Tradex Scheme Regulations 2018

The instrument works by defining and refining a small set of legal concepts that the Act uses. The instrument itself supplies some definitions and cross‑references others to the Act and the Customs Act 1901.

• Nominated goods. The instrument refers repeatedly to “nominated goods” but does not redefine the term; it relies on the definition in the Act (s 5, note). The operative rules in the instrument set criteria for when nominated goods qualify under the Act’s paragraph 5(1)(b) and paragraph 5(2)(b) requirements (s 6).

• Consumed or used. The instrument does not reproduce the Act’s definition of “consumed or used”, but expressly states that the meaning given by subsection 21(6) of the Act applies (s 5). The instrument supplements that definition by listing specific permitted forms of consumption or use which will not count as consumption or use under subsection 21(6) (s 8).

• Core criteria for intended/not intended use. Section 6 operationalises the Act’s paragraph 5 criteria. For paragraph 5(1)(b) (intended use), the instrument requires that nominated goods “must not be intended to be consumed or used in Australia” (s 6(1)). For paragraph 5(2)(b) (actual use), nominated goods “must not have been consumed or used in Australia” (s 6(2)). Those are gating conditions for qualifying as nominated goods under the Act.

• Valuation. For calculating an amount of tradex duty (and related purposes), the instrument fixes the relevant measure of value as the customs value under Division 2 of Part VIII of the Customs Act 1901 (s 7). The instrument thereby imports the customs valuation regime into tradex duty calculations, rather than using an independent valuation rule.

• Permitted consumption/use exceptions. Section 8 lists five specific categories of consumption or use that, when limited to the circumstances described, do not count as consumption or use for subsection 21(6) of the Act. These are: accidental damage, accidental destruction, inspection or exhibition before export, incidental use immediately before export, and limited writing on traveller’s cheques (s 8(1)). The section also creates a negative condition: the permitted use is not permitted if the goods are subsequently further consumed or used in Australia in a way not permitted by the section (s 8(2)).

• Administrative refund requirements. Section 9 prescribes the minimum content and recipient of a refund request under subsection 42A(1) of the Act: deliver to the Secretary and include the relevant tradex order reference number and sufficient evidence to satisfy the Secretary as to the amount of refund (s 9(a)-(b)(ii)).

• Repeal of prior regulations. Schedule 1 repeals the Tradex Scheme Regulations 2008 (Schedule 1).

The instrument therefore creates a conceptual architecture that (a) identifies qualifying nominated goods by intention and actual use, (b) ties duty calculations to customs valuation, (c) narrows what counts as consumption/use by listing permitted exceptions, and (d) prescribes a basic administrative pathway for refund claims. Each of these concepts is explicitly anchored to a section of the instrument and, where relevant, to specific subsections of the Act or the Customs Act 1901.

The instrument affects identifiable classes of actors. The plain text identifies “persons” in multiple places and explicitly makes the Secretary the administrative counterparty for certain procedures (s 5 note; s 9(a)). The instrument therefore allocates duties and rights across public administration and private actors involved in importation and tradex orders.

• Importers and owners of nominated goods. The primary private parties affected are those who import goods that are or could be nominated goods under the Act. The instrument imposes eligibility criteria on nominated goods (s 6), affects the valuation basis used to calculate tradex duty on those goods (s 7), and constrains the circumstances in which consumption or use in Australia will be treated as permissible (s 8). Those practical rules affect decisions by importers, shippers and consignees about handling, inspection, temporary display, and immediate pre‑export use.

• Persons seeking refunds. Section 9 addresses any “person” seeking a refund under subsection 42A(1) of the Act. Such persons must give a request to the Secretary and include the tradex order reference number and sufficient evidence to satisfy the Secretary about the refund amount (s 9). That places recordkeeping and evidentiary burden on claimants.

• The Secretary. The instrument repeatedly places administrative power in the Secretary. Refund requests must be “given to the Secretary” and must include sufficient evidence “to satisfy the Secretary” as to the refund amount (s 9(a), (b)(ii)). The Secretary is therefore the decision maker for refunds under the Act, at least as contemplated by the instrument, and has a gatekeeping role in assessing sufficiency of evidence.

• Customs and valuation authorities. By tying tradex duty valuation to the Customs Act 1901 (s 7), the instrument draws in customs valuation authorities and processes. Agencies responsible for administering customs valuation rules will be relevant to computing tradex duty.

• Travel and financial service customers who use traveller’s cheques. Section 8(1)(e) explicitly references traveller’s cheques and narrowly permits writing on them in Australia except for countersigning the cheques in exchange for goods, services or cash. That affects the behaviour of travellers, banks and financial institutions who handle traveller’s cheques in relation to nominated goods.

• Entities previously regulated under the Tradex Scheme Regulations 2008. The Schedule 1 repeal removes the earlier instrument and transfers regulatory effect to the 2018 instrument; any parties accustomed to the 2008 regulations must now follow the 2018 provisions (Schedule 1).

In short, the instrument affects importers and their advisers, persons applying for refunds under the Act, administrators who assess customs valuation and refunds (the Secretary), and any parties involved in inspection, exhibition or incidental use of nominated goods in Australia. It assigns decision authority to the Secretary for refund assessment and imports customs valuation practice into tradex duty computations, thereby affecting how customs officials and administrators interact with importers over tradex matters.

The instrument assigns limited but specific duties and recognisable procedural rights. It operates mostly by clarifying eligibility and administrative steps under the Act rather than by creating independent substantive offences or new tax rates.

Duties imposed on private parties

• Duty to ensure nominated goods are not intended to be consumed or used in Australia. The instrument declares that for the purpose of paragraph 5(1)(b) of the Act nominated goods “must not be intended to be consumed or used in Australia” (s 6(1)). That imposes a pre‑importation compliance duty on the person nominating goods to ensure intention is demonstrable and documented.

• Duty that nominated goods must not have been consumed or used in Australia. For paragraph 5(2)(b) of the Act, nominated goods “must not have been consumed or used in Australia” (s 6(2)). This imposes an evidential duty after arrival to show the goods were not consumed or used.

• Duty to calculate tradex duty using customs value. The instrument requires using the customs value as defined in Division 2 of Part VIII of the Customs Act 1901 for purposes of subsection 21(2) of the Act (s 7). Practically, that requires compliance with customs valuation procedures and records for valuing goods.

• Duty to limit permitted consumption/use to narrow categories. Where certain consumption or use is allowed (s 8(1)), it is conditional and limited. If goods undergo further consumption or use in Australia not permitted by s 8, that negates the permitted status (s 8(2)).

• Procedural duty for refund applicants. A person requesting a refund under subsection 42A(1) of the Act must give the request to the Secretary and include the tradex order reference number and “sufficient evidence to satisfy the Secretary as to the amount of refund” (s 9). That imposes a recordkeeping and evidentiary duty.

Rights and administrative positions

• Right to request refund. Section 9 recognises a procedural right to seek a refund under subsection 42A(1) of the Act. The regulation prescribes minimum contents and recipient for a valid request (s 9).

• Right to rely on permitted uses. The listed permitted forms of consumption or use (s 8(1)) give a limited right to have those limited in‑Australia actions not count as consumption or use for the purposes of subsection 21(6) of the Act, provided conditions are met.

• Secretary’s evaluative role. The instrument grants the Secretary an explicit evaluative role. Refund requests must supply “sufficient evidence to satisfy the Secretary” about entitlement and amount (s 9(b)(ii)). That creates an administrative right for the Secretary to assess sufficiency and a practical duty for applicants to meet that standard.

Delegation and cross‑statutory duties

• Delegated or inter‑agency duties are implied by the mandatory link to customs valuation. Using customs value (s 7) means customs officers and valuation mechanisms under the Customs Act 1901 play a role in determining tradex duty amounts. The instrument implicitly requires coordination between agencies administering customs laws and the Secretary’s office.

What the instrument does not itself create

• It does not establish the rate of tradex duty or prescribe specific penalties. The instrument points to the Tradex Duty Imposition Acts for the rate and to the Act for liability consequences (s 7, note). Enforcement mechanisms and penalties therefore lie in the Act and associated legislation, not in the instrument.

In sum, the instrument establishes compliance duties around intention and actual use (s 6), sets the valuation benchmark (s 7), restricts permissible in‑Australia handling of nominated goods (s 8), and prescribes evidential and procedural content for refund applications (s 9). It positions the Secretary as the administrative assessor of refund entitlement and amount (s 9).

The instrument itself contains no express penalty provisions or enforcement sanctions. Instead, it operates as a set of regulatory specifications that integrate with the Act’s liability regime and with customs valuation mechanisms. The following points summarise how enforcement and penalties are implicated by the instrument’s provisions.

• No standalone penalty clauses in the instrument. The instrument sets eligibility, valuation and procedural rules, but does not create new offences or monetary penalties. Where the instrument refers to liability or refunds it does so by cross‑reference to the Act (for example, subsection 21(2) and subsection 42A(1) of the Act, cited in ss 7 and 9 respectively). This means enforcement of non‑compliance with the instrument’s requirements would be pursued under the Act’s enforcement provisions or other applicable legislation, not under the instrument itself.

• Administrative gatekeeping by the Secretary. Section 9 makes the Secretary the recipient of refund requests and the person to be “satisfied” about the amount of refund. That places discretionary administrative authority on the Secretary to accept or reject refund claims on evidentiary grounds (s 9(b)(ii)). The Secretary’s decision‑making may therefore be the first layer of enforcement: deficient or non‑substantiated refund claims will be rejected administratively.

• Valuation enforcement via Customs Act procedures. The instrument prescribes the customs value from the Customs Act 1901 for tradex duty computations (s 7). Customs valuation rules under the Customs Act include their own compliance and enforcement procedures; therefore enforcement of correct valuation will involve customs processes. Since tradex duty is calculated by reference to that valuation, any under‑valuation could trigger customs audit or assessment processes under the Customs Act.

• Interaction with tradex duty liability in the Act. The instrument repeatedly references subsection 21(2) and subsection 21(6) of the Act and refunds under subsection 42A(1) of the Act (ss 7, 8, 9). Liability to pay tradex duty and any penalties for non‑payment are governed by the Act and the Tradex Duty Imposition Acts; the instrument constrains the factual circumstances in which liability arises but does not itself specify penalties.

• Evidentiary burden and administrative review risk. Because s 9 requires “sufficient evidence to satisfy the Secretary as to the amount of refund” (s 9(b)(ii)), claimants carry an evidentiary burden. Rejection of a refund application can lead to further administrative or legal consequences under the Act depending on the broader statutory enforcement framework; those consequences are not set out in the instrument.

• Repeal as transitional enforcement mechanism. Schedule 1 repeals the Tradex Scheme Regulations 2008. Repealing prior regulations can affect enforcement continuity and transitional compliance obligations for regulated parties; the instrument does not specify transitional enforcement provisions but the outright repeal may require administrators to rely on the new rules for subsequent enforcement actions (Schedule 1).

In practical terms, enforcement arising from this instrument will depend on the enforcement provisions in the Tradex Scheme Act 1999 and the Customs Act 1901 and on administrative action by the Secretary. The instrument increases the importance of documentary evidence (for intention, lack of consumption or use, and refund amounts), and it places customs valuation methodology at the centre of any duty calculation questions that could trigger enforcement action.

The instrument is explicitly cross‑referential. It does not operate in isolation but imports definitions, valuation frameworks and liability mechanisms from the Act and the Customs Act 1901. The points below draw these interactions out with reference to the specific sections of the instrument.

• Tradex Scheme Act 1999. The instrument is made under the Tradex Scheme Act 1999 (s 3). Several operative provisions are direct implementations of or supplements to parts of the Act: s 6 implements paragraphs 5(1)(b) and 5(2)(b) of the Act by fixing core criteria about intention and actual use; s 8 supplements subsection 21(6) of the Act by listing permitted consumption or use for its purposes; s 7 operates for the purposes of subsection 21(2) of the Act; and s 9 prescribes procedural requirements for requests under subsection 42A(1) of the Act. Thus administrative liability, refunds and the substantive thresholds for nominated goods are defined in a relationship of complementarity with the Act.

• Customs Act 1901. Section 7 imports the customs valuation regime by stating that “the value of goods for the purposes of calculating an amount of tradex duty, or a related purpose, is the customs value of the goods within the meaning of Division 2 of Part VIII of the Customs Act 1901” (s 7). This aligns tradex duty valuation with customs valuation methodology, which will implicate customs valuation rules, documentation, potential adjustments and dispute resolution frameworks under the Customs Act. The instrument thereby creates an operational dependency on customs procedures and authorities for valuation, audits and possibly assessments.

• Tradex Duty Imposition Acts. The instrument’s note to s 7 identifies the Tradex Duty Imposition (Customs) Act 1999, the Tradex Duty Imposition (Excise) Act 1999 and the Tradex Duty Imposition (General) Act 1999 as the instruments setting the amount of tradex duty (s 7, note). The instrument therefore interacts with these Acts by providing the valuation input those Acts use to compute duty amounts.

• Administrative law principles. Although the instrument does not itself mention administrative review or merits review, it allocates discretionary assessment to the Secretary (s 9(b)(ii)). Decisions of the Secretary about sufficiency of evidence will be reviewable under general administrative law principles applicable to decisions by Commonwealth officers. The instrument’s procedural prescriptions will be relevant to any administrative review or judicial review process, even though the instrument does not itself prescribe review mechanisms.

• Repeal of earlier regulations. Schedule 1 repeals the Tradex Scheme Regulations 2008 in their entirety. That repeal means that the current procedural, valuation and permitted use rules supersede the 2008 rules. Any references in ancillary legislation to the earlier regulations will now be interpreted against the 2018 instrument where the Schedule has effect.

• Interaction with goods handling and consumer laws. The instrument permits inspection, exhibition and incidental use immediately before export (s 8(1)(c)-(d)). Those activities may engage other regulatory regimes (for example, quarantine, consumer safety or import licensing). The instrument does not displace those regimes; rather the permitted use categories operate in parallel and potentially subject to other applicable laws.

In short, the instrument is an implementing regulation that integrates the Tradex Scheme Act with customs valuation rules in the Customs Act and provides procedural detail that interacts with administrative law and other statutory regimes. The principal cross‑references are s 3 (made under the Act), s 7 (imports customs value under the Customs Act 1901), and s 9 (procedural link to subsection 42A(1) of the Act). The repeal of the 2008 regulations (Schedule 1) finalises the substitution of the new regulatory framework.

The instrument supplies its own minimal amendment history and replacement detail in a contained way. The instrument is dated 27 September 2018 and includes a commencement table. The commencement and repeal details contained in the instrument are the only amendment history provided in the text.

• Making and date. The instrument is signed and dated 27 September 2018 by the Governor‑General and the Minister for Industry, Science and Technology on the covering face of the instrument. The commencement table in section 2 states that “The whole of this instrument” commences “The day after this instrument is registered” and column 3 of the table contains the date “29 September 2018” (s 2). The instrument therefore indicates registration and commencement in late September 2018.

• Repeal of earlier regulations. Schedule 1 contains a single item repealing the entire Tradex Scheme Regulations 2008. The Schedule states: “Tradex Scheme Regulations 2008 , The whole of the instrument , Repeal the instrument.” The effect is to replace the 2008 regulations with the 2018 instrument.

• No other amendments recorded. The instrument contains no schedules that amend other instruments beyond Schedule 1’s repeal. It expressly provides in s 4 that each instrument specified in a Schedule is amended or repealed as set out in that Schedule and that any other item in a Schedule has effect according to its terms. Because Schedule 1 contains only the repeal of the 2008 instrument there are no other amendment entries within this instrument.

• Commencement note. Section 2 contains a formal commencement table and a note that the table relates only to the instrument as originally made and that it will not be amended to deal with later amendments. Section 2(2) further notes that any information in column 3 of the commencement table is not part of the instrument but may be edited in published versions; the table as published indicates the commencement date recorded above.

• No subsequent amendments recorded in the text. The instrument as provided does not include any later amendment schedules, or transitional provisions apart from the repeal. Any later amendments to the instrument would not be visible within the text unless the instrument were republished with amendment items; the instrument contains no such items.

Practically, the amendment history within this instrument is limited to the repeal of the 2008 regulations and the commencement around 29 September 2018. The instrument itself records that it is made under the Tradex Scheme Act 1999 (s 3), which remains the primary statutory source for further amendments or for the history of legislative changes to the overall tradex regime.

The instrument contains no litigation history, case references, or judicial interpretations. It does not name any cases, and the text includes no references to judicial decisions or precedent. The only references are to provisions of statutes: the Tradex Scheme Act 1999 and the Customs Act 1901, and to the Tradex Duty Imposition Acts in a note (s 7).

Because this instrument is an implementing regulation specifying definitions, valuation methodology and administrative procedure, any litigation that could arise would be under or about:

• The interpretation of the Act’s provisions (for example, subsection 21(6) or subsection 42A(1)) read in light of the instrument’s clarifications (s 6-9);

• The application of customs valuation rules from the Customs Act 1901 to tradex duty calculations (s 7); and

• Administrative decisions by the Secretary, particularly decisions about sufficiency of evidence for refunds (s 9(b)(ii)).

None of those potential litigation pathways is recorded in this instrument. The instrument’s silence means there is no source‑grounded judicial history to cite or analyse within the instrument itself. Any reported cases interpreting the instrument or its interaction with the Act would be external to the text provided and therefore are not addressed here.

If litigants challenge administrative decisions under the Act that invoke the instrument’s provisions, typical disputes would focus on factual questions (intent not to use, whether a permitted incidental use occurred), valuation disputes (application of Division 2 of Part VIII of the Customs Act 1901 as applied to tradex duty via s 7), or administrative law grounds (adequacy of reasons, sufficiency of evidence required under s 9). None of those litigation instances is recorded in the instrument.

The instrument is short but contains several practical pitfalls and evidentiary traps for regulated parties and administrators. The following points identify specific areas where compliance failure or misinterpretation could be costly, each tied to the instrument’s text.

• Intention and evidence. Section 6(1) requires that nominated goods “must not be intended to be consumed or used in Australia” for paragraph 5(1)(b) of the Act. Intention is factually established, not merely asserted. The instrument does not prescribe what evidence proves non‑intention, but the Secretary’s role under s 9 suggests documentary proof will be decisive. Failure to document commercial arrangements, contracts, export plans or shipping instructions may leave importers unable to demonstrate the required intention.

• Post‑arrival use rule. Section 6(2) requires nominated goods “must not have been consumed or used in Australia” for paragraph 5(2)(b) of the Act. Even permitted incidental uses are tightly constrained by s 8. If goods are inspected or temporarily exhibited but subsequently further used in Australia in a way not permitted by s 8, s 8(2) disqualifies the earlier permitted use. The “subsequently further consumed or used” trigger in s 8(2) can invalidate otherwise permissible actions.

• Narrow permitted uses. Section 8 lists permitted consumption or use but confines them to a few narrowly described events. “Incidental use that occurs immediately before the goods are exported” (s 8(1)(d)) is time‑limited and contingent on export actually occurring; the instrument does not define “immediately” or the degree of “incidental”, leaving a factual margin where interpretations can vary.

• Traveller’s cheques exception is limited. For traveller’s cheques, only writing on the cheques is permitted in Australia, and countersigning in exchange for goods, services or cash is specifically excluded (s 8(1)(e)). Users and issuers of traveller’s cheques must be alert that ordinary domestic encashment would fall outside the permitted exception.

• Customs valuation may diverge from commercial price. Section 7 fixes the customs value from Division 2 of Part VIII of the Customs Act 1901 as the basis for tradex duty. Custom valuation rules include adjustments and bases that may produce a different taxable base than the invoice value. Importers relying on invoice or book value without applying the customs valuation methodology risk under‑ or over‑estimating tradex duty.

• Evidence standard for refunds. Section 9 requires “sufficient evidence to satisfy the Secretary as to the amount of refund” (s 9(b)(ii)). That is a subjective sufficiency standard and vests significant gatekeeping power in the Secretary. Claimants should not assume that being able to identify a tradex order reference number is alone sufficient; substantial documentary proof will likely be required.

• Repeal of prior regulations may change practices. Schedule 1 repeals the 2008 regulations in full. Entities that previously complied under the 2008 regime should not assume prior operational practices remain valid under the 2018 instrument; check that prior compliance steps meet the stricter or differently focused requirements here.

• Administrative discretion and timing risks. Because refund requests must be given to the Secretary and the Secretary must be satisfied, timing of requests and contemporaneous documentation matter. The instrument does not prescribe time limits for making a refund request; however, missing administrative or statutory time limits under the Act (not specified here) could be consequential.

• Lack of transitional provisions. The instrument does not set out transitional arrangements for goods imported around the time of repeal/commencement. Parties who had transactions under the 2008 regulations will need to be attentive to whether their matters fall under the prior or current regime; the instrument does not provide the transitional allocation.

In short, the primary “gotchas” are evidentiary: intention, the tightness of permitted uses, the customs valuation link, and the Secretary’s subjective evidentiary standard for refunds. Each of those features can generate disputes over fact and valuation that are not resolved within the instrument’s text.

The instrument’s compliance obligations are concise. Compliance for regulated parties reduces to five practical streams: intention and documentation, handling and use practices, valuation and accounting, refund procedure and evidence, and coordination with customs processes. The instructions below cite the relevant sections.

1. Record and prove non‑intention to use or consume in Australia (s 6(1))

   • Before nominating goods, assemble contemporaneous commercial documents that show intent to export or not to use in Australia. This can include contracts of sale stipulating export destination, shipping instructions, export bookings, letters of credit conditioned on export, or other documentary proof that goods are intended to be re‑exported.
   • Because s 6(1) states that nominated goods must not be intended to be consumed or used in Australia, documentation must tie intention to the period when nomination is made and be readily producible to the Secretary if asked.

2. Prevent prohibited use and monitor permitted exceptions (s 6(2), s 8)

   • Ensure physical handling of goods while in Australia conforms to the permitted categories in s 8(1): inspection/exhibition, accidental damage/destruction, incidental immediate pre‑export use, and narrow traveller’s cheque writing.
   • If a permitted action occurs, document time, purpose and the immediate export plan. In particular, for incidental use “immediately before the goods are exported” (s 8(1)(d)), keep export evidence tightly linked to the use (shipping documentation, export declarations, carrier receipts).
   • Avoid any further consumption or use in Australia after a permitted action unless that further consumption falls within s 8. If further use occurs and is not permitted, s 8(2) will disqualify the permitted exception.

3. Use customs valuation methodology for tradex duty calculations (s 7)

   • Calculate tradex duty using the customs value defined in Division 2 of Part VIII of the Customs Act 1901 (s 7). Adopt the Customs Act valuation methodology and ensure accounting and customs declarations reflect that valuation method rather than relying solely on invoice or transfer price.
   • Keep valuation supporting documents consistent with customs valuation standards: invoices, related party transfer documents, packing lists, commissions, royalties, and any adjustments relevant under the customs valuation rules.

4. Maintain documentation to support refunds (s 9)

   • For any claim under subsection 42A(1) of the Act, prepare a refund request addressed to the Secretary and include the relevant tradex order reference number (s 9(a), (b)(i)).
   • Provide “sufficient evidence to satisfy the Secretary as to the amount of refund” (s 9(b)(ii)). Evidence should include proof of export, destruction reports (for accidental destruction), inspection logs, photographs, carrier receipts, customs export declarations, and any other contemporaneous documentation that links the event to the tradex order and quantifies the refundable amount.
   • Expect the Secretary to scrutinise proofs; submit a clear reconciliation of amounts claimed against tradex order particulars.

5. Coordinate with customs and administrative authorities

   • Because s 7 ties tradex duty to customs value, coordinate with the customs authority on valuation methodology, and ensure consistency between customs declarations and tradex duty calculations.
   • Engage with the Secretary’s office early where the facts are borderline, for example project exhibits or temporary use that might be challenged as non‑permitted consumption. Early clarification can reduce the risk of later denial of refund.

6. Special handling for traveller’s cheques (s 8(1)(e))

   • If traveller’s cheques are involved, restrict permitted activity to writing on the cheques in Australia but not countersigning them in exchange for goods, services or cash (s 8(1)(e)). Maintain evidence of the non‑exchange purpose for any writing.

7. Review prior compliance under the 2008 regulations (Schedule 1)

   • If your historical practice was shaped by the Tradex Scheme Regulations 2008, confirm that existing procedures meet the new requirements post‑repeal (Schedule 1). Update internal policies, checklists and training materials to reflect the 2018 instrument’s specifications.

8. Prepare for administrative discretion and potential review

   • Because s 9 vests a satisfaction test in the Secretary, structure submissions and records to anticipate challenging questions. Consider preparing a clear statutory mapping: identify the tradex order reference, tie each evidence item to the statutory element it proves (intention, non‑use, permitted exception, valuation basis), and provide a clean narrative and timeline.

9. Retain records for audit and review

   • Retain all records used to support intended non‑use, permitted inspection/exhibition, export bookings, customs valuation documents and refund submissions. The instrument’s focus on evidentiary sufficiency makes record retention crucial for later administrative audits or disputes.

By following these steps, regulated parties can align operations and recordkeeping to the instrument’s requirements: demonstrating non‑intention and non‑use (s 6), limiting and documenting permitted uses (s 8), computing tradex duty using customs valuation (s 7), and meeting the Secretary’s evidentiary standards for any refund requests (s 9). The instrument centralises administrative interaction with the Secretary and anchors valuation to the Customs Act, so compliance requires both administrative submissions and consistency with customs processes.
