Trade Practices (Consumer Product Safety Standard) (Reduced Fire Risk Cigarettes) Regulations 2008

Several concepts are defined or used in the regulations that are essential to understanding their operation.

Cigarette: Defined as “a roll of cut tobacco for smoking, enclosed in paper” (regulation 5). This excludes cigars, pipe tobacco, loose tobacco, and electronic nicotine delivery systems. The definition is narrow and product-specific. It covers only the traditional manufactured cigarette. The paper enclosure is central to the fire risk; the standard targets the cigarette paper’s combustion properties.

Full-length burn: Has the same meaning as in AS 4830-2007. While the standard itself is not reproduced in the regulations, it is incorporated by reference. A full-length burn generally means the cigarette continues to burn along its entire length without self-extinguishing. The performance requirement is that at least 75% of cigarettes tested in a trial must fail to achieve a full-length burn , that is, they must self-extinguish before reaching the end.

Lowered permeability band: Defined as “a concentric band of paper or other material that is included in, or applied to, cigarette paper in order to inhibit the burning of the cigarette” (regulation 5). These bands are the key technology used to reduce fire risk. They reduce the oxygen supply to the burning coal, causing the cigarette to extinguish if not puffed frequently. The regulations impose minimum specifications for bands: at least two identical bands surrounding the tobacco column, with positional requirements. For filter cigarettes, at least one band must be at least 15 mm from the lighting end and at least one band at least 10 mm from the filter end of the tobacco column (regulation 13(3)). For non-filter cigarettes, the band must be at least 10 mm from the “labelled end” (regulation 13(4)). The banding must be “by design” (i.e., intentionally placed during manufacture, not random).

Different kinds of cigarettes: Regulation 6 provides a classification system for testing. Cigarettes are of a different kind if they are sold under different brand names. Even under the same brand name, they are different kinds if they differ in menthol content, other flavourings, tar content, alleged mildness, presence of filter or cork tip, or length or mass. This classification is important because each different kind must be tested in a separate test trial (regulation 12(4)). A manufacturer cannot test a single representative sample across all variants; each variant must meet the 75% threshold independently.

Retail package: Defined in regulation 7 as the package in which cigarettes are sold at retail. It includes outer packages such as cartons when sold as one unit, but excludes display cases not sold with the cigarettes, and excludes wrappers normally removed upon opening (e.g., the transparent outer wrap on a packet). The marking requirement applies to each retail package, so the statement must appear on every packet and every carton sold as a unit.

Test trial: The testing protocol requires a test trial of 40 replicated tests on 10 layers of filter paper (regulation 12). Each test is conducted according to AS 4830-2007. The 40 tests are a statistical sample to determine whether the cigarette kind meets the 75% no-full-length-burn threshold. The test is destructive and presumably done by the manufacturer or a testing laboratory. There is no requirement for third-party testing or government certification; the regulations rely on self-assessment.

AS 4830-2007: The Australian Standard titled “Determination of the extinction propensity of cigarettes”. It is incorporated by reference as in force at the commencement of regulation 1 (i.e., 23 September 2008). Any subsequent amendments to that standard are not automatically adopted; the regulations fix the version at commencement. This is typical for safety standards: it provides regulatory certainty but means that if the standard improves or changes, the regulations would need amending to keep pace.

The concept of “lowered permeability” is not defined but is referred to in the definition of lowered permeability band. The bands reduce the paper’s permeability to air, slowing the burn. The regulations do not specify the band width, the permeability reduction percentage, or the band spacing beyond the minimum distance from the ends. This gives manufacturers some design flexibility but also creates ambiguity: what counts as “identical” bands? The regulations do not elaborate, so interpretation may require reference to industry practice or further guidance from the ACCC.

The regulations primarily affect manufacturers and importers of cigarettes sold in Australia. Domestic cigarette manufacturers must redesign their products to meet the performance requirement and must ensure all production (from 18 months after commencement for new production, and from 24 months for all stock) complies. Importers must ensure that every shipment of cigarettes entering Australia after the relevant dates meets the standard. Given that cigarettes are often imported from countries without equivalent standards (e.g., some Asian or Middle Eastern markets), importers may need to require foreign suppliers to modify their production processes, which can be costly and may lead to supply disruptions.

Retailers are indirectly affected. They are not required to test cigarettes, but they must only sell cigarettes that comply. A retailer who sells non-compliant cigarettes may be liable for an offence under the Trade Practices Act, even if they did not know the product was non-compliant, because the Act imposes strict liability for supplying goods that do not comply with a mandatory safety standard. Retailers therefore have an incentive to source only from compliant manufacturers and to keep records of compliance documentation.

Consumers are affected in two ways. First, they may notice a change in how cigarettes burn: reduced fire risk cigarettes tend to self-extinguish if not puffed frequently, which can be inconvenient for some smokers. Second, there may be a change in taste or draw resistance due to the banding. These are private costs borne by smokers, who may find the new cigarettes less satisfactory. The regulations do not compensate consumers for any reduction in product quality.

The Australian Competition and Consumer Commission (ACCC) is the enforcement body. It will need to monitor compliance, investigate complaints, and possibly conduct its own testing. The regulations impose a compliance burden on the ACCC as well.

The regulations also affect standards developers (Standards Australia) because they rely on AS 4830-2007. Any future revision of that standard would require an amendment to the regulations to remain current.

The regulations do not directly affect tobacco growers, wholesalers, or logistics providers, except insofar as they handle compliant versus non-compliant product.

The phased application created a window for manufacturers and importers to comply. Those who did not adapt in time faced the risk of having to destroy or recall non-compliant stock after the 24-month mark. The amendment to regulation 4 (2009 No. 66) changed the application provisions; the original version may have had different dates or scope. The nature of the amendment is not specified in the source beyond “amended”. It could have been a correction or an extension; without the original text, we cannot assess the effect. The table shows it changed regulation 4.

The regulations impose duties on corporations and individuals who supply cigarettes in Australia (the term “supply” is defined broadly in the Trade Practices Act). The key duties are:

• Performance duty: Cigarettes must comply with the performance requirement in regulation 10: at least 75% of cigarettes tested in a test trial must fail to achieve full-length burns.
• Testing duty: For the purpose of determining compliance, cigarettes must be tested in accordance with the testing requirements in Division 3 (regulations 11-13). This duty is not a one-off; it applies each time a manufacturer or importer supplies a new batch or kind of cigarette. However, there is no explicit frequency of testing specified. The regulations do not say “test each batch” or “test annually”. Reasonable interpretation: a supplier must have a reasonable basis to believe the cigarettes meet the performance requirement, which typically requires periodic testing.
• Packaging duty: Each retail package must bear the prescribed statement (regulation 14(2)). The statement must be clearly legible and not obscure required health warnings. It may be on an adhesive label that is firmly affixed.
• Duty not to supply non-complying cigarettes: Regulation 14(1) prohibits retail packages from containing cigarettes that do not meet the performance requirements. This is effectively a ban on supplying non-compliant product.

The regulations do not confer any rights on consumers directly. They do not create a private right of action for damages if a consumer buys a non-compliant cigarette. Enforcement is through the ACCC and criminal prosecution. However, a consumer may have a right to a refund or compensation under the Australian Consumer Law if the cigarettes are unsafe or not of merchantable quality, but that arises from the general law, not these regulations.

Manufacturers and importers have a right to design their cigarettes in any way that meets the performance requirement, subject to the banding rules if they choose to use bands. They are not required to use lowered permeability bands; other methods are permissible if they pass the test.

The regulations also provide a limited right to use adhesive labels for the marking requirement. This flexibility acknowledges that applying the statement through printing directly on the packet may be impractical for some packaging processes.

Suppliers have a right to rely on testing conducted by a competent laboratory, whether in-house or external. There is no requirement for government accreditation of the testing facility.

The regulations impose no record-keeping duty. However, in practice, a supplier would be prudent to retain test data to demonstrate compliance if challenged by the ACCC.

The regulations themselves do not prescribe penalties. Instead, they operate under the Trade Practices Act 1974 (now the Competition and Consumer Act 2010). Section 65C of that Act (as in force at the time) provided that a person who supplies goods that do not comply with a prescribed consumer product safety standard commits an offence. The penalty is not stated in the regulations, but under the Act it could be a fine (up to a certain amount for individuals and corporations) and possible imprisonment for individuals in serious cases. Additionally, the ACCC can issue infringement notices (on-the-spot fines), seek injunctions to stop supply, order recalls, and pursue pecuniary penalties through the courts.

The regulations create a strict liability offence: a supplier may be liable even if they did not know the cigarettes were non-compliant. This places a heavy burden on suppliers to ensure their due diligence systems are robust.

There is no defence of “reasonable mistake” in the regulations themselves, but the parent Act may provide defences such as “reasonable error” or “reliance on information from a third party”. However, given that these regulations are product-specific and the testing is within the supplier’s control, such defences may be difficult to maintain.

Enforcement is solely through the ACCC and the courts. There is no licensing or registration requirement. The ACCC can conduct its own tests by purchasing cigarettes from retailers and sending them to a laboratory. If the cigarettes fail, the ACCC can take enforcement action. The regulations do not require the supplier to notify the ACCC of test results or to obtain pre-market approval. This self-assessment model shifts the initial compliance cost to the industry, but it also creates an information asymmetry: the ACCC must detect non-compliance through market surveillance.

The regulations do not provide for a defence of “compliance with a foreign standard”. Only compliance with the Australian standard is relevant.

The marking requirement carries its own enforcement risk: a retail package without the required statement is non-complying, even if the cigarettes themselves meet the performance requirement. This is because regulation 14 is part of the safety standard.

Given the strict liability nature, the practical penalty for non-compliance can include the cost of a recall, reputation damage, and legal costs. For a major manufacturer, a recall of millions of cigarettes could be extremely expensive.

These regulations are made under the Trade Practices Act 1974. They are one of several consumer product safety standards prescribed under that Act. They interact specifically with the Trade Practices (Consumer Product Information Standards) (Tobacco) Regulations 2004, which require health warnings on tobacco products. Regulation 14(3) requires that the fire risk statement must not obscure any warning message required under those regulations. This requires careful placement of the statement, often on the side or bottom of the pack.

The regulations also interact with state and territory laws regarding fire safety, but those are not referenced. For example, some states have laws requiring fire-safe cigarettes in certain settings, but the national standard overrides or supplements them.

The regulations do not interact with customs or excise laws directly, but a non-compliant import may be prohibited from entry under the Customs Act 1901 if it fails to meet a mandatory standard, giving the Department of Immigration and Border Protection (now Home Affairs) grounds to seize or detain the goods.

If cigarettes are also subject to the Competition and Consumer Act 2010 (the successor to the Trade Practices Act), the same enforcement mechanisms apply. The Australian Consumer Law (which replaced the Trade Practices Act’s consumer protection provisions) continues the offence.

The regulations interact with tort law. If a cigarette causes a fire despite meeting the standard, the manufacturer may still be liable in negligence if the standard proved inadequate. Conversely, compliance with the standard is not a defence to a common law claim, though it may be evidence of reasonable care.

There is no interaction with intellectual property laws, but the banding technology may be patented, potentially creating licensing issues for manufacturers.

The regulations are silent on their relationship with international trade obligations. Australia is a party to the WTO Technical Barriers to Trade Agreement, which requires that technical regulations not create unnecessary obstacles to trade. The regulations could be challenged by foreign governments as a trade barrier if they are more restrictive than necessary or if they treat imported cigarettes less favourably. However, the standard applies equally to domestic and imported products, so it is facially non-discriminatory. The fact that the testing standard is an Australian Standard, not an international one, could be an issue.

The regulations were first made as SLI 2008 No. 195, registered on 22 September 2008 and commencing on 23 September 2008. The only amendment is SLI 2009 No. 66, which amended regulation 4 (the application provision). The amendment was registered on 14 April 2009 and commenced on 15 April 2009. The table of amendments indicates that regulation 4 was amended; no other provisions were affected. The nature of the amendment is not specified in the source text (it only says “am. 2009 No. 66”). Without the original regulation 4, we cannot know whether the change altered the phase-in dates, the scope of application, or the wording. However, the compilation shows regulation 4 in its amended form, which is the version described in the “Application” section above. The original regulation 4 may have had different timeframes or may not have included the distinction between manufactured/imported on or after a date versus all cigarettes. It is possible the amendment was necessary to clarify the application to imported cigarettes or to fix a drafting error. The table also shows no other amendments, meaning the regulations have remained largely unchanged since 2009.

The regulations are now part of a broader scheme under the Competition and Consumer Act 2010, but they have not been re-made or significantly updated. The reference to the Trade Practices Act 1974 in the regulations is technically outdated, but the regulations continue in force by operation of transitional provisions in the Competition and Consumer Act 2010.

There is no sunset clause. The regulations will remain in force unless repealed or amended. Given that they have been in effect for over 15 years, it is notable that no revision has occurred to incorporate changes to AS 4830 or to adjust the performance threshold.

The source text does not mention any litigation. No cases are cited. Based on publicly available information (not from the source, but acceptable background knowledge for a legal analyst), there has been no reported litigation directly challenging these regulations. That is not unusual for a product safety standard; most enforcement occurs through administrative action or infringement notices rather than court proceedings. The regulations have been in force for over a decade without apparent legal challenge, suggesting that the industry accepted them or found it not worth contesting. One possible reason: the cost of non-compliance (potential prosecution and recall) outweighed the cost of litigation, and the standard was technically feasible. Additionally, similar regulations had already been adopted in countries like Canada and the United States, so Australia was not a first mover.

There may have been some disputes about the interpretation of “full-length burn” or “identical bands”, but those would likely be resolved between the ACCC and the supplier without court involvement under regulatory guidance.

The absence of litigation does not imply the regulations are perfect. It may indicate that enforcement has been lax, or that the industry quickly adapted and is largely compliant. Alternatively, the high compliance costs may have been passed on to consumers without significant resistance.

Several aspects of these regulations could catch a supplier off guard.

First, the definition of “different kind” in regulation 6 is very broad. Any change in flavour, tar content, length, mass, presence of filter, or even alleged mildness creates a new kind that must be separately tested. A manufacturer cannot test a single variant and assume the results apply to a different length or flavoured version. This can multiply testing costs significantly for a product line with many variants. A brand that offers 20 different varieties (regular, light, menthol, extra-long, etc.) may need to conduct 20 separate test trials of 40 tests each, totalling 800 tests. Each test consumes 40 cigarettes plus filter paper and labour. The cumulative burden is substantial.

Second, the banding requirements in regulation 13 are mandatory for cigarettes that use lowered permeability bands. But note: “cigarettes that use lowered permeability bands” is not defined as any cigarette with bands; it likely applies to any cigarette that relies on bands to meet the performance requirement. If a manufacturer uses bands, they must have at least two identical bands, with specific distances from the ends. The regulations do not clarify what “identical” means. Does it require the same width, same permeability reduction, same shape? A manufacturer that inadvertently places bands at different distances or with different characteristics may be non-compliant even if the cigarettes pass the full-length burn test, because the banding rules are separate requirements under regulation 12(5). So compliance requires both passing the performance test AND meeting the banding rules if bands are used.

Third, the marking requirement applies to every retail package, including cartons if sold as one unit (regulation 7(2)(c)). A supplier selling cartons as retail units must ensure the carton itself bears the statement, not just the inner packets. This could require changes to carton printing.

Fourth, the statement must be “clearly legible” and must not obscure any warning message. If the warning message covers a large portion of the pack, there may be limited space for the fire risk statement. The regulations permit an adhesive label, but the label must be firmly affixed and not easily removable. The test is whether removal would damage the label or the packaging, considering expected lifespan. This is a subjective standard and could lead to disputes.

Fifth, the regulations apply to all cigarettes regardless of where they are manufactured after the 24-month phase-in. This means that even old stock manufactured before the commencement date may become illegal to sell after 24 months. A retailer could still have pre-2008 stock on the shelf in late 2010 and be selling it unlawfully. This is a classic compliance trap: the phasing creates a clear deadline, but inventory management is the supplier’s responsibility.

Sixth, the testing standard AS 4830-2007 is incorporated as in force at commencement. If Standards Australia revises the standard to a more stringent version, the regulations still refer to the old version. However, a supplier who tests under the new standard may not be compliant under the regulations if the new standard is different. Conversely, a supplier who uses the old standard but the test method changes could face problems. This creates uncertainty if the standard is updated.

Seventh, there is no provision for partial compliance or exemptions. Either the cigarettes pass the test or they do not. The 75% threshold is absolute; there is no sliding scale or alternative compliance path.

Eighth, the regulations do not address how test results from foreign laboratories are treated. If a product is tested in a facility accredited in another country, the ACCC may require retesting in Australia. The regulations do not require accreditation, but the ACCC may be sceptical of foreign test results.

Compliance is a multi-step process requiring product design, testing, packaging, and ongoing monitoring.

Step 1: Determine the product range. Identify each “different kind” of cigarette sold in Australia under the criteria in regulation 6. This includes different brand names, and differences in menthol, flavour, tar, mildness, filter, length, mass. Create a list of all variants to be tested.

Step 2: Design the cigarette. Most manufacturers will use lowered permeability bands. The design must include at least two identical bands surrounding the tobacco column. For filter cigarettes, one band must be at least 15 mm from the lighting end and one at least 10 mm from the filter end of the tobacco column. For non-filter, the second band must be at least 10 mm from the labelled end. The bands must be “by design” , i.e., intentional and consistent. The band width and permeability reduction are not specified, so the manufacturer must determine these through experimentation to ensure the cigarette self-extinguishes reliably.

Step 3: Conduct testing. Obtain a copy of AS 4830-2007 (the version in force at 23 September 2008). Set up a laboratory or contract a testing facility to perform test trials. Each test trial consists of 40 replicated tests on 10 layers of filter paper. The performance requirement: at least 30 out of 40 cigarettes (75%) must fail to achieve full-length burn. The testing must be done separately for each different kind of cigarette.

Step 4: Validate band compliance. If bands are used, ensure the banding design meets regulation 13. Document the design and test results.

Step 5: Design the packaging. Determine where to place the statement “AUSTRALIAN FIRE RISK STANDARD COMPLIANT. USE CARE IN DISPOSAL” on each retail package. Ensure it is clearly legible and does not obscure any health warning required under the Tobacco Information Standards. The statement can be direct printed or on an adhesive label. If using a label, ensure it is firmly affixed and not easily removable , i.e., peel strength must be sufficient to prevent removal without tearing the label or damaging the packaging. Test the adhesive under expected storage and handling conditions.

Step 6: Phase-in compliance. For new production and imports: from 23 March 2010, only cigarettes manufactured or imported on or after that date must comply. From 23 September 2010, all cigarettes (including pre-existing stock) must comply. Therefore, suppliers must clear old stock from the supply chain before the final deadline. This may require recalling or destroying non-compliant product.

Step 7: Maintain records. Although not required by the regulations, keeping thorough records of test results, banding specifications, and packaging artwork is essential for demonstrating compliance if the ACCC investigates. The ACCC may request evidence, and without records, a supplier may be unable to prove compliance, risking penalties.

Step 8: Monitor ongoing compliance. Any change to a cigarette (new flavour, new length, new packaging) may trigger a new testing requirement. The supplier must ensure that each new kind is tested before supply. There is no grandfathering for minor variations; if a variant is different under regulation 6, it must be separately tested.

Step 9: Importers. If importing, ensure the foreign manufacturer understands the Australian standard and can produce compliant cigarettes. Obtain test certificates from the manufacturer’s laboratory, but consider independent verification because the ACCC may not accept foreign test data without evidence of equivalency. Plan for longer lead times and possible rejections at the border.

Step 10: Engage with the ACCC if needed. The ACCC publishes guidance on product safety standards. Consulting that guidance can help avoid common mistakes. If in doubt about the interpretation of “identical bands” or “full-length burn”, seek legal advice or an ACCC informal opinion.

The cost of compliance includes: product design and engineering, testing fees (potentially dozens of test trials), packaging redesign, potential lost sales from stock write-offs, and increased cost of goods sold due to banding paper (which may be more expensive). There is no offset or subsidy. The costs are ultimately borne by consumers through higher cigarette prices.

Suppliers should also consider that the standard may affect product liability claims. A cigarette that causes a fire but is compliant may still ground a claim if the design was defective (e.g., bands not functioning in real-world conditions). Compliance with the standard is not a complete defence. Therefore, robust quality control and documentation is advisable.
