sec.102 Seizure of property subject to security
An authorised officer may seize a thing, and exercise powers relating to the thing, despite a lien or other security over the thing claimed by another person (the claimant ). However, the seizure does not affect the claimant’s claim to the lien or other security against a person other than— the authorised officer; or a person acting under the direction or authority of the authorised officer. (sec.102-ssec.1) An authorised officer may seize a thing, and exercise powers relating to the thing, despite a lien or other security over the thing claimed by another person (the claimant ). (sec.102-ssec.2) However, the seizure does not affect the claimant’s claim to the lien or other security against a person other than— the authorised officer; or a person acting under the direction or authority of the authorised officer.
