sec.35 Conditions, requirements and restrictions attach to the land
Conditions, requirements and restrictions in relation to the use of premises imposed by an agreement under Part 3 , that have not been amended, complied with or dispensed with attach to the land and are binding on successors in title. The conditions, requirements and restrictions continue to attach to the land after its inclusion in the Townsville planning scheme. The conditions, requirements and restrictions are then taken to be conditions that attach to the land under the Local Government (Planning and Environment) Act 1990 or the Sustainable Planning Act 2009 . s 35 amd 2006 No. 11 s 108 ; 2009 No. 36 s 872 sch 2 (sec.35-ssec.1) Conditions, requirements and restrictions in relation to the use of premises imposed by an agreement under Part 3 , that have not been amended, complied with or dispensed with attach to the land and are binding on successors in title. (sec.35-ssec.2) The conditions, requirements and restrictions continue to attach to the land after its inclusion in the Townsville planning scheme.
