39 General responsibilities of local registration authorities
(1) It is the duty of each local registration authority of an Australian
jurisdiction to facilitate the operation of this Part in relation to the
occupations for which the authority is responsible, and in particular
to make use of the power to impose conditions in such a way as to
promote the Trans-Tasman mutual recognition principle.
(2) It is the duty of each local registration authority of an Australian
jurisdiction to prepare and make available guidelines and
information regarding the operation of this Part in relation to the
occupations for which the authority is responsible.
(3) The first such guidelines and information are to be available within
6 months after the commencement of this section.
(4) In dealing with information obtained or to be obtained under this
Act, a local registration authority of an Australian jurisdiction must
have regard to the principles relating to information privacy set out
in Schedule 5.
(5) Nothing in subsection (4) or in Schedule 5—
(a) affects the operation or validity of any decision or other action
taken under this Act;
(b) gives rise to, or can be taken into account in, any civil cause of
action; or
(c) creates rights or duties that are enforceable in judicial or other
proceedings.
