sec.82 Supply to children prohibited
An adult must not supply a smoking product to a child (the relevant person ). Maximum penalty—140 penalty units. It is a defence to a charge under subsection (1) for the defendant to prove that at the time of the offence the defendant honestly and reasonably believed that the relevant person was an adult. s 82 amd 1999 No. 61 s 26 ; 2001 No. 20 s 17 ; 2004 No. 47 s 11 ; 2023 No. 16 s 17 (sec.82-ssec.1) An adult must not supply a smoking product to a child (the relevant person ). Maximum penalty—140 penalty units. (sec.82-ssec.2) It is a defence to a charge under subsection (1) for the defendant to prove that at the time of the offence the defendant honestly and reasonably believed that the relevant person was an adult.
