for goods: Part 2 sets the Trans‑Tasman mutual recognition principle for goods, which declares that goods produced in or imported into New Zealand that may lawfully be sold in New Zealand may, by virtue of the Act, be sold in an Australian jurisdiction without additional local requirements that would otherwise relate to the sale (s 10). Section 11 lists the types of local requirements that do not need to be complied with, including production standards, labelling and inspection requirements at the point of sale. The principle is subject to specified exceptions in s 12, for example laws regulating the manner of sale or seller conduct that apply equally to local and imported goods, transport and storage laws directed at health, safety or environmental protection, and inspection regimes that are not prerequisites to sale.

Mutual recognition for occupations: Part 3 establishes the occupational equivalent. A person registered in New Zealand for an occupation is, upon lodging the prescribed notice, entitled to registration in the equivalent Australian occupation, and pending substantive registration is taken to have deemed registration that permits immediate practice within limits (ss 16, 18, 19, 24). The notice requirements are detailed in s 18, including statements about disciplinary actions, certification of the instrument evidencing registration and a statutory declaration. Local registration authorities must grant registration within one month, subject to limited postponement or refusal grounds (s 20). Deemed registration continues until cancelled, suspended, replaced by substantive registration, or ceases under specified conditions (s 25). Conditions may be imposed to achieve equivalence, but not more onerous than would apply in similar circumstances under local law, unless they mirror New Zealand conditions or are necessary for equivalence (s 19(5), s 26(5)).

Equivalence and declarations: Division 4 (ss 27-31) provides for determination of equivalence between New Zealand and Australian occupations. The Australian Tribunal can make declarations on review (s 30), and Ministers may jointly declare equivalence (s 31). Ministerial declarations prevail over Tribunal declarations if inconsistent (s 29(2)). A Tribunal declaration on health, safety or environmental grounds is time‑limited to 12 months (s 30(4)).

Exclusions and exemptions: Part 4 and Schedules 1-4 identify categories of laws and subject matter excluded from the Act, permanently exempted, or subject to temporary or special exemptions. Schedule 1 contains exclusions including customs, intellectual property and taxation areas; Schedule 2 lists permanent exemptions like quarantine and endangered species and a range of sectoral laws by jurisdiction; Schedule 3 lists special exemptions including therapeutic goods, hazardous substances, radiocommunications, vehicles and gas appliances; Schedule 4 exempts certain occupational laws such as those governing medical practitioners. Temporary exemptions are strictly time limited, generally to 12 months (ss 46-48).

Information and privacy: Sections 37-39 impose duties to furnish and receive information among local registration authorities, with ss 37(3) expressly empowering authorities to provide information despite secrecy, confidentiality or privacy laws. Schedule 5 prescribes principles for solicitation, storage, use and disclosure of personal information; however, ss 39(4)(b)-(c) state that these do not create civil causes of action or affect validity of decisions.

Review and enforcement mechanisms: The Australian Tribunal has review jurisdiction under s 33, including powers to make orders and declarations under Division 4; it may order costs under s 34. Local registration authorities retain disciplinary powers and must give effect to reciprocal disciplinary outcomes under s 32. Fees relating to registration under the mutual recognition regime are subject to caps: they may not exceed fees applicable apart from the Act (s 40).

Participating jurisdictions and scope: The Act applies only while a State is a participating jurisdiction, see s 6; s 50 defines participating jurisdictions, including New Zealand only while its corresponding Act remains in force. Section 5 establishes the Commonwealth Act takes precedence over other Commonwealth laws unless those expressly override the Trans‑Tasman Act, and does not affect the Mutual Recognition Act 1992 except as provided.

These concepts form a tightly specified mechanism for cross‑border regulatory recognition between New Zealand and Australian jurisdictions, with express procedural timeframes, evidence and notice requirements, public safety carve‑outs, and sectoral exceptions set out in the Schedules.

The adopted Commonwealth Act, as made applicable in South Australia under s 4, alters rights and obligations for a range of actors. The principal affected groups are identified in the text and Schedules.

Individuals and businesses selling goods produced in or imported into New Zealand: Part 2 (ss 9-14) creates an entitlement to sell in an Australian jurisdiction goods lawfully sold in New Zealand, without further local sale‑related requirements listed in s 11, subject to exceptions in s 12 and the exclusions and exemptions in Schedules 1-3. Sellers who rely on mutual recognition face specific evidentiary requirements in defence to offences under s 13, notably labelling at point of sale and absence of reasonable grounds to suspect non‑compliance with New Zealand law.
Occupation holders registered in New Zealand: Part 3 (ss 15-41) directly affects New Zealand‑registered practitioners seeking to carry on equivalent occupations in South Australia. They must lodge the notice prescribed by s 18, supply evidencing documents, verify statements by statutory declaration, and consent to enquiries and information exchange. On lodging the notice, they obtain deemed registration (s 24) and entitlement to substantive registration (s 19), subject to time limits and grounds for postponement or refusal (ss 20-22).
Local registration authorities in South Australia: These bodies acquire duties under ss 19, 20, 21, 22 and 39. They must grant registration within one month unless postponement or refusal is validly invoked (s 20); they must furnish information to other participating jurisdictions when reasonably required (s 37); they must prepare and make available guidelines within six months of commencement (s 39(2)-(3)); they are empowered to impose conditions and fees subject to caps (s 19(5), s 40). They also must handle personal information in accordance with Schedule 5 and s 39(4).
Consumers and clients in South Australia: The regime changes the legal status of goods and service providers from New Zealand, potentially increasing the supply of goods and availability of professionals. Consumer protection and public safety laws operating as exceptions continue to apply, see s 12.
Ministers and the Governor: The Act gives designated persons specific roles. The Governor of South Australia can fix the day on which adoption terminates by proclamation (s 4(3)), and the Governor may make regulations for temporary exemptions under s 5. At Commonwealth level, the Governor‑General may make regulations under s 54, and Ministers may jointly declare equivalence of occupations under s 31. The designated person concept is defined in the Commonwealth Act’s interpretation provisions (see definition of designated person in the Appendix).
Australian Tribunal and New Zealand Tribunal: The Australian Tribunal has review jurisdiction over local registration authority decisions under s 33, and may include representation from the New Zealand Tribunal under s 35. Tribunal decisions and ministerial declarations have specified interplay, including a ministerial declaration prevailing if inconsistent with a Tribunal declaration (s 29(2)).
Sectors specifically carved out by the Schedules: The Act’s Schedules list exclusions and exemptions affecting specialised interests. For example, quarantine and endangered species laws are permanent exemptions (Schedule 2, Part 1); therapeutic goods, hazardous substances, radiocommunications, motor vehicle standards, and gas appliances are listed in Schedule 3 as special exemptions; a wide set of laws relating to firearms, gaming, indecent material and ozone protection are listed by jurisdiction in Schedule 2, Part 2. Schedule 4 exempts laws concerning medical practitioners.
Government agencies and registration authorities in other participating jurisdictions: The Commonwealth Act applies between participating jurisdictions; s 50 defines them and s 6 makes the Act applicable to a State only while it is a participating jurisdiction. Therefore interstate and interjurisdictional administrative processes, information exchange, and endorsement thresholds for regulations under Part 4 affect how the mutual recognition machinery operates across jurisdictions.
Parties to disciplinary proceedings: Section 32 binds the outcome of New Zealand disciplinary action to the equivalent registration in Australia unless the local authority chooses to reinstate or waive consequences. Section 26(3)(b) applies local disciplinary regimes to persons with deemed registration.

The Act therefore touches commercial exporters and importers, professional services providers from New Zealand, state registration authorities, tribunals, executive officials capable of making declarations and regulations, and specific regulated sectors listed in the Schedules. The practical effect is highly contingent on whether particular goods or occupations are captured by exclusions or exemptions, and on the administrative response of local registration authorities and Ministers.

The adopted Commonwealth Act defines precise duties and rights for multiple actors. Below are the principal ones with their statutory bases.

Entitlements for sellers of goods:

Right to sell: Goods produced in or imported into New Zealand and lawfully sold there may be sold in an Australian jurisdiction without complying with additional sale‑related local requirements as specified in s 10 and s 11. This right is subject to exceptions in s 12 and the Schedules.
Defence to prosecution: A person prosecuted under a law of an Australian jurisdiction for sale‑related offences may assert the Trans‑Tasman mutual recognition defence in s 13, by showing labelling at point of sale that the goods were produced or imported into New Zealand, and that the defendant had no reasonable grounds to suspect otherwise (s 13(1)). The defence is unavailable if the prosecution proves the principle did not apply (s 13(2)).

Entitlements and duties for New Zealand‑registered practitioners:

Entitlement to registration and practice: A person registered in New Zealand is, on providing the notice required by s 18, entitled to be registered in the equivalent Australian occupation and, pending substantive registration, to carry on the occupation under deemed registration (ss 16, 19, 24).
Notice content duties: Section 18 sets eight specific matters the notice must state, including that the person is registered in New Zealand, the occupations sought, all participating jurisdictions where the person has substantive registration, absence of disciplinary proceedings, consent to information exchange, and certification of the instrument evidencing registration (s 18(2)-(4)). The statements must be verified by statutory declaration (s 18(5)).
Time limits for decision: Local registration authorities must grant registration within one month after the notice is lodged, and when granted, registration takes effect as from the date of lodgement (s 20(1)-(2)). If no action is taken within one month, entitlement to registration vests automatically unless fraud is involved (s 20(4)).

Authorities’ duties and limits:

Postponement and refusal grounds: A local registration authority may postpone or refuse registration in prescribed circumstances: materially false statements, missing or false documents, materially changed circumstances, or non‑equivalence of occupations (s 21(1), s 22(1)).
Limits on conditions and fees: Authorities may impose conditions, but not more onerous than those that would be imposed in similar circumstances if registration were effected apart from the Act, unless they correspond to New Zealand conditions or are necessary for equivalence (s 19(5), s 26(5)). Fees may be imposed but may not exceed those applicable apart from the Act (s 40(1)); the Act does not authorise a tax (s 40(4)).
Duties to facilitate and inform: Authorities must facilitate operation of Part 3, make use of their power to impose conditions to promote the mutual recognition principle, and prepare and make available guidelines and information within six months (s 39(1)-(3)). They must also handle information in line with Schedule 5 privacy principles (s 39(4)).

Deemed registration rights and limits:

Immediate practice: Deemed registration takes effect on lodgement and permits the person to carry on the occupation as if substantively registered, subject to limits in s 26(2), insurance and public protection requirements in s 26(3)(a), and applicable disciplinary provisions (s 26(3)(b)).
Duration limits: Deemed registration continues until cancelled, suspended, ceases on substantive registration, or if the person ceases to be substantively registered in every other participating jurisdiction mentioned in the notice (s 25).

Information exchange and privacy duties:

Furnishing information: Local registration authorities must furnish without delay information reasonably required by another participating jurisdiction about substantively registered persons where the receiving authority notifies that the information is required in connection with a notice, deemed registration, or disciplinary action (s 37(1)-(2)). Section 37(3) permits furnishing despite secrecy or privacy laws.
Limits on use and disclosure: Schedule 5 imposes principles on solicitation, storage, limits on use and limits on disclosure of personal information collected under the Act (Schedule 5, clauses 2-5). However, s 39(4)(b)-(c) clarifies that Schedule 5 does not create civil causes of action or give rise to enforceable rights.

Disciplinary consequences and review:

Reciprocity on disciplinary grounds: If a person’s New Zealand registration is cancelled, suspended, or made subject to disciplinary conditions, the person’s registration in the equivalent Australian occupation is affected in the same way, unless the local authority reinsists or waives (s 32(1)-(2)).
Right to review: Decisions by local registration authorities under the Act can be reviewed by the Australian Tribunal (s 33). The Tribunal may make orders and declare non‑equivalence under Division 4 (s 30), and may award costs if a party has acted unreasonably (s 34).

Exclusions, exemptions and regulatory declaration powers:

The Act lists exclusions and exemptions in Schedules 1-4 and provides mechanisms for permanent, temporary and special exemptions under Part 4 (ss 44-49). The Governor‑General and Governors have regulatory powers to operate those exemptions, subject to endorsement thresholds by participating jurisdictions (for example s 44(3), s 45(4), s 47(7), s 48(5)).

Precedence and interaction with other Commonwealth laws:

The Commonwealth Act has effect despite other Commonwealth laws enacted or made before its commencement, and later Commonwealth laws are to be construed as subject to it unless they expressly override it (s 5(1)). The Act does not affect the operation of the Mutual Recognition Act 1992 except as provided (s 5(2)).

These duties and rights create a detailed administrative and evidentiary regime for market access by New Zealand goods and occupations, while preserving specific public safety and policy exceptions. Compliance duties fall on both applicants and local authorities, with temporal constraints and documentary verification central to the regime.

The South Australian Act itself primarily functions to adopt the Commonwealth Act and does not introduce new criminal penalties; rather, enforcement and penalty regimes are largely left to existing local laws and the Commonwealth Act’s procedural safeguards. The adopted Commonwealth Act allocates enforcement functions across existing regulatory and disciplinary mechanisms, while prescribing specific procedural consequences.

Defensive statutory protection for sellers: Section 13 provides a statutory defence in prosecutions for offences under an Australian jurisdiction’s sale laws where a defendant asserts the Trans‑Tasman mutual recognition principle. To rely on the defence the defendant must show point-of-sale labelling that goods were produced in or imported into New Zealand and must establish absence of reasonable grounds to suspect otherwise (s 13(1)). The Crown may rebut the defence by proving the principle did not apply because the goods did not comply with New Zealand requirements (s 13(2)). The section makes New Zealand evidentiary presumptions and defences available to parties in Australian proceedings (s 13(3)-(4)). Thus, the Act does not remove local criminal sanctions, but provides a tailored evidentiary defence and cross‑jurisdictional evidentiary rules.

Disciplinary and administrative enforcement for occupations: Part 3 embeds reciprocal disciplinary consequences (s 32). If registration in New Zealand is cancelled, suspended or made subject to conditions for disciplinary reasons, the person’s registration in the equivalent Australian occupation is affected in the same way (s 32(1)). Local authorities may nevertheless reinstate cancelled or suspended registration or waive conditions (s 32(2)). Persons with deemed registration are subject to local disciplinary provisions applicable to substantively registered persons (s 26(3)(b)). These provisions thread enforcement through existing local disciplinary frameworks rather than creating a new enforcement machine.

Review and remedial processes: The Australian Tribunal has specific powers for review of local registration authority decisions under s 33. On review, the Tribunal may make orders as it considers appropriate (s 30(1)); it may declare occupations not equivalent in limited circumstances under s 30(2), and declarations based on s 30(2)(b), that is health, safety or significant environmental risk grounds, are time limited to 12 months (s 30(4)). The Tribunal may order costs against a party that has acted unreasonably under s 34. Decisions by local registration authorities must include notification of review rights and, where required, reasons in accordance with the Administrative Appeals Tribunal Act 1975 (s 33(3)).

Regulatory sanctions: The Act leaves intact existing penalties in local laws that fall within the exceptions and preserved areas. Part 2, s 12 preserves laws regulating the manner of sale and conduct of sellers where those laws apply equally and are not based on qualifications. Similarly, many safety and health‑oriented obligations are preserved as exceptions (s 12(3)-(4)). Therefore enforcement of such local laws and their penalties continues unaffected where the statutory exceptions apply.

Information sharing and confidentiality enforcement: Section 37 empowers local registration authorities to provide information despite any secrecy, confidentiality or privacy law (s 37(3)). However, when an authority receives information it is subject to the receiving jurisdiction’s secrecy or privacy law (s 38). Schedule 5 sets limits on use and disclosure, with mandatory record notes where information is used or disclosed for criminal enforcement or public revenue protection (clauses 4-5). Schedule 5 explicitly states that its principles do not give rise to civil causes of action, nor do they affect the validity of decisions under the Act (Schedule 5, Part 2, clause 4).

Exemptions and regulatory instruments: Enforcement risk is also shaped by the Part 4 machinery for exclusions and exemptions. Permanent exemptions in Schedule 2 and special exemptions in Schedule 3 remove mutual recognition operation in specified domains; temporary exemptions are limited to 12 months (s 46), and continuation of temporary exemptions for ministerial implementation is also time capped (s 47). Regulations for temporary exemptions require endorsements by specified thresholds of participating jurisdictions (for example s 44(3), s 45(4), s 47(7), s 48(5)). The procedural rules for making such regulations can therefore affect the scope of enforcement for particular sectors.

Precedence: Section 5(1) provides that the Commonwealth Act has effect despite other existing Commonwealth law and that later Commonwealth laws are to be construed subject to it unless they expressly override it. That provides a statutory precedence that shapes enforcement priorities for Commonwealth instruments interacting with the Trans‑Tasman regime.

In short, enforcement under the adopted regime is handled through existing state and Commonwealth penalty regimes for regulated goods and occupations, supplemented by the Act’s evidentiary defence for goods, reciprocal disciplinary rules for occupations, tribunal review powers and structured mechanisms for exemptions which can limit or reinstate enforcement in particular domains. The Act does not create a standalone penal code; it integrates mutual recognition into prevailing regulatory enforcement frameworks while setting procedural constraints and review paths.

The Commonwealth Act, adopted by the South Australian Act, is expressly drafted to operate within the broader Commonwealth and State legal frameworks. The text contains multiple provisions that define interactions, precedence, exceptions and limits.

Precedence and Commonwealth‑State relations:

Section 5(1) states that the Commonwealth Act has effect despite anything in any other law of the Commonwealth enacted or made before its commencement, and subsequent Commonwealth laws are to be construed as subject to this Act, except where a law expressly overrides it. This provides the Act statutory primacy over pre‑existing Commonwealth laws and sets a construction rule for later Commonwealth laws.
Section 6 limits the Act’s operation to States that are participating jurisdictions and provides that it does not affect laws of a State so far as they can operate concurrently. Therefore the Act is fitted into the federal structure via participation choices by States and Territories (s 50).

Interaction with the Mutual Recognition Act 1992:

Section 5(2) records that, subject to s 51(2) (a technical reference in the Commonwealth Act), nothing in the Trans‑Tasman Act affects the operation of the Mutual Recognition Act 1992. Practitioners must therefore consider both regimes where interstate and Trans‑Tasman recognition overlap.

Exclusions and carved‑out fields:

Schedules 1-4 explicitly exclude or exempt a large range of subject matter from the Act’s operation. Schedule 1 lists excluded laws in matters such as customs, intellectual property and taxation; Schedule 2 lists permanent exemptions including quarantine and endangered species and sectoral laws by jurisdiction; Schedule 3 lists special exemptions such as therapeutic goods and motor vehicle standards; Schedule 4 exempts certain occupational laws such as those regulating medical practitioners. These Schedules govern where other laws continue to operate without displacement. Section 44-49 set the processes for amendment of the Schedules and threshold endorsement requirements for regulations altering exclusions or exemptions (for example s 44(3), s 45(4), s 47(7), s 48(5)).

Regulatory and ministerial declarations:

Division 4 of Part 3 (ss 27-31) governs the relationship between Tribunal determinations and ministerial declarations regarding equivalence of occupations. Notably, where a Tribunal and a joint ministerial declaration are inconsistent, the ministerial declaration prevails (s 29(2)). Ministerial declarations apply only in participating jurisdictions concerned (s 31(3)), and the local registration authority must give effect to the declaration (s 31(4)).

Information law and privacy interactions:

Section 37(3) authorises provision of information despite any law relating to secrecy, confidentiality or privacy. However, s 38 places received information under the receiving jurisdiction’s secrecy and privacy laws, and Schedule 5 prescribes principles governing solicitation, storage, use and disclosure of personal information obtained under the Act. Schedule 5 also clarifies limits on enforceability: its principles do not create judicially enforceable rights or civil causes of action (Schedule 5, Part 2, clause 4).

Administrative law and review:

Decisions by local registration authorities under the Act are subject to review by the Australian Tribunal under s 33, which operates with the Administrative Appeals Tribunal Act 1975. Section 33 requires notices of decisions to state review rights and availability of statements of reasons, and s 34 permits the Tribunal to order costs if a party acted unreasonably. Tribunal review interacts with administrative law doctrines and procedural requirements in the Administrative Appeals Tribunal Act.

Disciplinary regimes and reciprocity:

Section 32 provides that disciplinary action taken in New Zealand affects Australian registrations in the same way, subject to local authorities’ power to reinstate or waive. Local disciplinary frameworks therefore retain important force and interact directly with overseas regulatory outcomes.

Temporary exemptions and international obligations:

Sections 46-48 allow temporary and special exemptions, but these are constrained by purpose clauses specifying protection of health, safety and environment and strict time limits (no longer than 12 months in aggregate, ss 46(4), 47(8)), and endorsement thresholds for regulations (e.g. s 47(7)). The Schedules also carve out laws implementing international obligations such as the Convention on International Trade in Endangered Species (Schedule 1, Part 2), which remain effective to the extent they implement such obligations.

Practical contract and compliance consequences:

For private parties, the mutual recognition principle changes substantive compliance costs where goods or services fall within the regime, but it does not displace contractual obligations or laws that regulate the manner of sale, business conduct, or safety and environmental protections (s 12). Local registration formalities requiring personal attendance are expressly disallowed as prerequisites for registration under the mutual recognition regime (s 41).

In sum, the Act is an overlay that interacts with, and is constrained by, other Commonwealth, State and international laws. It provides primacy over some Commonwealth laws, preserves other laws through explicit Schedules, channels review and declaratory power through tribunal and ministerial instruments, and sets rules for information exchange that must be reconciled with local privacy regimes. Practitioners must therefore read the Trans‑Tasman text alongside relevant sectoral statutes listed in the Schedules and the Administrative Appeals Tribunal framework.

The South Australian enactment itself is short and primarily references the Commonwealth Act. The provided legislative history identifies the following recorded amendments and dates.

Original passage and commencement:

The Trans‑Tasman Mutual Recognition (South Australia) Act 1999, No. 27 of 1999, received assent on 1 April 1999 and commenced on 23 September 1999 (Gazette 23.9.1999 p1209), as recorded in the legislative history.

2004 amendment (Removal of Sunset Clause):

The Trans‑Tasman Mutual Recognition (South Australia) (Removal of Sunset Clause) Amendment Act 2004, No. 38 of 2004, received assent and commenced on 5 August 2004. The legislative history entry states that provisions amended include s 2 being omitted under the Legislation Revision and Publication Act 2002, and s 4 being substituted (with s 4(2) substituted and s 4(3) inserted) by s 3 of the amending Act, with the changes commencing on 5 August 2004. The 2004 Act's short title indicates its object was removal of a sunset clause; the legislative history confirms substitution and insertion in s 4, which in the current text provides for adoption of the Commonwealth Act and for the Governor to fix the day on which the adoption will terminate (s 4(3)).

Consequential textual effects in this version:

The current South Australian s 4(1) adopts the Commonwealth Act and any amendments made to it by regulations, and s 4(2) clarifies the commencement period for the adoption, noting the adoption commences on the day the State Act comes into operation but not so as to give effect to any adopted provision before it comes into operation under the Commonwealth Act. Section 4(3), inserted by the 2004 amending Act, grants the Governor a proclamation power to fix the adoption termination day. These textual details record the post‑2004 legislative form adopted in the parliamentary amendments.

Other recorded adjustments:

The legislative history also notes that s 2 was omitted under the Legislation Revision and Publication Act 2002, as part of routine revision. No further amendments of substance to the text of the Commonwealth Act as adopted are recorded in this South Australian legislative history entry.

Status and expiry:

The South Australian Act retains an expiry provision at s 6, stating the Act expires at the end of the period for which the Commonwealth Act is adopted under s 4. The 2004 amendment described as "Removal of Sunset Clause" suggests prior arrangements that limited the Act’s duration were altered; the current text however preserves the mechanism whereby the Governor may fix the termination day for the adoption (s 4(3)), and the State Act will expire when that adoption ends (s 6).

Implications for practice:

Practitioners should note the textual history recorded, in particular the 2004 amendment. Changes to the Commonwealth Act itself, and any regulations made under it, are adopted in South Australia by s 4(1)(b) to the extent prescribed. The Governor’s proclamation power to terminate the adoption, and the possibility of future regulations for temporary exemptions under s 5, mean that the State’s adoption can be modified or ended administratively, subject to the statutory mechanics.

The source does not record further amendments in the provided text. Any practice note should monitor Commonwealth-level amendments to the Trans‑Tasman Mutual Recognition Act 1997, and any State proclamation or regulations made under ss 4 and 5 of the South Australian Act, since s 4 adopts Commonwealth amendments by regulation and s 5 authorises State regulations for temporary exemptions.

The source material supplied does not record any reported litigation or case law arising under either the South Australian adoption Act or the Commonwealth Trans‑Tasman Mutual Recognition Act 1997. The appendix reproduces the Commonwealth Act and its procedural review routes, but the legislative text itself does not cite or summarise case law. Consequently, there are no decisions named in the Act or in the South Australian legislative history provided.

What the Act supplies instead are the statutory dispute resolution pathways and administrative review mechanisms that a litigant would use. Those mechanisms frame the litigation approach and are therefore relevant to any analysis of potential or actual disputes.

Tribunal review and remedies:

Section 33 provides that, subject to the Administrative Appeals Tribunal Act 1975, applications may be made to the Australian Tribunal for review of decisions of local registration authorities in relation to their functions under the Act. The Tribunal’s powers under Division 4 permit it to make orders determining entitlement to registration or equivalence of occupations (s 30(1)), to declare occupations not equivalent in limited circumstances (s 30(2)), and to specify conditions (s 30(1)).
The Tribunal may order costs if a party has acted unreasonably (s 34). The Administrative Appeals Tribunal Act 1975 frames the Tribunal’s procedures, and s 33(3) of the Trans‑Tasman Act imposes requirements that notices of decisions include statements about review rights and the availability of written reasons under that Act.

Interplay with New Zealand bodies:

Section 35 promotes consistency between Australian Tribunal decisions and the New Zealand Trans‑Tasman Occupations Tribunal, permitting the President of the Australian Tribunal to include New Zealand Tribunal members or nominees in reviews, and requiring regard to NZ Tribunal decisions (s 35(2)-(4)). That mechanism could influence the composition and considerations in any review, and would be material in cross‑jurisdictional proceedings.

Disciplinary and administrative avenues:

Disputes involving disciplinary measures are addressed by s 32, which makes disciplinary outcomes in New Zealand affect Australian registration in the same way, while giving local authorities discretion to reinstate or waive consequences. Enforcement challenges will therefore be pursued through local disciplinary frameworks and Tribunal review rather than fresh criminal proceedings rooted in the Trans‑Tasman statute.

Procedural constraints that shape litigation:

Time limits and mandatory administrative steps: For occupations, a local authority must grant registration within one month of notice unless it acts under s 20(3). Deemed registration begins on lodgement (s 24(1)-(2)). These statutory time constraints will shape applications for urgent or interim relief in judicial review or Tribunal proceedings.
Preservation of other law and exceptions: Schedules 1-4, and the public safety and environmental exceptions in s 12, will be central to litigation strategy where authorities refuse registration or assert exemptions. Tribunal or judicial consideration will necessarily explore whether the exceptions or particular Schedule items apply.

Privacy, disclosures and limitations on causes of action:

Schedule 5 prescribes privacy principles for handling personal information, but s 39(4) clarifies that Schedule 5 does not create civil causes of action or rights enforceable in proceedings. That has evidential and procedural implications for litigation, particularly where disclosure of information obtained under the Act is contested.

Absence of recorded cases in the source:

Because the supplied text contains no case law, practitioners must look beyond this source to Tribunal and court records to identify precedents, and to the Administrative Appeals Tribunal Act 1975 for procedural guidance. The Act’s built‑in review routes indicate the likely forums for litigation, namely the Australian Tribunal and potentially superior courts on judicial review of administrative decisions. The Act’s text provides the statutory skeleton parties will use in argument, including timeframes, notice requirements, equivalence tests (s 28), and the limited grounds on which registration may be refused or postponed (ss 21-22).

In short, the Act furnishes legislative causes of action and administrative review mechanisms but does not contain or reference litigation history in the text provided. Parties and advisers will therefore rely on Tribunal practice and any relevant case law outside this instrument when assessing precedential outcomes.

The text contains several procedural and substantive traps for the unwary, where paperwork, timing, and subject‑matter carve‑outs materially determine legal outcomes. These are concrete mechanisms, grounded in the statutory text, that create compliance risk or unexpected loss of entitlement.

One‑month deadline and deemed registration effect: A New Zealand‑registered person lodging a notice under s 18 acquires deemed registration immediately (s 24(1)-(2)) and the local authority must grant registration within one month (s 20(1)). If the local registration authority fails to act within that month, the person is automatically entitled to registration at the end of the period, and objections are limited (s 20(4)). Practitioners must track lodgement dates precisely; failure to do so risks lost opportunities to seek interim relief or to challenge a postponement within statutory windows.
Strict notice contents and statutory declaration: Section 18 prescribes detailed contents of the notice, including statements about disciplinary proceedings, lists of participating jurisdictions where substantive registration is held, certification of evidencing instruments, and consent for enquiries. Those statements must be verified by statutory declaration (s 18(5)). Materially false or missing information is an express ground for postponement or refusal (s 21(1)(a)-(b), s 22(1)(a)-(b)). Small documentary lapses can trigger refusal windows, and the authority may permit amendment only at its discretion (s 18(6)).
Deemed registration limits and cessation: Deemed registration can cease in several ways that may not be intuitively obvious: it ends if the person becomes substantively registered in the jurisdiction (s 25(2)), if the local authority refuses registration (s 25(3)), or if the person ceases to hold substantive registration in every other participating jurisdiction mentioned in the notice (s 25(4)). The last condition means that losing registration elsewhere may terminate the entitlement locally, so practitioners must monitor their registration status in other jurisdictions listed in the notice.
Conditions and fee caps: Local authorities may impose conditions under s 19(5) and s 26(5), but they must not be more onerous than those applied in similar circumstances under domestic registration unless they reflect New Zealand conditions or are necessary to achieve equivalence. Fees may be charged but not exceed fees applicable apart from the Act (s 40). Advisers must compare fee schedules and condition regimes to ensure local authorities are operating within statutory bounds.
Exclusions and exemptions in Schedules: A large number of sectoral laws are listed in Schedules 1-4 as excluded or exempt (for example quarantine, therapeutic goods, motor vehicle standards, gas appliances, firearms, gaming, and medical practitioners). The presence of a Schedule item will remove mutual recognition for that subject matter or sector. Users must check the specific Schedules relevant to their goods or occupation; mutual recognition is not universal.
Temporary exemptions are time limited and require endorsement: Temporary exemptions under s 46 and continuation under s 47 operate for no more than 12 months in aggregate (s 46(4), s 47(8)), and regulations to effect exemptions can require endorsement by two thirds or all participating jurisdictions depending on context (s 47(7), s 45(4), s 44(3)). Parties cannot rely on protracted temporary exclusions; these are short term and politically contingent.
Ministerial declarations override Tribunal declarations: If an Australian Tribunal declaration under s 30 and a ministerial declaration under s 31 are inconsistent, the ministerial declaration prevails (s 29(2)). This hierarchy can produce unexpected outcomes for litigants relying on Tribunal precedent; ministerial agreements can alter equivalence outcomes in participating jurisdictions.
Information exchange despite secrecy laws, but post‑receipt privacy limits apply: Section 37(3) authorises local authorities to furnish information despite secrecy, confidentiality or privacy laws, but s 38 then subjects the received information to the receiving jurisdiction’s secrecy or privacy laws. Schedule 5 imposes principles on use and disclosure yet explicitly does not create civil causes of action (Schedule 5, clause 4). This creates complex secrecy and evidentiary dynamics in cross‑jurisdictional investigations.
Disciplinary reciprocity with limited local discretion: Section 32 binds Australian registration to disciplinary outcomes in New Zealand, but local authorities can reinstate or waive such effects (s 32(2)). The default reciprocity can have immediate practical consequences for practitioners when disciplinary action occurs overseas.
Limits on formalities requiring presence: The Act forbids formalities requiring personal attendance for substantive or deemed registration (s 41). Authorities seeking to impose in‑person requirements as a precondition for recognition may be acting beyond what the Act allows.
No private right to challenge Schedule 5 privacy principles: Schedule 5 imposes privacy principles but s 39(4)(b) states they do not give rise to civil causes of action or enforceable rights, limiting remedies for privacy breaches under the Act itself.

These are statutory mechanisms that will commonly generate disputes or compliance failures. The combination of precise documentary requirements, short administrative timeframes, sectoral carve‑outs, and cross‑jurisdictional information flows produces a compliance environment where small administrative errors or mistaken assumptions about applicability can have outsize consequences.

Compliance under the adopted Trans‑Tasman regime requires attention by both applicants (sellers of goods or New Zealand‑registered practitioners) and local registration authorities. The statutory text sets clear documentary, timing and procedural obligations. Below is a practical checklist framed to align with the statutory provisions.

For sellers of goods produced or imported into New Zealand:

Verify lawfulness in New Zealand: Ensure the goods are lawfully sold in New Zealand, because the Trans‑Tasman principle applies only to goods lawfully sold there (s 10).
Check Schedules and exceptions: Determine whether the goods or associated laws are excluded or exempt under Schedules 1-3 (for example quarantine, endangered species, therapeutic goods, hazardous substances, radiocommunications, motor vehicle standards, gas appliances and other items listed in Schedules 2-3) or fall within the exceptions in s 12. If they do, mutual recognition may not apply.
Labelling at point of sale: To preserve the statutory defence in s 13, ensure point‑of‑sale labelling states the goods were produced in or imported into New Zealand, and maintain records showing there were no reasonable grounds to suspect non‑compliance with New Zealand law.
Prepare for local safety and storage requirements: Even where mutual recognition applies, local laws regulating transport, storage or handling that are directed at health, safety or environmental protection and that apply equally may still be enforced (s 12(3)); ensure compliance where relevant.
Retain New Zealand evidence: Keep original or certified copies of instruments evidencing lawful sale or compliance under New Zealand law, as prosecution may rely on New Zealand presumptions (s 13(3)-(4)).

For New Zealand‑registered practitioners seeking to work in South Australia:

Draft the section 18 notice carefully: Include all items listed in s 18(2)(a)-(h). Confirm the occupation sought, list all participating jurisdictions where substantive registration exists, state disciplinary status, specify any conditions, and consent to enquiries. Certify accompanying documents as originals or accurate copies (s 18(3)-(4)).
Statutory declaration: Verify the required statements by statutory declaration as mandated by s 18(5).
Provide documentary evidence: Attach the instrument evidencing registration or sufficient information to identify the person and their registration. Be prepared to certify authenticity.
Time management: Lodge the notice promptly; deemed registration operates on lodgement (s 24(1)-(2)), and the local authority must grant registration within one month (s 20(1)). If the authority fails to act within one month, entitlement vests automatically (s 20(4)). Track the one‑month clock precisely.
Prepare for conditions and insurance: Be ready to comply with local requirements regarding insurance, fidelity funds or trust accounts designed to protect the public; a person with deemed registration may not carry on the occupation without complying with these protections (s 26(3)(a)).
Monitor registration status in other jurisdictions: Deemed registration ceases if the person ceases to be substantively registered in every other participating jurisdiction listed in the notice (s 25(4)). Keep registration status current.
Anticipate postponement/refusal grounds: Avoid material false or misleading statements and ensure all required documents are provided. If the local authority intends to postpone or refuse, it must do so within one month, and postponement is limited to six months (s 21(3)).

For local registration authorities and regulators:

Meet statutory timeframes and publishing duties: Grant registration within one month where appropriate (s 20(1)), issue notices of decisions with review information (s 33(3)), and prepare guidelines and information within six months of commencement for the occupations for which the authority is responsible (s 39(2)-(3)).
Limit conditions and fees within statutory bounds: When imposing conditions or fees under ss 19 and 40, ensure they are not more onerous or greater than fees and conditions that would apply apart from the Act, unless they reflect New Zealand conditions or are necessary for equivalence (s 19(5), s 40(1)).
Information exchange and privacy handling: Furnish information when reasonably required by another participating jurisdiction in connection with notices or disciplinary action, and do so notwithstanding secrecy laws where authorised by s 37(3). However, once information is received, treat it in accordance with receiving jurisdiction privacy laws and the principles in Schedule 5; keep records of use or disclosure for enforcement uses as required by Schedule 5 clauses 4-5.
Use powers to facilitate the mutual recognition principle: The authority’s duty includes facilitating the operation of Part 3 and using powers to impose conditions to promote the mutual recognition principle (s 39(1)). Prepare operational procedures to assess equivalence and determine appropriate conditions to achieve equivalence under s 28.
Handle deemed registration consequences: Apply local disciplinary provisions to persons with deemed registration as if they were substantively registered (s 26(3)(b)), and ensure any cancellation, suspension or refusal follows the statutory procedure and is notified appropriately (s 25(3), s 22).

For counsel advising on contested decisions:

Tribunal and review preparation: Be ready to use the Australian Tribunal review route under s 33 and consider inclusion of New Zealand Tribunal members under s 35 where appropriate. Note ministerial declarations can trump Tribunal declarations if inconsistent (s 29(2)).
Evidence from New Zealand law: Prepare to deploy New Zealand presumptions or defences available under s 13(3)-(4). Ensure admissibility and authentication of New Zealand instruments and the statutory declaration content in s 18.
Challenge scope: Where refusals or postponements occur, check whether grounds relied upon are listed in ss 21-22, whether equivalence was correctly assessed under s 28, and whether health, safety or environmental risk grounds for non‑equivalence under s 30(2)(b) were validly established.

Practical housekeeping for all affected parties:

Consult Schedules early: Identify whether the goods, occupation or regulatory field is affected by Schedules 1-4; mutual recognition is not universal.
Document retention: Keep originals, certified copies and statutory declarations; maintain records of labelling and date of lodgement.
Monitor regulatory instruments: Track Commonwealth and State regulations altering the Schedules or making temporary exemptions, since ss 4(1)(b) and 5 empower adoption of Commonwealth amendments and State regulations respectively.

Adhering to these steps aligns operational practice with the Act’s documentary, timing, evidence, fee and privacy prescriptions, and reduces the risk of administrative refusal, disciplinary escalation, or loss of deemed registration.
