sec.115 Original decisions— Act , s 123
For section 123 of the Act , definition original decision , paragraph (b) , the following decisions are an original decision— a decision made under section 96 to revoke an exemption decision; a decision made under section 99 to give a temporary holding yard approval subject to conditions; a decision made under section 99 to refuse an application for a temporary holding yard approval; a decision made under section 103 to refuse an application to extend the period of a temporary holding yard approval; a decision made under section 103 to extend the period of a temporary holding yard approval by a shorter period than stated in the application for the extension.
- (a) a decision made under section 96 to revoke an exemption decision;
- (b) a decision made under section 99 to give a temporary holding yard approval subject to conditions;
- (c) a decision made under section 99 to refuse an application for a temporary holding yard approval;
- (d) a decision made under section 103 to refuse an application to extend the period of a temporary holding yard approval;
- (e) a decision made under section 103 to extend the period of a temporary holding yard approval by a shorter period than stated in the application for the extension.
