Town Planning (Buildings) Uniform General By-laws 1989

The by‑laws are constructed around a small set of recurring regulatory levers.

1. Classes of building: The by‑laws regulate siting and standards by building class (Class 1 to Class 8 appear throughout). The by‑laws themselves do not define the class categories. Instead, by‑law 3(1) requires that expressions used in these by‑laws have the same meanings as in the Statement of Planning Policy No. 1 or the Building Regulations 2012, as appropriate. Practically, a designer or applicant must consult those instruments to confirm whether a proposed development is Class 1, 2, 3, 4, 6, 7 or 8 for the rules to apply.

2. Setbacks and siting: Frequent numerical setbacks are prescribed. For residential areas the default front setback is 7.5 metres (by‑law 6(b)(i); by‑laws 7(a), 9(1)(a)). Side and rear distances are specified by building class, number of storeys and by the detailed general residential zone tables in by‑law 16. When walls are oriented at angles, an averaging rule and the Statement of Planning Policy No. 1 measurement methods apply (by‑law 7(c)).

3. Plot ratio and lot coverage: The by‑laws cap density through plot ratio and lot coverage measures. For Class 1 buildings the maximum plot ratio is 0.5 and outbuildings are counted in the building area while unroofed terraces are excluded (by‑law 10(1)-(2)). For Class 2 buildings the instrument provides a table relating percentage of lot area covered to allowable plot ratio (by‑law 13(1)), with a further exception where single occupancy flats are at or below 300 dwellings per hectare (by‑law 13(2)). By‑law 16 also sets maximum lot coverage percentages in general residential zones and a formula for minimum separation between buildings on the same lot.

4. Parking and vehicle manoeuvring: Parking is regulated quantitatively. Class 2 buildings must provide parking on the rear set back at the rate of 11/3 spaces per dwelling and supply on‑site turning so a motor vehicle can enter the street without reversing (by‑law 11(2)-(3)). By‑law 16(d) sets minimum car space dimensions and requires 50% of the lot to be natural planting and pedestrian space subject to certain inclusions. Loading docks for Class 6, 7 and 8 buildings must be sized to contain vehicles on the lot and permit entry to the street without reversing (by‑law 19). Rear access for refuse removal and servicing is required for Class 6, combined Class 1 and 6, Class 7 and Class 8 buildings; the access must be at least 1 500 mm wide and must not pass through a building or arcade (by‑law 20).

5. Ancillary buildings and features: Outbuildings are controlled with limits on proximity to frontages, separation from other buildings, maximum wall heights and aggregate area caps for outbuildings on Class 1 lots (by‑laws 21-22). There are special minimum separations for stables, fowlhouses/kennels, water closets and private workshops, with cross‑reference to public health by‑laws where applicable (by‑law 21(3)).

6. Council decisionmaking and variation: Councils are given repeated powers to fix lesser distances, approve siting other than prescribed and exercise discretion when the circumstances justify it (by‑laws 6, 9(2), 25). The by‑laws make multiple references to where councils may prescribe or approve different outcomes under “any law”, signalling that local planning schemes and development control frameworks can interact with these standards.

7. State and Ministerial modification routes: Certain modifications to standards in general residential zone tables may be made with the consent or after reports involving the State Planning Commission and Minister where minimum lot area or precinct sizes are achieved (by‑law 16, Parts A-C tables). Those pathways require reports and satisfaction as to social and aesthetic desirability.

8. Integration with other regulatory instruments: The by‑laws expressly import meanings and measurement regimes from Statement of Planning Policy No. 1 and the Building Regulations 2012 (by‑law 3(1)). They operate in the context of the Planning and Development Act 2005 (and historically under the Town Planning and Development Act 1928), and several of the by‑laws are intentionally "subject to" other written law, meaning applicants must reconcile these by‑laws with local planning schemes, building regulations and public health by‑laws (for example by‑laws 3(1), 4(2), 21(3) and 25).

The instrument therefore combines prescriptive numeric limits controlling density, siting, and parking with administered discretion primarily at the council level and conditional Ministerial modification powers for larger‑scale or precinct developments.

The by‑laws distribute obligations and decision rights among actors connected to building activity in Western Australia. The principal affected parties are:

• Lot owners and prospective purchasers: Owners who intend to construct, extend or subdivide are directly constrained by minimum lot area and frontage requirements for particular building classes (for example Class 1 minimum lot area 550 m2 and frontage 15 m by‑law 8(a)-(b); Class 2 minimum frontage 20 m by‑law 12; Class 6 minimum lot area 185 m2 and frontage 5 m by‑law 18). The by‑laws also require minimum rear, side and front set backs, which reduce the permissible building envelope on the lot (by‑laws 6, 7, 9, 16).

• Developers and builders: Developers and their consultants must design to the plot ratio limits (by‑laws 10 and 13), lot coverage ceilings (by‑law 16), vehicle parking and turning requirements (by‑laws 11, 19, 20, 16(d)), and outbuilding size and placement (by‑laws 21-22). These prescriptive constraints affect how many dwellings or how much floor area can be delivered on any given lot and influence construction technique and cost.

• Architects and planners: Measurement rules are explicitly outsourced to other instruments (by‑law 3(1)(a)-(b)), so designers must consult Statement of Planning Policy No. 1 and the Building Regulations 2012 for definitional and measurement detail. The by‑laws also require specific calculations for non‑parallel walls and plot ratio computations (by‑laws 7(c), 13(3)), which influence site planning and architectural form.

• Local councils: Councils are the principal decisionmakers under the by‑laws. They approve exceptions, fix alternate setback distances under local law, receive applications for demolition to permit new Class 1/2/3 construction on a lot with an existing such building (by‑law 5(1)), exercise discretion to approve siting contrary to the by‑laws where proper (by‑law 25) and may approve lesser outbuilding setbacks (by‑law 21(1)). They also are the body that defines land liable to flooding for the purpose of by‑law 23, and they administer the penalties under by‑law 26.

• State agencies and the Minister: The State Planning Commission and the Minister have roles where modifications to general residential zone standards are sought for specified precinct sizes and lot area thresholds (by‑law 16 Parts A-C). The Minister may modify standards other than plot ratio where satisfied modifications are socially and aesthetically desirable, typically after reports from council and the State Planning Commission.

• Tenants, neighbours and local communities: Neighbouring landowners are affected by set back, separation and parking requirements because those rules shape building height, privacy, solar access and traffic flows. For example, by‑laws 7(b) and 9(1) prescribe separation distances that affect light and views. By‑law 14 imposes minimum set backs for buildings on land abutting lots that contain Class 1, 2 or 3 buildings, thereby extending control over neighbouring development.

• Operators of commercial premises: Specific provisions govern commercial and industrial buildings: Class 6, 7 and 8 buildings must provide loading docks and access ways that contain vehicles on the site and allow entry to the street without reversing (by‑law 19). Class 6, combined Class 1 and 6, Class 7 and Class 8 buildings must provide rear access for rubbish removal and servicing, minimum 1 500 mm width, not passing through the building or arcade (by‑law 20).

• Entities subject to public health by‑laws: For certain outbuildings (stables, fowlhouses, kennels, water closets, workshops), minimum distances are conditioned by any public health by‑laws in force under the Health (Miscellaneous Provisions) Act 1911, so owners must reconcile both regimes (by‑law 21(3)).

Who pays: The immediate financial costs of compliance fall on lot owners, developers and builders who must design within reduced building envelopes, provide required parking and turning space, and possibly reconfigure schemes to meet setbacks, plot ratio and parking controls. Councils incur administrative costs in processing approvals, determining flood‑liable land and enforcing breaches, though these administrative duties are stated and not quantified in the instrument.

Who decides: Councils make most site‑specific decisions and variances (by‑laws 5, 6, 9, 21, 25). The Minister and State Planning Commission enter decisionmaking only under defined modification pathways in by‑law 16 for certain multiunit and precinct developments.

What behaviour changes: The by‑laws constrain density and site coverage via plot ratio, lot coverage and setback limits, and require on‑site parking and manoeuvring arrangements. Designers will alter building footprint, orientation and height to satisfy those numeric constraints. Developers may avoid building types that trigger stricter standards or seek council or Ministerial approvals for modified standards where possible.

This section summarises the principal duties imposed on persons constructing or altering buildings and the rights (administrative discretions) that permit departures from the prescriptive standards.

Principal duties

• Application and scope: Ensure the by‑laws apply to the works in question. The by‑laws apply throughout the State (by‑law 4(1)) except where a building or incidental structure is exempt from a building permit under the Building Act 2011 Part 5 or regulations or an order under that Part (by‑law 4(2)). That is a pre‑condition to the duties below.

• Approval requirement for certain infill constructions: On lots in the metropolitan region, a municipal district of a town or within townsite boundaries where a Class 1, 2 or 3 building exists, do not construct a further Class 1/2/3 building unless the council approves an application providing for demolition of the existing building, or the new building is an addition or extension (by‑law 5(1)(a)-(e)). There is a conditional exception permitting two Class 1 dwellings on a lot of at least 1 hectare if other siting conditions are met and council consent is given (by‑law 5(2)).

• Setbacks: Comply with minimum setback distances. General minimums include 7.5 m from the frontage for residential areas where no council set back is fixed (by‑law 6(b)(i); by‑law 7(a)). Side and rear setbacks are prescribed for Class 2 and Class 1 buildings (by‑laws 7(b), 9(1)(a)-(b)). For general residential zones, the extensive Part A-C tables in by‑law 16 provide detailed minimum setbacks depending on zone classification, plot ratio and lot frontage.

• Separation and internal spacing: For multi‑dwelling buildings, ensure separation between external walls with windows to habitable rooms is not less than 6 m (by‑law 11(1)). In general residential zones, inter‑building distances on the same lot must meet a minimum of 9 m or a formula‑derived distance, with a potential 15% reduction in specified height‑differential cases (by‑law 16(4)(b)).

• Plot ratio and lot coverage: Do not exceed the specified plot ratios. Class 1 plot ratio limit is 0.5 (by‑law 10(1)); the area includes outbuildings but excludes unroofed terraces (by‑law 10(2)). Class 2 plot ratios are set in a table that ties permitted plot ratio to the percentage of lot covered by building (by‑law 13(1)); exceptions apply for single occupancy flats up to 300 dwellings per hectare (by‑law 13(2)). General residential zones specify maximum lot coverage percentages linked to plot ratios (by‑law 16(4)(a)).

• Parking and manoeuvring: Provide parking behind the front set back at prescribed rates and turning space so vehicles can leave without reversing into the street (Class 2: 11/3 spaces per dwelling and turning provision, by‑law 11(2)-(3); by‑law 16(d) details parking dimensions). Loading docks for Class 6, 7 and 8 must be sufficient to contain vehicles wholly on the lot and permit entry to the street without reversing (by‑law 19).

• Outbuildings: Observe siting, separation and height limits for outbuildings (by‑laws 21-22). Except where council approves otherwise, outbuilding wall height is not to exceed 3 m and total outbuilding area on a lot with a Class 1 building must not exceed 50 m2 (by‑law 22(1), (3)). Special minimum distances apply for stables, fowlhouses/kennels, water closets and private workshops, with the qualifier that public health by‑laws may also apply (by‑law 21(3)).

• Flood and earthworks: Do not construct on council‑defined flood‑liable land (by‑law 23). Do not form embankments or excavated faces higher than 1 m without council approval (by‑law 24).

Rights and discretions

• Council approvals and fixes: The council can approve the construction of a building where a demolition proposal is included, allow additions and extensions, fix lesser setback distances under any law, and approve siting in positions other than prescribed where it is proper to do so (by‑laws 5(1)(d)-(e); 6; 21(1); 25). Those are administrative discretions that permit variance from the prescriptive rules.

• Minister and State Planning Commission modifications: For some general residential zone standards, the council may modify standards for grouped development with consent of the State Planning Commission, and the Minister may modify standards for multiunit development where minimum lot or precinct areas are met and the Minister is satisfied the modifications are socially and aesthetically desirable. These rights are described in the tables and notes to by‑law 16 (Parts A-C).

• Local law interplay: The by‑laws are frequently “subject to” or operate in conjunction with “any law” that allows the council to prescribe alternatives (by‑laws 3(1), 4(2), 25). Practitioners can use local planning schemes, council by‑laws and other written law as the legal basis to seek departures.

• Calculation conventions drawn from other instruments: For angled walls and for plot ratio passages/accessways, the by‑laws require calculations in accordance with Statement of Planning Policy No. 1 and treat passages wider than 1 m as 1 m for plot ratio determinations (by‑laws 7(c), 13(3)). The “right” here is the right to rely on the externally defined measurement conventions when preparing plans.

Administrative and enforcement features

• Offence provision: Any person who fails or neglects to do anything directed or forbidden by the by‑laws commits an offence and is liable to a penalty not exceeding $500 (by‑law 26). The by‑laws do not set out a civil enforcement regime in the text beyond this offence provision; councils exercise decisionmaking and approval functions.

In sum, duties are largely prescriptive, numerically framed obligations focused on siting, coverage, parking and outbuilding rules. Rights are principally discretionary permissions resting with the council, with specific Ministerial/State Planning Commission roles available for larger or precinct developments.

The by‑laws’ enforcement framework is compact and administratively oriented. The instrument relies on council decisionmaking and a single statutory offence provision rather than a graduated civil enforcement matrix.

Key enforcement provisions in the text

• Criminal offence and monetary cap: By‑law 26 states that contravention of a direction or prohibition constitutes an offence and attracts a penalty not exceeding $500. The provision was inserted in the 1994 amendment (see compilation table; by‑law 26 inserted Gazette 7 Jan 1994 p. 21). The by‑laws do not, within the instrument, prescribe a schedule of infringement notices, daily penalties, remedial orders or civil enforcement mechanisms. They do not set out procedural enforcement powers such as entry, inspection, stop notices or rectification orders.

• Council’s administrative role: The principal operational enforcement and compliance role is implicit in the council’s power to approve or to fix lesser distances under “any law” (by‑laws 5(1)(d), 6, 21(1) and 25). The by‑laws anticipate councils will regulate compliance through the application and approval process. For example, the requirement that a council must approve construction of a Class 1, 2 or 3 building on a lot already occupied by such a building unless demolition is proposed links approvals to compliance (by‑law 5(1)(a)-(e)).

• Interaction with building permit regime: By‑law 4(2) excludes works for which a building permit is not required under the Building Act 2011 Part 5, the Building Regulations or an order under that Part. Conversely, where a building permit is required, the permit process under the Building Act 2011 and its regulations will run in parallel with the by‑laws. Enforcement of building permit conditions, inspections and certifications typically sit with the Building Act framework. The by‑laws neither duplicate nor displace the Building Act’s enforcement mechanisms but form an additional layer of statutory standards that councils are to apply when exercising planning/building approval functions.

Practical enforcement pathway

• Administrative approvals: Councils process applications and attach conditions or refuse consent when proposals do not conform with the by‑laws. They determine flood‑liable land for the purpose of the prohibition on building (by‑law 23). Councils can also exercise discretion to approve departures under by‑law 25, and to approve particular outbuilding siting departures under by‑law 21.

• Criminal sanction for breach: If a person builds contrary to these by‑laws, they commit an offence under by‑law 26 and face the stated monetary penalty. The by‑laws do not provide for graduated penalties, daily fines or remedial orders within the instrument itself.

Observed enforcement gaps and operational implications (text‑grounded)

• Single maximum penalty: The by‑laws set a single maximum monetary penalty for any breach, without differentiating severity, recidivism or size of development. The instrument leaves procedural enforcement, remedial action and escalation to other written law or council practice, not to these by‑laws. Practitioners must therefore expect enforcement to occur primarily through planning approvals and council compliance practice rather than via an extensive penalty schedule contained in the by‑laws.

• Coordination with Building Act enforcement: For works requiring a building permit, the Building Act 2011 regime will be the operative enforcement architecture for construction standards, inspections and certification, while the by‑laws define separate siting, plot ratio and parking constraints that councils will typically check at planning approval or building permit stages. Compliance therefore requires coordinating approvals under both statutory schemes.

• Role of the council as gatekeeper: Councils determine many of the critical compliance questions through approval and discretion powers (by‑laws 5, 21, 25). This concentrates enforcement and variance adjudication at the local level; the by‑laws themselves do not prescribe an independent state administrative review process.

The enforcement regime is therefore a hybrid: prescriptive standards enforced by council administrative processes, supplemented by a statutory offence with a capped monetary penalty. Practitioners should plan to secure council approvals before construction and to coordinate the by‑laws’ requirements with the Building Act permit and inspection processes.

The by‑laws were drafted to operate within a network of planning, building and public health instruments. The instrument expressly cross‑references and defers to other written law in multiple places.

Express cross‑references and incorporation

• Statement of Planning Policy No. 1: By‑law 3(1)(a) states that expressions used in these by‑laws that are also used in Statement of Planning Policy No. 1 have the same meanings as in that Statement. By‑law 7(c) and by‑law 9(2) also direct that certain calculations be made in accordance with that Statement. The practical effect is that measurement methods, averaging rules for non‑parallel walls and possibly other technical definitions are controlled by that external instrument.

• Building Regulations 2012 and Building Act 2011: By‑law 3(1)(b) imports meanings from the Building Regulations 2012. By‑law 4(2) excludes buildings or incidental structures from the by‑laws where a building permit is not required under the Building Act 2011 Part 5 or its regulations or an order under that Part. The by‑laws therefore operate in tandem with the building permit and building regulatory framework; where the Building Act prescribes procedures and standards, those will apply alongside or in combination with the by‑laws.

• Local Government and health instruments: By‑law 21(3) explicitly subjects separation distances for stables, fowlhouses/kennels and water closets to any by‑law made under the Health (Miscellaneous Provisions) Act 1911 applicable in the area. This requires applicants to reconcile public health by‑laws with these by‑laws in areas where such health by‑laws remain in force.

Statutory parentage and continuity

• Planning and Development Act 2005: The by‑laws were originally made under earlier town planning legislation and are now continued under the Planning and Development Act framework (notes cite former s 31 of Town Planning and Development Act 1928 and continuation under s 262 of the Planning and Development Act 2005). The by‑laws therefore function as subordinate planning instruments within the State planning framework.

• Local planning schemes: Several provisions are “subject to” or allow councils to "prescribe under any law" different set backs or plot ratios. For example by‑law 6 allows a council to fix a lesser set back under any law in relation to a particular lot. The frequent reference to "any law" indicates these by‑laws were intended to operate alongside local planning schemes, local planning policies and possibly other local by‑laws; in practice, local planning schemes will often determine the precise local standard and permit variations or additional controls.

Operational interactions and sequencing

• Permits and approvals: Where a development requires a building permit under the Building Act 2011, that permit process will proceed in conjunction with the by‑laws’ standards. Where a proposed development contravenes these by‑laws, council consent under the by‑laws (or a local law enabling a lesser distance) will be required before construction can lawfully commence. Practitioners must sequence planning approvals, building permits and any council discretionary approvals.

• Measurement conventions and calculation rules: Because the by‑laws defer to Statement of Planning Policy No. 1 and Building Regulations 2012 for terminology and measuring methodologies, any dispute about how a distance or plot ratio is calculated will require examining those instruments. The by‑laws give example computation rules (for non‑parallel walls, passages in plot ratio) but tie them to external measurement guidance (by‑law 7(c); by‑law 13(3)).

• Ministerial and State Planning Commission involvement: For particular types of multiunit or precinct developments in general residential zones, the by‑laws provide a pathway for Ministerial modification after reports from council and the State Planning Commission (by‑law 16, Parts A-C). That creates an interaction point between local planning decisions and State oversight on larger projects.

Limits and qualifications in the instrument

• Scope exclusions: By‑law 4(2) removes from the by‑laws’ reach any building or incidental structure for which a building permit is not required under the Building Act 2011 Part 5 or its regulations. That means minor works exempt from permits under the Building Act will also be outside the by‑laws’ ambit as drafted.

• Subject to other written law: Several discretions and approvals are expressly “subject to any other written law” (for example by‑law 25). Practitioners must therefore reconcile the by‑laws with local planning instruments, development control orders, state policies and any relevant Acts.

In practical terms, compliance requires checking at least four linked documents: the by‑laws themselves, the Building Act 2011 and Building Regulations 2012, Statement of Planning Policy No. 1 for measurement/interpretation matters, and the relevant local planning scheme or council by‑laws. Certain modification routes additionally require Ministerial and State Planning Commission reports (by‑law 16).

The compilation table and marginal notes in the instrument record the by‑laws’ amendment history and the statutes under which they operate. The text includes the following legislative timestamps and amendment entries.

Original enactment and reprints

• Original by‑laws: Town Planning (Buildings) Uniform General By‑laws 1989, gazetted 28 July 1989, commenced 28 July 1989 (Compilation table).

• Reprint: Reprint 1 of the Town Planning (Buildings) Uniform General By‑laws 1989 as at 20 August 2004, incorporating earlier amendments to that date (Compilation table).

Subsequent amendments recorded in the compilation table and marginal notes

• 1993-1994 amendment: Town Planning (Buildings) Uniform General Amendment By‑laws 1993 were gazetted 7 January 1994 and commenced 7 January 1994. By‑law 26 (the offences and penalties provision) was inserted on 7 January 1994 (see by‑law 26 insertion note).

• 2012 amendment: Town Planning (Buildings) Uniform General Amendment By‑laws 2012 gazetted 5 June 2012. The 2012 amendment amended by‑law 3 (Interpretation), by‑law 4 (Application), and provided commencement details (see marginal note after by‑law 3 and by‑law 4). By‑law 3 was amended to reference the Building Regulations 2012 (by‑law 3 amended: Gazette 5 Jun 2012 p. 2363). By‑law 4 was amended to reference the Building Act 2011 Part 5 and the building permit exemptions (by‑law 4 amended: Gazette 5 Jun 2012 p. 2363).

• 2016-2017 amendment: Town Planning (Buildings) Uniform General Amendment By‑laws 2016 were gazetted 10 January 2017 and mostly commenced 24 January 2017, with parts commencing earlier (see compilation table: bl. 1 and 2 commenced 10 Jan 2017; other by‑laws commenced 24 Jan 2017 or per Gazette). By‑law 21 (siting of outbuildings) was amended in 2017 (by‑law 21 amended: Gazette 10 Jan 2017 p. 231). The marginal note shows the by‑law 21 amendment date.

Statutory continuity

• Parent legislation transitions: The by‑laws were formerly made under s 31 of the Town Planning and Development Act 1928 and are continued under s 262 of the Planning and Development Act 2005 (notes). The compilation table and notes explain that the short title of the Local Government Act 1960 was amended and cross‑referenced to the Local Government (Miscellaneous Provisions) Act 1960 by the Local Government Act 1995 (notes 2 and 3). The Instrument therefore retains continuity across changing statutory frameworks and references.

Amendment content highlights (text‑based)

• 1994 insertion of an offence provision: By‑law 26 introduced an explicit penalty provision with a capped monetary penalty (by‑law 26 inserted: Gazette 7 Jan 1994 p. 21).

• 2012 interpretative updates: By‑law 3 was updated to reference the Statement of Planning Policy and the Building Regulations 2012 for meaning of expressions, and by‑law 4 was updated to reflect the Building Act 2011 permit exemption point. Those amendments integrated the by‑laws with the modern building regulatory framework.

• 2017 outbuildings update: By‑law 21 was amended in 2017. The current text sets out explicit siting distances for outbuildings and special distances for stables, fowlhouses, water closets and private workshops, and gives the council the ability to approve alternate sitings for carports and garages (by‑law 21 as amended).

Documentary trail and citation

• Gazette citations and commencement: The compilation table lists the Gazette references and commencement dates for each amending instrument (1989 original, 1994 amendment including by‑law 26 insertion, 2004 reprint, 2012 amendment, 2016/2017 amendment). Practitioners should consult these Gazette notices for the exact amendment texts and commencement dates.

The compilation table and marginal notes in the instrument are the authoritative source for amendment history. Any further amendments after the dates recorded in the compilation table are not contained in the provided text and would require checking updated reprints or the State Law Publisher for later amendments.

The instrument, as provided, contains no judicial decisions, case names or litigation summaries. The by‑laws’ text and compilation table do not reference any court or tribunal rulings.

What the instrument shows about likely litigation vectors (text‑grounded)

• Disputes over interpretation: Because the by‑laws import definitions and measurement conventions from Statement of Planning Policy No. 1 and the Building Regulations 2012 (by‑law 3(1)), disputes may arise in practice over measurement rules for non‑parallel walls or plot ratio calculations. The by‑laws require those calculations to follow external instruments (by‑law 7(c); by‑law 13(3)), so judicial or administrative interpretation would likely focus on how those external instruments apply in particular cases.

• Council discretions: The by‑laws confer repeated discretions to councils to approve departures (by‑laws 5, 6, 21, 25). Litigation or merits review would, if it exists, typically centre on whether councils properly exercised discretion, considered relevant matters, or complied with process. The instrument itself does not set out review rights or merits appeals; those procedural avenues would be found in other written law.

• Enforcement and remedies: The by‑laws provide a maximum criminal penalty but do not set out a detailed enforcement mechanism for remedial orders. If enforcement disputes arose, they would likely involve the interplay of these by‑laws with the Building Act 2011 enforcement powers, local government enforcement powers under other Acts, and common law remedies; those instruments are not contained in the text provided.

Practical note for researchers

• Absence of listed cases in the instrument means any litigation history must be sourced externally from court databases, tribunal records or council enforcement files. The by‑laws do not themselves catalogue litigation or administrative review outcomes.

Because the source contains no litigation references, this section reports only that none are listed in the instrument and identifies the likely areas where disputes would arise given the by‑laws’ structure. For actual case law, consult judicial and tribunal records outside the instrument.

This instrument embeds several practical traps and technical points that frequently catch practitioners, each grounded in the by‑laws’ text and its cross‑references.

1. Applicability hinge on building permit exemptions (by‑law 4(2))

• Gotcha: The by‑laws do not apply to works for which a building permit is not required under the Building Act 2011 Part 5 or regulations or an order under that Part. Practically, whether these by‑laws apply to a proposed structure depends first on the Building Act permit rules. Do not assume universal application; check the Building Act permit exemptions before applying the by‑laws.

2. Definitions and measurements are external (by‑law 3(1))

• Gotcha: Core terms and measurement rules are imported from the Statement of Planning Policy No. 1 and the Building Regulations 2012. For example, by‑law 7(c) directs the calculation of average distances for non‑parallel walls to be made in accordance with that Statement. If you misapply local, informal measurement methods, you risk non‑compliance. Always obtain the relevant definitions and measurement conventions from the external instruments cited.

3. Plot ratio and lot coverage counting rules (by‑laws 10(2), 13(3), 16(4)(a))

• Gotcha: For Class 1 buildings, plot ratio includes outbuildings but excludes unroofed terraces (by‑law 10(2)). For Class 2 buildings, passages or accessways wider than 1 m are regarded as 1 m for plot ratio calculation (by‑law 13(3)). Small differences in how you treat a terrace, passage or accessway can change whether a scheme breaches the plot ratio ceiling.

4. Average distance rules for non‑parallel walls (by‑law 7(c), 9(2))

• Gotcha: When walls are not parallel to boundaries, averages must be used and the Statement of Planning Policy No. 1 measurement method applies. Failing to use the specified averaging approach can lead to incorrect setback calculations.

5. Small fixed penalty but no graduated infringement scheme (by‑law 26)

• Gotcha: The by‑laws set a single maximum penalty of $500 for breach (by‑law 26). That figure may not reflect contemporary enforcement practice or other civil remedies available under other Acts. Relying solely on the by‑laws for enforcement strategy is incomplete; check local government enforcement practices and Building Act powers.

6. Council discretion is broad and local (by‑laws 5, 6, 21, 25)

• Gotcha: Councils can fix lesser distances or approve siting contrary to the by‑laws where proper. That means compliance is partially contingent on local administrative practice and council policy. A proposal that fails the prescriptive standards may still proceed with council approval, but applications must be prepared to justify the specific variation to the council’s satisfaction.

7. Interplay with public health by‑laws for certain outbuildings (by‑law 21(3))

• Gotcha: Siting distances for stables, fowlhouses/kennels and water closets are also subject to public health by‑laws under the Health (Miscellaneous Provisions) Act 1911. You must check council health by‑laws in addition to these by‑laws.

8. Ministerial and State Planning Commission modification conditions are precise (by‑law 16)

• Gotcha: Only where the by‑law’s thresholds are met (for example, minimum lot areas or precinct sizes specified in Parts A-C) can the council with the State Planning Commission’s consent, or the Minister following reports, modify certain standards. These are not open‑ended powers; the by‑law prescribes minimum sizes and the social/aesthetic satisfaction test.

9. Vehicle manoeuvring and turning requirements are strict (by‑laws 11(3), 19)

• Gotcha: By‑laws require on‑site turning so vehicles can enter the street without being reversed into it. Practically, you must demonstrate turning templates and manoeuvring plans for parking and loading areas. Failure to show this on plans will likely lead to refusal or conditioning.

10. Outbuildings aggregate area cap and height limit (by‑law 22)

• Gotcha: For lots with Class 1 dwellings, the total outbuilding area is capped at 50 m2 unless the council approves otherwise (by‑law 22(3)). Wall heights are capped at 3 m unless the council approves otherwise (by‑law 22(1)). These are cumulative constraints; multiple small structures that individually appear minor may in aggregate breach the cap.

11. Legacy and transitional references in notes

• Gotcha: The by‑laws reference older statutes and instruments in the marginal notes (Local Government Act 1960, Town Planning and Development Act 1928, Uniform Building By‑laws 1974). While those references record legislative history, practitioners must be careful to rely on current Acts and the Building Act 2011/Building Regulations 2012 for operative rules.

12. Multiple numeric standards across different parts

• Gotcha: Different parts of the by‑laws (for example the simple Class‑specific by‑laws 7-13 and the detailed general residential zone tables in by‑law 16) contain different numeric standards. Ensure you apply the table or by‑law that is applicable to the lot's zoning and class of development. Misapplying the wrong table can produce incorrect compliance assessments.

In all these scenarios, the safe course is to check whether the by‑laws apply to the proposed works (by‑law 4(2)), identify the building class via the Building Regulations, apply measurement conventions from Statement of Planning Policy No. 1, and seek early engagement with the council where discretion or Ministerial modification pathways may be necessary.

This is a practical checklist, grounded in the by‑laws, for preparing compliant proposals and managing approvals. Follow the sequence and citation pointers below.

1. Confirm applicability and building class (by‑laws 3(1), 4(2))

• Step: Determine whether your proposed works require a building permit under the Building Act 2011 Part 5 and its regulations. If not, these by‑laws may not apply (by‑law 4(2)). If you do require a permit, identify the building class using the Building Regulations 2012 and the Building Act definitions; the by‑laws’ numeric rules apply according to the relevant class.

2. Establish lot data and zoning (by‑laws 8, 12, 16)

• Step: Record lot area, frontage and zoning classification. Check minimum lot area and frontage thresholds where applicable: Class 1 single dwelling minimum lot area 550 m2 and frontage 15 m (by‑law 8); Class 2 minimum frontage 20 m (by‑law 12); Class 6 minimum area 185 m2 and frontage 5 m (by‑law 18). For lots in a declared general residential zone, consult the relevant Part (A, B or C) table in by‑law 16 for specific lot area, frontage, setback, lot coverage and plot ratio standards.

3. Calculate building envelope, plot ratio and lot coverage (by‑laws 10, 13, 16)

• Step: For Class 1 buildings, ensure the plot ratio does not exceed 0.5 and remember building area includes outbuildings but excludes unroofed terraces (by‑law 10(1)-(2)). For Class 2 buildings, use the plot ratio table linking area covered by building to the allowable plot ratio and apply the passage/accessway rule treating widths over 1 m as 1 m (by‑law 13(1), (3)). In general residential zones, apply the lot coverage percentages linked to maximum plot ratio in by‑law 16(4)(a).

4. Measure set backs and separations using the correct conventions (by‑laws 6, 7, 9, 16)

• Step: Apply the numeric setback distances for frontage, rear and sides appropriate to your building class and number of storeys (e.g. Class 2 setbacks per by‑law 7(b)). For walls not parallel to boundaries, compute average distances in accordance with Statement of Planning Policy No. 1 as required by by‑law 7(c) and by‑law 9(2). For multiple buildings on the same lot, apply the 9 m minimum or the formula in by‑law 16(4)(b) to determine minimum separation, including the circumstances where the formula may be reduced by 15%.

5. Design parking, loading and manoeuvring (by‑laws 11, 16(d), 19, 20)

• Step: Provide parking behind the setback at the prescribed rates (Class 2: 11/3 spaces per dwelling, by‑law 11(2)), ensure minimum car space dimensions 5.4 m x 2.4 m excluding access drives (by‑law 16(4)(d)), and prepare turning templates to show a motor vehicle can enter the street without reversing (by‑law 11(3); by‑law 19). For Class 6, 7 and 8 buildings, ensure loading docks wholly contain vehicles on the lot and permit entry to the street without reversing (by‑law 19). For refuse and servicing, include rear access at least 1 500 mm wide that does not pass through the building or arcade (by‑law 20(1)-(2)).

6. Design and locate outbuildings in compliance (by‑laws 21-22)

• Step: Ensure outbuildings are set back no nearer to the frontage than the principal building and not less than 6 m from other street boundaries unless council approves lesser distance (by‑law 21(1)). Maintain minimum 1 800 mm separation from Class 1, 3 or 4 buildings (by‑law 21(2)). Observe the special separations for stables, fowlhouses/kennels, water closets and private workshops and check applicable health by‑laws (by‑law 21(3)). Limit wall height to 3 m unless council approval is obtained and ensure total outbuilding area for lots with Class 1 buildings does not exceed 50 m2 unless council approves otherwise (by‑law 22(1), (3)).

7. Check flood and earthworks constraints (by‑laws 23-24)

• Step: Confirm with council whether the lot is defined as land liable to flooding or inundation. Do not propose building on such land (by‑law 23). Keep newly formed embankments and excavated faces to 1 m height or obtain council approval for higher works (by‑law 24).

8. Consider council discretion and modification pathways early (by‑laws 5, 25, 16)

• Step: If your scheme does not conform, prepare a variation justification addressing local amenity, social and aesthetic considerations where applicable. For general residential zone modifications beyond local discretion, check the thresholds allowing the council with State Planning Commission consent or the Minister to modify standards (by‑law 16 Parts A-C). For proposals over one hectare or precincts meeting the by‑law thresholds, prepare the required comprehensive architectural and subdivision plans and be ready to supply information for council and State Planning Commission reports.

9. Prepare documentation and calculations to external standards (by‑laws 3, 7(c), 13(3))

• Step: Include plot ratio calculations showing how outbuildings and terraces are treated, dimensioned setback plans using the Statement of Planning Policy No. 1 measurement conventions, access and turning templates, loading dock containment templates, and clear notation where passages/accessways widths are treated as 1 m for plot ratio (by‑law 13(3)). Provide evidence of compliance with the 50% natural planting requirement for general residential zones where applicable (by‑law 16(4)(d)).

10. Apply for council approvals and coordinate with building permit (by‑laws 5, 4(2))

• Step: Lodge any required planning application with council early, attaching demolition proposals if the lot is already occupied by a Class 1, 2 or 3 building and you propose a new Class 1/2/3 building (by‑law 5(1)(d)). Coordinate building permit lodgement under the Building Act 2011 Part 5 with the council planning approval process so that the by‑laws’ requirements are cleared before construction.

11. Deal with enforcement and penalties (by‑law 26)

• Step: Be aware that contraventions may attract an offence penalty (by‑law 26). For borderline or contentious issues, obtain council confirmation of approval in writing and, where reasonable, seek advice on whether remedial works or retrospective approvals are possible.

12. Seek pre‑application meetings and formal advice

• Step: Given the numerous discretions granted to councils and the cross‑referencing to external instruments, arrange a pre‑lodgement meeting with council planners and building officers to confirm applicable standards, measurement conventions and likely conditions. If broader modifications are sought under by‑law 16, early engagement with State Planning Commission pathways and the Minister’s processes is advisable.

This compliance checklist follows the by‑laws’ order and makes the practical connections necessary to produce a complete application. Because the by‑laws repeatedly defer to other instruments and to council discretions, obtaining definitive answers often requires early council engagement and reference to the Building Act 2011, the Building Regulations 2012 and Statement of Planning Policy No. 1.
