sec.77 Supply of tobacco products from vending machines
A person in charge of a tobacco product vending machine in liquor licensed premises must not allow a child to obtain a tobacco product from the vending machine. Maximum penalty— for a first offence—70 penalty units; or for a second or later offence—140 penalty units. However, the person does not commit an offence against subsection (1) if, before the child obtained the tobacco product, the person had taken the prevention measures. s 77 amd 2001 No. 20 s 13 ; 2023 No. 16 s 3 sch 1 (sec.77-ssec.1) A person in charge of a tobacco product vending machine in liquor licensed premises must not allow a child to obtain a tobacco product from the vending machine. Maximum penalty— for a first offence—70 penalty units; or for a second or later offence—140 penalty units. (sec.77-ssec.2) However, the person does not commit an offence against subsection (1) if, before the child obtained the tobacco product, the person had taken the prevention measures.
