51Offences

51 Offences (1) Subject to subsection (2), an offence against, a contravention of or a failure to comply with a provision of this Act, other than the following sections, is a regulatory offence: (a) section 29AAYD(2); (b) section 29AF(4) and (5); (c) section 29AT(1), (2), (4) and (5); (d) section 29AU(2); (e) section 30(1); (f) section 30A(1); (g) section 31(1); (h) section 49(1) and (2). (2) Part IIAA of the Criminal Code applies to an offence against the (a) section 29AAP(3); (b) section 30B(1), (2) or (3); (c) a regulation that provides that Part IIAA applies to it. Note for subsection (2) Part IIAA of the Criminal Code states the general principles of criminal responsibility, establishes general defences, and deals with burden of proof.
