38 Infringement notice not required to be served etc.

This Part does not: (a) require an infringement notice to be served on a person in relation to an offence against section 28; or (b) affect the liability of a person to be prosecuted for an offence against section 28 if: (i) an infringement notice is not served on the person in relation to the offence; or (ii) an infringement notice served on the person in relation to the offence has been withdrawn; or (c) affect the liability of a person to be prosecuted for an offence against section 28 if the person does not comply with an infringement notice served on the person in relation to the offence; or (d) limit the amount of the penalty that may be imposed by a court on a person convicted of an offence against section 28.
