sec.70 Restriction on charges that may be imposed
A person must not charge an amount in relation to the towing, storage, viewing or accessing of the motor vehicle, or the taking of property from the vehicle, other than— a towing charge under section 71 ; or a storage charge under section 72 or 73 ; or a viewing charge under section 74 . Maximum penalty—50 penalty units. A person must not charge an amount in relation to the release of the motor vehicle from the location to which it has been towed other than a release charge under section 75 . Maximum penalty—50 penalty units. To remove any doubt, it is declared that a cancellation fee is not an amount in relation to— the towing, storage, viewing or accessing of a motor vehicle; or the taking of property from a motor vehicle; or the release of a motor vehicle from the location to which it has been towed. In this section— cancellation fee means an amount charged to a person for failing to attend an appointment outside business hours to view, access, take property from or retrieve a motor vehicle. (sec.70-ssec.1) A person must not charge an amount in relation to the towing, storage, viewing or accessing of the motor vehicle, or the taking of property from the vehicle, other than— a towing charge under section 71 ; or a storage charge under section 72 or 73 ; or a viewing charge under section 74 . (sec.70-ssec.2) A person must not charge an amount in relation to the release of the motor vehicle from the location to which it has been towed other than a release charge under section 75 . Maximum penalty—50 penalty units. - (a) a towing charge under section 71 ; or
- (b) a storage charge under section 72 or 73 ; or
- (c) a viewing charge under section 74 .
