sec.68 Definitions for part

In this part— non-chargeable activity means— responding to a request— to tow a motor vehicle; or to attend the scene of an incident, a place at which a motor vehicle has been seized or a private property; or travelling to the scene of an incident, a place at which a motor vehicle has been seized or a private property; or taking steps to find the owner of a motor vehicle; or using a device on a tow truck to lift, load or move a motor vehicle; or taking or producing photographs; or storing movable property that is inside a motor vehicle; or allowing the owner of a motor vehicle stored in a holding yard or the owner’s agent— to view or have access to the vehicle during business hours; or to take property from the vehicle during business hours; or moving a motor vehicle stored in a holding yard within the yard or to an entrance to the yard; or releasing a motor vehicle from a holding yard during business hours; or administrative tasks, including preparing and sending a document or information. a record made under section 25 or an inventory made under section 66 non-chargeable matter means— fuel costs relating to the operation of a tow truck; or time spent by a person at the scene of an incident, a place at which a motor vehicle has been seized or a private property, other than working time; or the purchase of tools or equipment; or the attendance at the scene of an incident, a place at which a motor vehicle has been seized or a private property of more than 2 persons to operate, or assist with the operation of, a tow truck; or the attendance at the scene of an incident, a place at which a motor vehicle has been seized or a private property of a tow truck if the tow truck is not used to move a motor vehicle from the scene, place or property. working time means— in relation to a motor vehicle damaged in an incident in a regulated area—time spent at the scene of the incident, after an authorising person for the vehicle has given a towing authority for the vehicle— preparing the vehicle for towing; and cleaning the scene; or in relation to a motor vehicle seized in a regulated area—time spent at the place of seizure, after an authorising person for the vehicle has given a towing authority for the vehicle, preparing the vehicle for towing; or in relation to a motor vehicle to which part 7 applies—time spent on the private property on which the vehicle is parked— taking reasonable steps to find the owner of the vehicle; and preparing the vehicle for towing.

• (a) responding to a request— (i) to tow a motor vehicle; or (ii) to attend the scene of an incident, a place at which a motor vehicle has been seized or a private property; or
• (i) to tow a motor vehicle; or
• (ii) to attend the scene of an incident, a place at which a motor vehicle has been seized or a private property; or
• (b) travelling to the scene of an incident, a place at which a motor vehicle has been seized or a private property; or
