#### 115 Delegation 115 Delegation > > (1) The Minister or Treasurer may delegate to a public servant or an officer of a class prescribed by the regulations all or any of the functions conferred or imposed on the Minister or Treasurer by or under this Act, other than— > > > > > (a) this power of delegation, or > > > > > (b) the function of granting or refusing to grant a licence for the conduct of an off-course totalizator, or > > > > > (c) any other function prescribed by the regulations. > > > (2) The Secretary of the Department of Enterprise, Investment and Trade may delegate the exercise of any function of the Secretary under this Act (other than this power of delegation) to— > > > > > (a) any person employed in the Public Service, or > > > > > (b) any person, or any class of persons, authorised for the purposes of this subsection by the regulations. > > **s 115:** Am 2019 No 14, Sch 1.23\[1\]; 2022 No 59, Sch 3.67.
