19B Certain persons taken to be drivers under this Part (1) Subject to subsection (2), a person is taken to be a driver for this Part despite not driving or being in control of a vehicle if: (a) the person: (i) holds a licence, other than a learner's licence or a provisional licence; and (ii) is occupying the front passenger seat of the vehicle; and (b) the vehicle is being driven by a learner driver. (2) A person is not taken under subsection (1) to be a driver for this Part if the person is a driving instructor.
