sec.37 Obtaining or attempting to obtain authority for services other than towing services

This section applies if a motor vehicle is damaged in an incident in a regulated area. A relevant person must not, while the owner of the motor vehicle or the owner’s agent is at the scene of the incident, obtain or attempt to obtain the authority of the owner or the owner’s agent for the carrying out of a service other than a towing service. obtaining or attempting to obtain the owner’s authority for the carrying out of repairs to the motor vehicle by someone else Maximum penalty—40 penalty units. Subsection (4) applies if the motor vehicle is towed by a tow truck from the scene of the incident to premises stated in a towing authority for the vehicle. A relevant person must not, before the motor vehicle arrives at the premises, obtain or attempt to obtain the authority of the owner of the vehicle, or the owner’s agent, for the carrying out of a service.
