#### 62 Prohibition on obtaining authority to repair 62 Prohibition on obtaining authority to repair > > (1) A person must not obtain or attempt to obtain from another person the other person’s authority for the repair by a particular repairer of a motor vehicle that has been involved in an accident before it is delivered to the place specified in the towing authorisation relating to the motor vehicle as the place to which it is to be towed. > > > > Maximum penalty—50 penalty units or imprisonment for 6 months, or both. > > > (2) If— > > > > > (a) an authority for the repair of a motor vehicle is obtained in contravention of subsection (1), and > > > > > (b) within 48 hours after obtaining the authority the person who gave the authority to repair (or the person’s agent) revokes the authority by written notice given to the repairer in respect of whom the authority was given or to an employee of that repairer, > > > > the person revoking the authority is not liable for any costs or damages arising as a result of giving the authority or revoking the authority, or for the cost of any work performed on the vehicle after it was towed to the place specified in the towing authorisation. > > > (3) In this section, repairer means a person who carries on the business of repairing motor vehicles. > > **s 62:** Am 1999 No 61, Sch 1 \[16\] \[17\].
