27 Ownership of horticulture produce
The ownership of the produce passes from the grower to the merchant: (a) if the price of the produce has been agreed to by the merchant and grower before delivery—on delivery of the produce to the merchant; or (b) if the price of the produce has not been agreed to before delivery—at the time that the merchant and the grower agree on a price for the produce.
Note: Under clause 25, a price must be agreed to either before the delivery or immediately upon delivery.
